Marketplace return? - About xda-developers.com

I don't know if I'm posting in the right place but I had something on my mind I wanted to throw out there. I really liked the marketplace and loved getting the good deals. I was wondering if there was a way to bring it back but not leave it open to every one to make there own deals. Maybe if could elect some trustworthy members that are well known and had positive feedback to make all transactions through. Trades or sales those members will be the middle man. Process will be a little slower and a little more money for shipping because it will be making two stops instead of one but at least it gives you a opportunity to experience the marketplace again. This should eliminate scams along as the members we choose are trustworthy. Maybe if we prepare our self to pay at least 30 for shipping. Reason being is because on a average is about $10 to ship maybe more depending on if you get insurance, but 10 to ship to the middle man, 10 to get to the destination and $10 paid to the middle man for handling our transaction. Just a thought.

Yeah they've done this many times in another forum I used to go to for kicks, (solecollector).
What I dont understand though, is why XDA closed it in the first place.
They are not liable for anything, everything is the buyer/sellers liability as it was THEIR own self who chose to do the transaction.
As long as XDA is not liable for anything, I think they should bring it back.
A lot of people have left these forums due to that.
Hopefully they re-open it soon...

While perhaps not necessarily legally liable, when scams occur right and left, it may have been an ethics decision on the part of the staff. If you owned a site or property rife with immoral or illicit behavior, although you could legally not be held liable, you might still take action to attempt to protect the "innocent" if you will, even at the expense of some good deals.
Ultimately it was the staff decision to shut it down, and I doubt anyone is going to convince them otherwise at this point unless they decide on a new system according to their own internal discussions.

Wish they would reconsider reopening it also

I find myself visiting XDA less ever since the market place was closed... really hope they do bring it back one day. :/

But this sums up where this project is at:
----
ok guys.. some bad news.. Talked with Matt2 on a business level and after i went over some figures with him, my calculations were so far off.. i should be on mars..
The break even point for this project is 275+/- 10/12 extras.
I have been saying 150 and I am not sure where I got that unless I was not calculating the shipping since I did free shipping.
We are at 129 at the time of writing this.
So here is my question, I have always said, I will refund if we stop this without it being made. We had over 350+ that wanted this.
My initial thought was to spend the several hours tonight to just cancel/refund.. but then I figured we came this far. I also go on vacation Sept 10-18.
So what I propose, today is the 11th of August. Lets give it till the 25th of August. 2 Weeks... If we are not even close, then I will spend the next 2 days refunding..
So listen.. if anyone out there wants this.. buy it now.. or it will not get made.. To all of those that did buy.. sorry its taking so long, your money is safe. I am not out to steal anything, I just want the door to be made.
Thanks
Joe

Thats crazy man but just like your saying, i actually am one of the dudes who said he was going to order one and i havent been on XDA in awhile, sorry i didnt see the thread but ill put an order in for one now. Best of luck, i hope we make it.
I'm sure though that if you made 275 you wouldn't have any problem at all selling them, both on here and on ebay. I'm surprised you have as many preorders as you do, considering you don't have a product to ship.
I just ordered mine. Can't wait to see it!
sketchy sketchy
yea dont forget about all the people not on xda or the other forums your doing this on. if you get close enough where you can afford to invest a little, do it and sell the rest after they are made.

STFU! GET OFF THE BOARDS!
go back in the hairy little hole you crawled out of.
Joey has been upfront with all of us following this project from the start. He is human like the rest of us. first time he has done something like this and im sure he now knows to "measure twice cut once" always check the numbers and check them again to be sure... so we will wait it out and see what happens not a big deal!
We didnt even know if it was going to make production after the first couple days because so many VOTED YES TO THE PROJECT AND THEN DISAPPEARED when it came time to pony up for the pre-order. If people would have kept their word about ordering they would be in production already!
Joey....how many people actually place an order of the 359 that originally voted yes?
Would raising the price of each one by a couple of bucks per door get them to the target without needing more preorders?

