I can confirm from what I've seen from multiple outlets that both are true.
Reuters, HTC and various sources confirmed the One X and Evo LTE rumor and Verizon CFO has confirmed the other

There won't be anything you can do to your phone to keep them from throttling you.
The data will be passing through their network before it gets to your phone so they will just slow down the data passing through their network before you even see it.
No way around it unless you change carriers or use wifi.
D***...either way I'm having issues with their speed. I'm always pulling about 100kb/s as a down speed its unbelievable. I currently have 2 remedy tickets out because 3 outs of 4 techs can't do their freakn job right

Glad this came up here. So I am grannyd in on my dinc2 (signed 2yr in July) along with a really good old verizon talk/text plan and with a business discount. So all in all things are peachy for me atm.
So here are the problems: the wife has long been up and needs to ditch her iphone from work. Wtf do I do?!
1. Do I wait this out to see what the family plans look like?
2. Or do I upgrade her now onto a 4g phone and get in before the family plans come out? Hell they might actually be ok if priced decently?!
3. Could I get a used 4g phone add that to my unlimited plan?!
4. Should I add her a data line and get her an off contact phone so we aren't locked in for 2yrs?! Is that possible?!
Jezus this is f'd up. These greedy mofos will go down at some point. And here is praying that Google does it from right under their own feet (their own network)

It's true about the new Evo. I'm so sad. I would have had my phone today and activated it on a new line of service. I think that since the patent in question is not being infringed upon it won't take long to clear, but it still really sucks. It's been sucky having only Wi-Fi for my phone, and I was really excited to come home today and activate it. I really hope it doesn't take very long to go through.

Internet petition wouldn't do anything honestly. Technically with that site, 1 guy can sign it 50 times. It's just gonna raise the awareness to Verizon "hopefully", but I doubt that's gonna do anything.
Unless like couple hundred of thousands people discontinue their contracts complaining about this issue, they won't do ****.
They never care and never will.

i think we need to see an official statement about it from verizon before the real outrage from more users is present...besides those of us who read every internet post out there, 99.9% of verizon users probably arent aware of their intentions
but if there is enough of an outcry, who knows?
verizon has canned stuff before (sadly not the $30 upgrade fee) but the supposed charge for paying your bill online was shelved when people flipped out
but my interpretation of what the cfo said is this (obviously its my opinion)
your next upgrade post family data plans will force you off unlimited (or whatever tiered plan you are on if on a family plan) and into either tiered (for single line accounts) or family data plan (for those with multiple joined lines)
if you upgrade between now and when the plans start, you should be ok for the next 2 years....
however there is speculation if on a family plan (shared minutes currently, individual lines on the same account shouldnt be affected) if *anyone* on the family plan upgrades, everyone gets kicked onto a shared plan automatically (we ll see)
i *think* after family data starts, if you buy devices off contract (though if you buy directly from verizon at full price they may try to screw you) you should be able to keep unlimited data.....
but when you are off contract, verizon can (with prior notification) change the terms of your month by month status at anytime and since you are off contract and they dont have to forgive your etf (cuz there is none) its take it or leave it
id like to blame the iphone 5....funny timing that this happens when a lte iphone is looming and vzw is surely worried about the data usage that could bring
anyway, just how i see it

Not going to happen, sorry.
Every carrier is moving to this model and Sprint wont be too far behind. This will impact 1% of Verizon customers the other 99% wont even notice the change. Why? Because right now they don't even know they have unlimited data or know how much the unlimited data is for. IF they were to call and complain it would take two seconds for a Verizon rep to point out they don't even reach 1Gb of data.

1. Are you on a family plan? If not then there is no reason to wait.
2. If you move to a 4G phone now you will be on unlimited data until you upgrade your next phone
3. No. Any phone change will trigger the data change
4. You can add a line with any Verizon approved phone. You don't HAVE to buy one on contract when adding a line.
Right now I'm paying $60/month for two phones with unlimited data. If the family tier offers 3-5GB month at $50-$60 I wont sweat it. Since we both started working from home our data use has dropped dramatically. Even when we both commuted we both barely got over 3GB combined. With individual plans being 2/30 and 50/5 I can only hope the family one comes in somewhere in line.
What do the data plans start at now anyways? 4gb?

If you adjust quality settings you can make it stick. I was using Spotify an hour a day with high quality streaming and was just going over 2GB.
As for current plans, if you're unlimited you have a 5GB cap.
Oh I agree. It's just the idea of watching every friggen byte coming through. They already have me for 130/month for Fios 80/wireless. Here a-holes take my whole paycheck and fight it out with my ex.

