Just in case any of you want to get out of your Sprint contract heres how!
On page 2/7 on your Sprint Bill it will say: Tax & Surcharge Base Changes. Effective 4/1/13, Sprint will be changing tax systems for charges such as insurance & premium content. This update may cause an increase of taxes and/or surcharges on your bill for these products. For details of taxes & surcharges, visit sprint.com/taxesandfees. This is how you get out of it because it is whats called a "Material Change" meaning it will cost you more! You have to call or chat with Sprint before the end of this month (April) or you will not be able to do it. I'm leaving because I have paid full price for half the service of 4G and LTE customers for far too long.
They may tell you its not a change but it is!
Did this work for you?
Sent from my SPH-L900 using Tapatalk 2
Hoss, a Material Change does not necessarily mean high costs... A material change just means a large enough change in the legalese of the contract to warrant an opportunity for the consumer to get out... Rather than being strong armed into the new terms with no chance for a way out without exorbitant ETFs.

Hmmm I may have use this to my advantage. I too am tired of waiting for lte and being stuck with the slowest 3g ever. My note is a glorified paperweight when not connected to a wifi network...

OP... thanks for posting this
Good to know
They're only letting people out if their bill actually goes up because it only applies to "premium" content, and so far everyone's bill has actually gone down a few cents.

So far I've only seen 2 or 3 ppl successfully weasel out on this one. There's not much wiggle room on this one since it only affects premium content and it appears the surcharges actually dropped a fraction of a percent instead of increasing. However if for some reason your bill went up by 1cent you can get out. The material change clause is only for materially adverse changes, ie effects you negatively.

I don't pay my bill personally, so I have no idea if mine actually went up. Question being. Can my Note II be sold and activated by someone else? I got a cease and desist letter when I was forcing roam on my last phone. I assumed they'd just cancel my contract and I'd get to keep my device.
Finally who is everyone changing to? Verizon is a minimum $100 with $60 of that being 2GB of data, which is paltry. I don't so much care about the money I'd like better service, but 2GB of data isn't likely enough.

Stopped at the local Sprint store and they knew nothing. I called customer service and they told me you can't get out of the contract for surcharge or tax changes. Not sure I believe it or not.
I was just looking at Ting today (Ting.com) and thinking to myself - man this would be a good deal for someone who's currently with sprint and was out of their contract. I then realized I'd owe Sprint an ETF of $350 for my Note 2 which killed my dreams. Also I want to get my wife an S4 this month.... not sure if I want to go subsidized for $250 and go another 2 years or if I'd like to try to get out of the contract this way and buy it outright for the likely $600+ that it would be from amazon or the likes.

Never believe the first level customer service person. You have to go above their head. Also, the sprint store knows nothing unless they get it in some technical bulletin (in which case you're lucky if they actually read it and aren't a 17-yr-old-dropout)

Priced Verizon today. About $9 more per month for me and my girl. Yes I know they cap the data, but it's there when you need it. Spend most of my time on wifi, so data not a deal breaker for me.

Prolly worth mentioning Ting uses Sprint's network. I would also disect their plans and compare to your usage. It's hardly a good deal at all for anyone that uses their phone.

Making that assumption about Sprint stores is absurd. Most of my team is in their 30's and have a good idea of whats going on. When they don't they find the answer.

use a 3G roaming prl and download a TON of (legal) torrents. It might take 2 to 4 months, but they will drop you from service.

Or....you could be civil about it. Call care, and plead your case, nicely. They have been known to allow customers out of a contract without and etf so long as the equipment gets returned, ask them if they'll make exception for you and let you do that
EDIT: never mind, I read your original post. I do think it's unreasonable to expect to not have to return the phone and not pay an etf either. Regardless of the amount you paid for the phone, you did enter a contract, and sprint ate a lot of money up front when you signed that contract.
If you feel so strongly about it, though, just cancel and eat the etf cost, and you should more than make up for it by how much you can sell the phones on eBay.