I am not sure of the numbers. I dont mind investing my own $ into it.. But I am just trying to get alot closer to that break even point.. If I sell more after, thats great but tbh, I am doing this as a community buy... not trying to get rich (not that I think that is even possible)

Calling someone sketchy is a personal attack.... joey has been upfront with us every step of the way...I only gave you some of your own medicine. That's all nothing more..
It aggravating when you watch someone work their ass off for the community on a project and have half of the people disappear who were supposed to order, then have you call this guy sketchy when hes done nothing but try to make us happy by seeing this project through any way he can... nobody else even came close to a comment like yours.
I followed the thread, saw all the updates, saw members commit money with delay after delay. I understand **** takes time but every post was "here is a final prototype but yours wont look like this" point is, promising something, taking peoples money, then GOING ON VACATION to wait it out IS sketchy whether you can admit it on not. You seem to have a serious personal stake in this or with the op but from an outside perspective it IS sketchy. If the op falls through and refunds everyones money then fine, that doesn't mean the situation was any less sketchy.
You say it wasn't sketchy because he kept everyone up to date, guess what, so do Nigerien scammers. Him keeping everyone updated is not a fool proof reassurance.
Sorry bro. Been holding out until I could see the finished product. Went ahead and ordered because I really want one. Thanks for the time an effort. Will tell my buddies with evos.
If you don't want one, don't send him money and leave the thread. I don't see how hard that is. And it's not that hard to get money back through paypal.

This will be my last reply to you...
This was not a person that had one post and decided to start asking for peoples money..before this went to pre-order he told us of his VACATION and possible delivery dates. I have been involved with community generated projects in the past and they all involved a pre-order because these types of projects are not cheap to get started and not done to make an initial profit, they are to help get something made the community wants and doesn't exist, once the community is taken care of then you try to make money from the project by exploring different ways to market said item at a significantly higher price. He is not a prince from Nigeria sending unsolicited emails trying to get my bank info so that comparison was completely stupid AND HE IS USING PAYPAL! Wait did I mention PAYPAL! Nobody had to western union him cash or transfer cash into his account, so we feel very confident because at the end of the day if this doesn't get to production we WILL ALL GET OUR MONEY BACK BECAUSE HE USED PAYPAL! Easy for him to refund our money and has buyer protection. My personal stake in this -- I want a unique clear and colored battery door for my evo, made in the USA sold in the USA by someone in the community who actually followed thru! Joey took a poll to see how many people would buy one and it was more than enough for this project to move forward! It is not his fault that some people are not doing their part of the project and pre-ordering to get these to production.
Like I said this is my last response to you regarding this thread...you are officially on my ignore list.

Yea but this guy, Kim Dotcom(lmao), is under critical fire my friend! I don't think he'll be out anytime soon...He's been charged with a felony once before, on which he banked $42 million, BUT under German law, it was swept under the rug. And my guess is that the US government will not be as forgiven for the current charges that have been brought up against him...two of them being RACKETEERING and MONEY LAUNDERING??? WTF...but not only that, Megaupload has had endorsements from high profile celeb's which will bring this case into the limelight, so pretty soon everyone is gonna be talking about it, at which point the government will definitely not want to loss this one...http://www.foxnews.com/scitech/2012/01/19/feds-shut-down-file-sharing-website/

But i think anonymous just got played. Shutting down megaupload shortly before the SOPA vote...you have to expect an anonymous attack. I'm still not so sure about that. A number of them were scared into dropping support once they realized that had no idea what was actually going on in the bill or on the internet for that matter. The public backlash was pretty tangible. If things get more serious protests would likely get more intense and the backlash would likely be epic.
Do I think that means that SOPA/PIPA have been defeated? Tough question. Chances are bills called "SOPA" and/or "PIPA" will likely never get passed...but I think it's not unlikely that they will be dismantled into pieces and stuffed into "feed the poor orphans" bills, "job creation" bills and "unemployment extension" bills....what kind of heartless prick would vote against unemployment benefit extension, jobs creation and feeding poor orphans?
...only honest politicians. Good luck finding one of those let alone enough to keep something named like that from passing.
Well, as you all know the government only works for the rich. So, when the rich think there precious profits might be damaged they will arrest you. That is exactly what happened with pirate bay. They forced a foreign government to arrest people who hadnt committed a crime in their own country.
For the record I use megaupload all the time to download roms. I think we all do. They are far from pirated so hopefully they will see the site has a great legitimate purpose.