The majority of people use 2gb of data so that's $30. Right now data cost 30$ so this won't affect the majority. Power users use more than 2 using anywhere from 5-10gb so these power users have to pay extra because Verizon loves money. I use 6gb and sometimes 8gb so ill worry about this when I grab my Droid Incredible 3

This tired plan really should be renamed to "lower caps and more money plans"..... I'm not entirely sure how on earth anyone could think this is good for the end users.
Wait ... can someone please tell me if I'm on a family plan with 3 Smart phones (my Inc2, and 2 Droid Charges) with the unlimited data, when we upgrade or renew our contract, do we get to keep our unlimited data? Or is it unclear to everyone at this moment?
If you renew your contract, you are no longer grandfathered as you are agreeing to new terms. If you have current data plans with no intention to change/renew in the near future, you are covered with unlimited data. If you buy your device at retail without renewing your contract, your contract should remain the same.
More than likely if you have an unlimited plan, you will eventually start being harassed by Verizon to renew, upgrade, or do something else that will cause contract changes on your part to switch you to a limited data plan.
I am a power user. I have used upwards to 8gb in a month on 3G. Capping at a max of $10 for an ungodly amount per month is unacceptable. This would be too easy to break on 4G and I think that is their intention.
Sprint is pretty proud of their unlimited plans. If Verizon doesn't see the light before it comes time for me to renew again, I may forego my discount and move to Sprint if Sprint continues down the path of unlimited.

I too have a family plan set up (5 devices, 4 of which are smartphones) all unltd data and a 1400 min plan, and i have been told time and time again even after the recent purchase of my Inc 2 and my inlaws Charges' im continously told im fine, im grandfathered in.
I really havent seen any flux in my bill if anything i was actually quite surprised with my monthly after the dust settled.

I should also mention that i have a corporate acct, not a regular user acct.

I'm not misinformed. If you upgrade using their upgrade option, you are also renewing your contract. Renewing your contract means new contract terms should your current contract no longer be available/valid. This means upgrading after the 7th would mean you lose unlimited data. This is why people are rushing to get their upgrades in, so they can be grandfathered in.

But everything I've read makes it sound like you are only in for the current contract...and that after its up they won't let you keep a month to month at your current rates. This sucks..

well the month to month is being abolished, that's a given. it was a marketing move to reel in more business. Once the contracts are established they were given quazy deals to move from month to month to contractual.

i just called into their corporate accounts customer service and asked all about the how to of upgrading my current min/data plan come the end of July.
the rep verbatim said "there is no change that would take affect to my account when upgrading either. She said if necessary they can actually help me by giving me some extra min's if infact i am running low on my current set to hold me over till my next billing cycle".
"but as far as upgrading there are no extra fee's nor changes in packages coming any time soon, that she is aware of".
"so when the time comes in July to simply call and make the upgrade and go ahead and do so".
I talked to some Verizon employees and they all told me that whenever I renew my contract/upgrade with Verizon, I'll still be grandfathered in with the unlimited data, I'll try asking a different store if people have heard different.
I just called last thursday, and I was asking about canceling. I was really thinking about going to another carrier, I was interested in getting a Nexus S. I wasn't eligible yet for an upgrade, but they gave me an early one which was great. But I was talking to the guy, and his argument to stay was unlimited data, I said that tiered data was going to happen for them as well. He said he nothing of this, hadn't heard anything at all.
So now this, but who knows maybe they leave their employess in the dark. And maybe they dont read up regularly on engadet and droid-life like I do.
But they really need to get the prices down a bit. Tmobile you can get 500mins, unlimited text and 5gb of data for 79.99, The same thing on verizon would now be like over $100 I could be a bit off, but this could hurt them in the future.