I've been a Sprint customer for 10+ years and I've had almost zero complaints until these dang smart phones became the mainstream thing to have. Back when I had my Samsung Instinct the speeds were GOOD. For example, tethering was around 1.5mb all day long. By the time I got the EVO 4G though, things went down the toilet. Smart phones got super popular and Sprint simply couldn't handle it.
To top that off we got slapped in the face with a $10 dollar premium for 4G, oh excuse me "premium data" that doesn't even work for most of us. I have no 4G here and I' lucky to get 50kb's on 3G. I get 1.2mb on the Verizon PRL though.
I'd been using the 11115 PRL and toggling between Sprint and Verizon when I needed more speed but I've recently switched to the 00002 PRL in hopes of getting dropped. I shouldnt HAVE to toggle to Verizon to make my phone work.
I've complained to Sprint, they simply do not care. I bet they will start to care when I plug my phone in this weekend and pick some random Blue-ray sized files to torrent over 3G.
Can't wait to get over to AT&T or Verizon. I loved Sprint when it worked. I'd rather have a 5GB cap that works then unlimited that doesn't. Who cares about unlimited if you can't use it?
The plus side to having them boot me is I can keep my Epic Touch and resell it to help re-coop some of the money I feel I got scammed out of dealing with Sprint now that they don't seem to want to fix their network or compensate those of us who are/were loyal customers and are sick of this slow non-usable network.
Great...another thread for people to come in and post about how crappy Sprint's speed is and to teach people how to screw Sprint and the other millions of Sprint users that don't have problems (like me) by forcing your phone to roam and download tons of data.
amen sister.
I'm almost 1 year into my 2 year contract with sprint and I cannot wait until I can get out of it. I signed on because of unlimited data, which is great because I get 4g at work, but if I'm not at work or near one of the sp****ly placed 4g towers, I'm screwed.

do you have 4g wherever you go in your city?
My problem is that there are 6 4g towers placed around cincinnati and if you're not withing 1-2 miles of it, no 4g for you. Then, because we are a fairly dense market, the 3g speeds suck and the phone is almost useless.
Sprint does suck. Sprint has fallen so far behind the competition that i'm shocked that anybody ever renews a contract with them.
Yeah my service with sprint (virgin mobile) ain't great but hey I pay $25 a month for service. You just can't beat that!

It I was paying $25 a month, I wouldn't ***** but I'm paying $108ish and I feel like I'm being kicked in the balls.
Being a 10+ year Sprint customer who has seen the service go down the drain, I have every right to complain because I know how it used to be before they decided to add all these new smart devices but not add new network to back them up.

Yeah, I have no plans of using the Verizon PRL and get kicked. I have been in touch with customer service and it is getting to the point where they might let me out without ETF. I did not know that they would request the phones to be returned so I am trying to decide 1) if that's reasonable, and 2) if it is, then if it would be cheaper to pay ETF instead.
Tell them to refund your $200.00 dollars and you will be glad to return it.
I would be annoyed if on top of paying for the crap service they also wanted the phone back.

Agreed as well. If you sign a contract, man-up and fulfill your side of the agreement.
I totally do NOT agree with that. If you sign a contract and the provider can't provide what has been promised, the contract should be void.

I agree with u op. Sprint speeds have gotten a lot worse for me as well. My phone is not usable unless I'm on wifi. Its ridiculous. BUT u did sign a contract and you had two weeks to try it out. Hope it works out for u.

The attitude of well it sucks but i did sign a contact that specifically does NOT make any speed promised etc is exactly why we keep getting screwed.
Considering I'm paying $108 dollars a month, $10 of that being for "premium data", it should at least WORK. On my phone, its unusable off wi-fi. No joke, sites can take up to 2 and 3 minutes to load and that is IF it loads. Normally something times out.
That is a load of crap, hence why I'm currently forced roaming on Verizon.