Can they do this?

See my other thread "USB connected" error over and over to get the jist of what's been going on, but basically I've been having a hell of a time getting Sprint to replace my Epic for what is obviously a hardware issue.
My phone was completely EC05 stock when I brought it in, the tech has flashed it back to EC05 twice now with what he calls their "Slate" program, I had a little disagreement w him, so I emailed the manager. This is how he responded, he essentially banned my serial number from replacement at all service centers in the region. Read this ****, it's ridiculous. I seriously felt like everyone at that store are buddy-buddy and that they just make fun of customers behind their back, they ALL had bad attitudes.
"Tyler,
I want to start out by acknowledging your extensive background in the Navy and commends you on your position as a communications electrician. Very admirable of you to serve our country and on behalf of my staff and all of Sprint for that matter, I would personally like to thank you for your services.
As far as this matter is concerned, I appreciate your feedback and I apologize if there is some tension that has formed over this issue between you and our technician.
I have read your email and have discussed this issue with my technician and our senior technician within our district. The conclusions that have been drawn through conversations between you and our technician, as well as applications that were present when originally checking in your device, is that the original manufactures software that comes with the device was modified through processes of rooting. XDA is a common feedback forum often consulted between users that modify their devices that will bypass certain restrictions the manufactures software will prohibit specific conduct per request and demand of the contract between Sprint and the manufacturer. Once this softwares' integrity has been compromised, the manufacturers warranty is no longer valid and even when doing a hard reset to restore the original software, the default software may have glitches from time to time.
As of right now, our district has been notified of this issue and of the serial number of this device, and will not be permitted for exchange at any of our service centers. I apologize for any inconvenience this may cause from your current expectations of our service centers. I can assure you though, I have looked into this matter with great detail and the proper procedure has been followed under our policies and procedures regarding your transaction.
Moving on, I would like to touch basis on the importance we put in maintaining a high standard of customer service at our Cypress location and discuss your concern of the attitudes of my employees. It has been brought to my attention that profanity on your behalf, was used toward them in a derogatory intention that I do not tolerate. I understand the frustration and disagreement that you have regarding our procedures but civility is necessary to communicate effectively. I will not speak for Mr. Hessey while adressing this matter, but encourage you to take into consideration how you played a role in this matter. I welcome you to contact me at the store if you have any further questions regarding my response or decision that has been made in regards to this matter at 7148914911.
Store Manager"
That's bull. Try the other service centers anyway if you haven't already. Lots of Sprint techs are assholes, don't let it get to you.
That's why I always say play stupid never mention rooting or anything it always comes back to bite you in the ass.... on a side note You should read them their waranty service on rooted phones.. they clearly state if it is considered hardware and purely nonsoftware they cannot deny you service

Ok buddy, if u want some very strong fire power on ur end, here is what u can do. Send a copy of that to the fcc, better business bereau consumers union and a lawyer. It is against the law to black list "any esn" unless phone is reported lost, stolen or cloned. Ur phone was software modified. That's it.

Not to mention throw in there was no actual modification on your device, and that they "speculated" based on a completely legitimate forum application. Also still pm me your name I'm egging to go off on this guy. I use to work for Sprint not even that long ago for a few years and would love to school him on the legalities and policies that keep him from ever having the authority to do this.

as ****ty as it is to say and im gonna hate myself for doing this but they can do that he cant do it because of suspected rooting but the fact where he says that you used profanity against their employee is why he can do it its in the ToS:
Our Right To Suspend Or Terminate Services
We can, without notice, suspend or terminate any Service at any time for any reason. For example, we can suspend or terminate any Service for the following: (a) late payment; (b) exceeding an Account Spending Limit; (c) harassing/threatening/abusing/offending our employees or agents; (d) providing false or inaccurate information
sorry man this really sucks i still say call and give that jackoff hell just because its what i would do but with that seems like he really can keep you from servicing your phone since that is one of your "contracted services"

The only reason I even mentioned that I'm a vet is to sort of level w the tech guy that I'm pretty tech savvy myself, and that I'm a trained Communications Electrician from my time in the Navy. He was treating me like I'm an idiot, mostly because I mentioned xda it seemed like, and I merely wanted him to stop acting so condescending.