[I win after all after a call to retention][see further down for new developments] Each month I get my data throttled, I have to spend an hour or so on the phone until they'll open a service request ticket for some upper level honcho to press a button and clear up the problem in 5 minutes.
This time I upgraded my data plan to 10GB, but the throttle would not release. After the hour of my dealing with script following drones, a higher level support tech asked me what kind of phone I had. When I replied Galaxy Nexus, she gleefully replied that "our contract with you states we don't have to support 3G for you since you didn't buy one of our [crappy over priced phones] from us. In fact, I'm supposed to disable your 3G service. Even if you have a iPhone 4S." (Um... WHAT? iPhone? Now you're just trying to insult me.)
Just when I thought all hope was lost, my mobile muse rescued me with divine inspiration. "Oh really?" I smirked, "I just stuck my SIM card in my wife's T-Mobile Sensation™ and I'm still getting throttled. Can you support me now, biatch?"*

I got the usual, "Your service request will be processed within the next 3 business days" reply. Apparently when I upgraded, they failed to remove the 5GB red flag on my account. Generally, my service requests go through the first business day. As I called on Saturday, I expect they'll get to it today... At least that's what usually happens.
Incidentally, they let me upgrade to 10GB for $40/month for three months, and threw in T-Mobile hot spots (whatever those are). It took me three phone calls of hemming and hawing before I got offered this, but it's there.

Tmobile customer service might not be stellar but it's usually better than most other carriers.
Don't confuse the poor customer service reps with red flags like I'm using a device not sold/supported by Tmobile.
Just tell them you're using a phone that they sell/support and keep the distractions to a minimum.
This isn't a T-Mobile problem, its more of a problem with American carriers in general. They're wary to have to do anything involving a device they "don't support". Its unfortunate but kinda how it is.
Just keep on doing your thing. May I suggest going prepaid? You won't get good CS with an unlocked phone anyway, might as well not pay for it.

When you hit 5GB, you'll receive a pop up and/or SMS telling you you're being throttled for the rest of the period.
Your data speeds will also reduce to about that of EDGE, topping out at about .5mbps down / up. The icon in your status bar will still say 3G or H and you'll keep low ping times, but the speeds will be reduced.
I got sick of T-Mo and switched to StraightTalk prepaid. $45 per month for unlimited everything and I have yet to be throttled.

That's because Straight Talk doesn't throttle. They just cancel your service lol. And they do it a lot sooner than 5GB.
I agree Straight Talk is a great deal, but it's not the same as T-Mo when it comes to data. T-Mo is 100% up-front about when they will throttle you, and they'll never cut your data off or charge overages.

Yep. In about 15 months as a T-Mobile customer I've only gone over 5gb maybe 2-3 times, but only actually been throttled once. That one time I was throttled, I was notified instantly.

Yeah i don't understand this either. They are so worried about getting you to get one of "their" phones. Even if your not using their phone, your still paying for their service. You buy a phone from them, they get a few hundred in profit one time. But if they provide good service, they don't need to rely on selling you a phone because they'll be making money on the service they're selling you. I guess the carriers forget that they are providing a service, it doesn't matter what you use the service on they should support it.

Funny I had the complete opposite happen to me I called T-Mobile about slow data issue when I was in Las Vegas two weeks ago. The tech guy I talked to was real helpful and knew the GNex and was more than happy to help me. His biggest worry was that I called from my GNex and that if for some reason we would get cut off. But everyone has different outcomes when dealing with customer service. I will say that T-Mobile is light years ahead of Sprint, they just suck.

So I'm still throttled. I called back today and they now say that no matter what, they cannot lift the throttle until the end of the billing cycle. They WERE, of course, happy to take my money to backdate a data plan increase, however. How sleazy.
I call this utter and complete bull****. As a programmer and dba, I refuse to believe it's impossible to lift a throttle before the end of the cycle.
I'm now being held hostage to creeping data by my contract.
Screw you, T-Mobile.
Time to figure out my exit strategy.
Call back and ask to talk to accounts and billing so you can cancel

I know exactly how you feel ..this happen to me last month ..I got throttled last month at 5 gigs ..so next day I call upgrade to the ten ..told me within two hours my data would be back to normal speeds..one day later still slow as hell ..anyways I call tech ..they ask " what phone you have " I say "gn" they say the can't do tickets for that ..so I put my sim in a sensation 4g and a T-Mobile vibrant ..still slow ..long story short I had to wait till my billing cycle over to get my speeds back..hang in there man ...