If it is so bad that you cannot even use it, you need to call Sprint, and keep calling them until they either fix it or they let you out of your contract because they are not living up to their obligation to the contract. Coming on XDA and crying about it will get you nowhere. This is a development website, not a ***** fest site about the provider. Take this **** elsewhere.
I'm going to stop this before it goes any further. Sorry your speeds aren't up to par (mine aren't either), but you will need to find another way than discussing here. Contracts are contracts, no way around it. Just call and call until you get the answer you want. This will turn out to be a war and we do not need that here as we have enough of that already.

This has some potentials.
2/3 owning state in Sprint would give control to them.
It would give Sprint a pretty healthy infusion of cash.
It gives Softbank access to more spectrum.
It gives Softbank the roaming agreements in the USA that it wanted.
It gives Softbank access to more phone systems they may want and possibly in reverse to Sprint.
It'll drive Sprint's stock price up. Short term anyway.
It has the potential to make Softbank/Sprint and everything else they own one of the largest global cell providers.
More than likely Sprint will continue to be treated independently in the USA under the guiding hand of them. Until they figure out what they want, I suspect pricing, unl data, etc won't change for awhile. After 2 years, anyone's guess tho.
Makes me sad because the possibility of Google buying Sprint goes down further

TMo and Sprint are definitely seeing gains from Verizon's apathy toward its customers. This Network Vision could really change the game.
We may see a lot of new devices come out too
i knew my "$10 premium data fee" on 4 lines was being used for something!!! it darn sure hasn't been used for getting me "premium data" since I started paying it over 2 1/2 yrs ago!!
"By raising some new equity directly, Sprint would be able to shore up its balance sheet and potentially fund other deals such as a buyout of Clearwire in which it already holds roughly 48 percent."

Give it up already. Same post in a few different threads now? C'mon man.
We get it...you hate Sprint and everything about them. Obviously that statement pertains to the cash they'd receive in selling a majority stake in their company.
I wouldn't fathom some of that money we've all been paying has gone towards the biggest network upgrade any cell provider has ever gone through...upgrading every single of their 30,000+ towers? No, it couldn't be something like that.

So, I'm not sure that I should be blaming Sprint or not on this one, but as far as I can see, someone has to be blamed. I am currently running with my good ol' GS1...Yes, the OG Galaxy S1 (Epic) on Sprint. I am all set to upgrade and have been waiting patiently for Black Friday.
SOOO... I have been checking the leaked ads as well as checking with stores, connections, forums, whatever....and everyone (AT&T, T-Mobile, Verizon) is giving away their GSIII phones on black friday through a bunch of different retailers (Sams, T-Mobile site, Wal-Mart, Radio Shack).....all except for Sprint!
Yes...I have seen it as low as $49 in Best Buy (Allegedly, after waiting in line for 5 hours), but why not Free??? I'm not trying to make a big deal out of it, but sh!t, Sprint....not for nothing, but I don't even have a good argument for you anymore.
I used to brag to my friends about the unlimited data that I had...at less of a cost than their 'Throttled' T-Mobile data, but my 'Full Speed' downloads are slower than their throttled speeds. I think should be doing everything they can to increase their customer load...since in the past 4 years, their service has gone to crap. I have been a loyal customer for over 10 years and right now I wish I didn't have other family members on the plan that were tied to contracts. They are the only thing keeping me with Sprint right now.
Ok...Off my Rant box..............
Anyone else have anything to say? Did I miss the invitation to the 'FREE' party? Should I not be *****ing about this? As far as I know, you all probably didn't get a free phone either, so I am sorry if I sound a little...*****y. I guess my question would be....Why stay with Sprint? (Maybe just looking for a little reassurance)
Sprints customer service ratings are pretty good. We have better cheaper plans. You could go get the free phone and pay more for less but you probably won't or you wouldn't still be on the og epic. Pay the 50 bucks and lose the entitlement so we can keep our data unlimited. Seems like a small price to pay.