It is definitely BS. They did it for me when I upgraded to the 5GB plan.
Im tired of sprint, ive been screwed out of an upgrade and there was countless times fraud occured while on my parents family plan through assurion but thats besides the point. im on my own plan now and the unlimited speeds are painfully slow not to mention the 4g i pay for thats not in available in my area.my question is this, if i roam over 300 megs of data a month i understand that sprint will cancel me and that is what i want but will there be an ETF? if anyone knows or has had experience with this please let me know. i apologize for posting this, i know its been discussed before but from what i read i was only seeing people who were upset about being canceled but im wanting to use this to get canceled but i was unable to determine if there will be an ETF, thanks for your help.
A) how were you screwed out of an upgrade? If there has been a legitimate error it can be corrected. For example if you returned a product but your contract didn't get reset.
B) what 4G are you paying for? Sprint doesn't charge extra for 4g,only for smartphone access.
C) using too much roaming data is technically grounds for charges by the mb, plus termination with etf still being charged. In practice, it is usually just a friendly parting of ways.
If you were unhappy with the speeds you shouldn't have signed a contract, or returned the device during the return policy. The speeds are not appreciably different now vs 8 months ago. In my area they have improved noticeably.

i think i may attempt this with you. using my basic logic im thinking if they "boot you" then you wouldn't have to pay etf cause u didn't et. but as we all know basic logic was thrown out the window by cellular companies so i could be wrong. i apologize that was a bit of a rant i should also mention i work in a different location and the speeds there are terrible but but i was refferering to the premium data charge "4g" of which is not available in my area and will not be since sprint is abondaning development for their wimax. and as far as the upgrade my last upgrade with sprint was somewhere around 2008 id say i still should have had my upgrade available due to one of my parents letting me use their upgrade to get a new device but somehow or another both my upgrade and parents upgrades were used and as far as signing a contract i didnt i perfromed a latteral transfer which allows me to pay for my own bill with out having to buy out of my parents contract although i checked yesterday and i believe it extended two years while my next upgrade isnt available for another 363 days but you do think they will charge the etf?

its worth a shot to me because i was going to pay the etf anyways right now im just using roam control im up to 391 megs in two days while roaming so id say it shouldnt be long before im flagged

Again op you do not pay for 4g access. You pay ten dollars extra because its a smartphone. Btw. You entered a contract then you are disappointed and want to leave. But you don't want to pay a dime. I just do not get peoples thought processes sometimes. I freaking love sprint. data speeds are amazing in my neck of the woods. I get 1.1mb Down and 670kb up on 3G and 16.7mb Down and 1.51 mb up on 4G. I think once I managed to pull 24mb down on 4G. All other carriers throttle you after 2gb of data use. Sprint wont. Thats just my two cents.

megs of roaming won't ever get you kicked off. Yes, they can charge you overages AND an etf if they wish, and they have on occasion. Most the time they don't though.

Not everybody gets such good speeds as you...and it's been consistenly awful for a while now.
I just ran a speedtest for me in KC, not far from Sprint Headquarters and 213kbps down and 98kbps up, and that's good for me. I'm almost exclusively am on wireless just so I can actually browse or get on the internet. That's not the reason I pay for my cellphone. You better believe I'll be looking at another carrier after my contract expires.

Yea its not earth shattering but its just another broken link in the chain of bad decisions by Sprint lately. The sad part is you sit back and go what next...
In my point of veiw all sprint has done the last year is raise cost for us! We customers who wanted 4g and bought the evo 4g most never seen or connected to 4g. 3G speeds are beyond terrible and downright bog to 1X kind of speed during busy hours. At this point the cost between Sprint and verizon service is closing more and more as we speak. So I can expect many more customers to think, Why not go to a service with great data and call connectivity. Sprint really had a good think going with cost effective plans, but since have taken away many things like discounts on all lines, premier customers, ect ect. I know they are still cheaper but for how long and when will we see good data speeds like other companies? We are dead last in that!

Personally my biggest regret is getting my S2...not because I don't like the phone, but Sprint's data service is just godawfully slow. I bet I use less than 50M a month. The second I get home I go to WiFi and when I'm out and about I just don't bother as the 3G is a joke.
Unless Sprint gets LTE here in Iowa by mid 2013, I'll pay the early termination fee for our lines and go to Verizon. When I'm a meeting a work I'll have my coworker look stuff up on his Galaxy Nexus...with the 8-12 MB download speeds from Verizon.
Life could certainly be worse, but my data speeds have nowhere to go but up.
I don't see this as a big deal whatsoever. The last line of the memo is the most important Imo. Everyone is eligible for upgrade the 1st of the month their contract is up. What more can you ask for?
As far as sprint saving money, not sure how really. I mean by allowing an early upgrade they are guaranteeing 22 months of payment out of you. Most of us would use that 2 weeks to get a new phone on launch, right? What happens when instead of getting a launch phone with them early, another carrier has a new phone being released when your contract is up? I'm blabbing, but what I'm saying is if they let me upgrade a little early I would be more likely to stay with that provider. But if I wait then I'm suddenly out of contract, which would make me shop around carriers.
Tl;dr
I see potential loss here, because they are basically giving sprint customers a reason to shop around while off contract instead of always keeping us in contract by allowing early upgrades.