Ya but $0.96 is a bigger steal. And only thing they really have to keep their customer base is a promise of awesome 4g ln the coming months. Question is, is that enuf for u to Stay? All while you pay for a premium data add on for 1x type speed. If tmo had the uncapped unltd data in june u better believe I'd be with them instead right now. I get where the op is comin from. Granted sprint may still come out with something nice for black Friday considering the value of this phone seems to be plummeting thanks to the note ii

I sent an update reply. I did see that they had it for $.96. I'm not greedy or feel entitled. I was simply wondering why every other carrier had it for $.96. Why is that so out of line? Would anyone willingly pay $50 more for the EXACT same device just so they wouldn't have a feeling of entitlement or so that they could say that they weren't complaining?
well part of the problem is that we live in a very selfish society if we can't have something we get upset if anybody else can get it so for example if you paid 100 dollars you might be annoyed at anyone else getting it for 50 dollars so you would complain about their position or claim there entitled because they are potentially getting a better deal than or desiring a better dealg or if you would want to get that better deal you wouldn't be complaining that your part of the nature of human beings
you also see a little bit of if I can't have it neither should you mentality
our society is based around on getting the most you can at least you can and we massively overpay for cellular service in this country so we tend to look for the best deal we can get
this further create animosity when someone else manages to get a better deal than you did so we complain about it
Is normal and natural don't let it bother you

Yeah, selfish people tend to have bad grammar too.
I was using dictation on the phone and is that the best you can come up with for a reply? really? lame
Well it's been fun everyone but I just got a letter from sprint letting me know they will be terminating my contract for excessive roaming. I find it funny though because Since I was laid off in late november I've used mostly WiFi at home... but my contract is up on march 13 after that I'm probably going back to T-Mobile. So long to everyone on sprint forums from the Nexus 4G the GS2 and right here on the GS3.
Super cool story, bro.

I'm sorry...I found that funny as well.
On subject...it worries me when I read that people are getting the boot from Sprint. I don't abuse my connection at all, but I'm always curious why folks would be told to leave. It's not like Sprint is doing all that well these days.

I know some folks like to force roam for whatever reason, but what if your phone is doing it on its own because Sprint's network is not as robust? I suppose Sprint could always say that person x isn't a good customer for them...but it is always surprising at least to me, to hear.

Sprint will offer the airwave for people in that situation. You usually get warned before they terminate your contract. That'd be the time to ask about the airwave.
People who force roam to get out of their contact w/o the etf need to grow a pair. You signed a contract you need to honor it or pay the etf if you want to leave.

Yeah it gets on my nerves when ppl force roam off cuz it makes the rest of us suffer price hikes and loss of perks, sprint has to recoup the money they lost 1. On the contract they just terminated and 2. On the roaming tab that customer left them with. Off network roaming costs sprint a small fortune they pay something like $1.50 for every 500MB you use off network so $3 a GB if you roamed 9 GB they now have to pay $27 to whoever you roamed on, usually VZW. And they let it go for 3-6 months so in the end they end up paying close to what your etf should be plus forfeit your etf so they lose out 2x what they should have broken even on.
And to put things in perspective for costs, it only costs sprint about 9/10ths of 1 cent per GB you use on their network. So 10GB costs them 9 cents versus ~$30 off network

Dish Network Offering to Buy Sprint in $25.5B Deal
This merger is interesting because more money could mean faster deployment of LTE
More spectrum could mean more coverage and/or faster data speeds.
A quick note about spectrum from the DISH investor presentation:
*DISH holds licenses to 45 MHz of spectrum
*Consumers will now have access to a package of mobile video channels via high-powered 700MHz band.
Some very big potential benefits. However I have never had DISH service and would like to know how they treat their customers?
Update from S4GRU on the spectrum holdings of DISH:
AWS-4 band: 2000-2020 MHz x 2180-2200 MHz (nationwide)
Lower 700 MHz E block: 722-728 MHz (nationwide, except New York, Los Angeles, Philadelphia, Boston, San Francisco)

I hear Dish is not very friendly towards customers. They would most indefinitely remove unlimited data to make more money off sprint subs. Also, it's likely Hesse would be out the door. I'd rather Sprint stick with Softbank.

This is what I am seeing in comments on lots of sites today....scary stuff, it seems like Sprint should stay far away from a company with very poor customer service.
Spectrum means A LOT.
But why did Dish wait so long to make an offer? Seems odd. This will, especially if Sprint ultimately opts for the Dish deal, slow down the buyout process. That means it will take that much longer for Sprint to have cash, which means it will be that much longer before we have a network. The process of Sprint's upgrades gets pushed back for the millionth time.
Remember when Sprints goal was to have the upgrade process relatively completed by this years end? Yeah, maybe 2015. Maybe. Probably about the time big red starts rolling out "5G." (Joking... Well, half joking.)
Sprint isn't known for making wise decisions. Now that they have an option, look for them to take the crappier deal.
The SoftBank acquisition was nice because it seemed there would have been minimal changes on our end. It had more of the look of an investment than a buyout.
But SPECTRUM! In this day and age that's worth more than cash. Even though it appears they offered more of that too, with a reported less stake in the company. Edit: Less cash, with stock offer.
All in all, I have a year left on contract, I hope the buyout is completed by then (whichever one) so I'll have a better idea whether or not it is best to stick with Sprint.
They were already bought by soft bank so technically Dish would be buying Softbank, that is of course of it goes through but I hope Dish doesn't get it. They are horrendous

That deal has not gone through yet. Sprint had accepted the deal, but it wasn't due to be finalized until this summer. Sprint could back out and go with Dish.

If unlimited data is eliminated or the prices go up too much, I'd have to make the jump to another carrier... We all know that Sprint's network isn't stellar (yet, hopefully), so the main things keeping me here are the unlimited data and (relatively) low prices. If Dish Network does buy Sprint and the predictions are true, it'd most likely be enough to lose me as a customer. (and because I'm egotistical, that must be the worst thing that could happen to Sprint. Just kidding!)
I have dish network and there costumer service is great.. At least for me. . Also my bill is only 57 dollars a month.. And I get almost all the channels including blockbuster on demand.. And I can watch the on my phone, tablet, or computer. . I can even watch what I have on my dvr.. I love dish network and if they buy sprint, then we will have pretty much a empty spectrum. . Which means faster data because it won't be over crowded like it is now.

I'm lucky to be in a really good Sprint affiliate area. I would hope that if this buyout happens, it wouldn't change much but I'm sure it will be bad for all customers.

I'd have to agree with you. I have dish and the only complaint I have had is when the get in contract disputes with channels and drop em until the issue is resolved. Other than that they have the best pricing for satellite HDTV and high speed satnet. DirecTV is a fu*king joke I pay half of their basic package for full premium HDTV including all movie channels. Their satnet is a little pricy at $120/mo for 40gbs but it's also the fastest of all the satnet options at 15/5 or 15/10 depending on the package, where most other's are 5/1 or at best 10/5. Hughesnet only offers a max 7.5/2 @ 15gb for $80/mo and $10/gb overage. Dish's overage is $10/5gb block. Every time I've had a complaint they knock $10-50 off my bill plus give us an additional $30 towards PPV. Their customer service is always polite and friendly and overly apologetic and the sat only goes down in extremely heavy rains and its only out for about 30mins max, typically less than 10, while it relocks another available sat. I also don't see Hesse allowing dish to remove unlimited if they struck up a deal as that's his big selling point and something he touts like its his first born child.

I have a question that someone might have a answer to but might not...say DISH does buy sprint and then comes in and removed unlimited data from everyone's plan. Technically they are changing or breaking the contract we signed up for so could we leave them without an ETF because they are the one's that are changing it?

Yes, if they don't grandfather in existing customers or allow you to keep your existing plan thru the end of your current contract. There's ways for them to get around letting you out ETF free when they make changes like that.

Dish in my opinion is a joke. They are cheap but you get service you pay for. They have possibly the worst customer service ever. There is a reason they lose customers each year and are rated poorly year after year.