Exactly, if you treat this as a separate event then its not a big deal but if you start to add up all that has happened in the past year and since the Iphone came aboard and it may upset you especially if you took 2 minutes to have this page refresh due to network restraints....

Yeah, I do wish I had verizon for their great coverage, thats what I had before my parents kicked me off of their plan.
But hey I don't mind my virgin mobile: 1200min/unlimited text/unlimited data for $40 a month. I am pretty happy with that. Even have unlimited wimax 4g
I will probably switch over to sprint in a year or two though when I can afford it better.

i live in Iowa as well. all my friends have Verizon as well. they do have nice service but they can only use 2gb a month or they pay out the ass. i get around 1mb down most days and i use about 10-16gb of data per month. my bill has never gone up and no one at sprint cares.

I think this is a good move. You guys that are complaining about it need to see what we see in the stores. This 14 day early deal is confusing to customers and abused by third party stores. The cost savings are in reduced overrides that are done when customers come in confused. Id rather have a consistent, fair policy than one that can be used to work the system by some and not taken advantage of by others. The upgrade now promo is a perfect example of a policy change that makes sense. Customers in March could pay to reset their upgrade regardless of the plan they were on. Instead of yearly upgrades for customers on expensive plans, now anyone could get it with a little extra cash if they need it.

Don't let my girlfriend see your posts. She has a Verizon Gnex but the 4g is nearly useless. We live an hour away from the Quad Cities and Verizon's 4g only covers the core of that area.
At least with Sprint, there's no teasing just out of range prospect of 4g!

Well I guess we need to wait for the exact info but there is some speculation that even someone on your family account changing phones could cause anyone on the same account to lose unlimited. My wife just recently downgraded from Android to iPhone (has had 2 HTC phones which both would not shut off the screen when she had it next to her face and she doesn't like the screen size of the LTE phones) who I guess now has a 3G unlimited plan down from a 4G plan she had when she was using my old Thunderbolt. While she doesn't use that much data and being forced into a tiered plan when she upgrades in 2 years won't be a big deal but I want to keep my unlimited even if it means buying phones off contract. The only thing that might make it ok is the $60 I pay now between both phones for data can be used for like a 10 or 20 gig bucket.
I will be pissed if they don't offer us AT LEAST the double data promo.

I think thats exactly the opposite of how its going to work, if you have a contract with them, you can make them honor it. If you do not have a contract with them, your screwed. Right now I am paying $50 for 10GB, if the "data share" thing comes through, I imagine they would charge you $10/each additional phone on your plan, you would be looking at around $60/10GB IF they are still offering the double data! That's a BIG if, you better call them right now. Normally $50 gets you 5GB.
It is what it is, these wireless companies are all the same. Personally I'm tired of the misinformation, online petitions and broken promises. When my contract is up and they try to move me or my 3G wife to another plan I'll let my wallet do the talking and go to the company that offers the best overall value.

The problem for me is VZW is the only carrier to actually have reception in my area, and everybody knows it, so they can charge whatever they want. I have a choice of paying VZW a super premium and always being able to use the device I am paying for, or paying a competitor and not having service.

I'm just shocked they won't let us use it through the rest of our contract. Giving people only a few months using it and making them switch mid contract is beyond awful.

I bought a Gnex on verizon a few weeks after it came out. I'm currently on a family plan and I'm the only one who has a smartphone on the plan (3 total phones, mine's one of the "added" lines). Currently I'm on a "month to month" I guess is what it's called. My particular line's contract expired at the beginning of this month and I am currently just paying my same charges with unlimited data, but not bound into the 2 year agreement as far as I'm aware.
What I want to know is how to handle it from here on out, if there's a way to even handle it well. I would like to renew my contract and be able to keep my grandfathered unlimited data through this garbage, which means I need to act immediately before they put this crap into effect, assuming it won't go retro active. So with that being said, can I just simply call and get my contract renewed for 2 years and that be that? Is there even a way to do that? I just don't want to blow whatever extra time I have on my grandfathered unlimited data.
I realize that all the information isn't there, but how would you guys handle this if you were in my position? I don't want to screw myself, I use 8-12 gb of data a month so this is sort of important.

Reading through all these sites and Shamu or shammon quotes sounds like people with 3g upgrading to 4g phones will be forced into the shared data plans. But hell either way were all screwed.