Ok well, the manager claims that policy isn't even valid, and he found this entire forum post, printed it out, and claimed I have committed fraud by posting his e-mail on here.
The only option he gave me is to pay for insurance for the phone and make a claim w Asurion, so I'll still have to pay $100 for a new phone.
All in all I still believe this is a hardware issue and I feel that the manager has been short-sighted in automatically attributing it to roms, etc.
All posts have been edited to remove his name though as he does make a good point with that. I actually meant to remove his name when I pasted that, but I must have forgot.

[Off Topic] Self Defense

Started a new thread for anyone that wanted to continue the conversation about self defense from this thread because it is getting way off topic from the OP.
Self defense: what's your stance? Firearm, or no?
Open discussion, let's not attack someone else's views/opinions, or say things that will have a mod close this thread.
Is anyone ANTI-self defense? I mean, you can be pro-self defense (martial arts) and be anti-firearm.
Personally, I have a shotgun, a .22 and a .45. I'm seriously considering getting a license to conceal and carry but I don't currently. I also have had years of living with a Dad who was a gun nut and he filled my head with more opinions on the various aspects of gun control, concealing and even gun ownership than you could imagine. What stuck with me though is that you should NEVER own a gun unless you are SURE you can use it. You must be of the mindset that you can take a life, because if you don't - if you hesitate - your gun could be used against you. I don't know if many people actually mull over the fact that bad guy or not, everyone is someone's son or daughter. And once the aggression drains from that face you laid down, you are looking at a human being. Who is scary dying or dead? Can you live the rest of your life with that on you?
If I lived alone, I wouldn't own a gun. But I have a family and their well being is my responsibility. Would I kill if I had to? Only for them. Nothing I own is worth a life otherwise.
Just my two cents. You're welcome to disagree. I spent years arguing with Dad, "I could do it. No problem." And then I had kids and my perspective changed. I am changed.
Much respect to all who participate in this thread.
What is this doing on XDA ????

Well said. I also have a family, and would do absolutely anything necessary for them. I conceal carry anywhere its legal, any time I am able to, as well as my wife. Of course, I would only use a firearm when absolutely necessary, and would not hesitate when it can to my family. Like you said, you have to have already decided if the time came to take a life, you need to know if you will or not, and not hesitate.
I'm also a life member of the NRA, and platinum member of the USCCA - they provide funds in the event of a criminal or civil lawsuit, as you as you did everything correctly.
I don't comprehend the government's views on the 2nd amendment, and states like Illinois where it is extremely difficult to legally defend yourself with a firearm. There are clear statistics showing that pro-gun states/cities have a lower crime rate over a period of time. I'm at work at the moment, so I don't have a link to provide as a reference currently.

Check out the link in the OP. Background info - someone got their new HTC One stolen at gunpoint. That thread got way off topic, as the OP was inquiring what they could do to possibly locate the phone.
In some states its illegal to claim self-defense if you were already carrying a weapon with "intent" to defend yourself.
I begin self defense up to and including killing someone in self defense. But of course situation dictates, I'm not going to shoot someone for stealing my $30 grill from my front porch. But if someone were to break into my house and I were in the house, who ever comes through my door better be ready to die.

I understand why the thread was started. My wife and I both have a carry permit and believe in the second amendment.
What I was saying was XDA is not for NRA and gun control debates, it's for phone info.

Agreed. One should never even reach for a firearm unless its something serious to begin with, which includes breaking into my home with my wife and kids. In Kentucky (and probably most states) you can only legally self defend with a deadly weapon for serious injury/bodily harm/death, rape/sexual act, kidnapping. As far as property, the law isn't perfectly clear, but if the perp is in your home, it's all bad for them.

Fair enough. But it was already being discussed anyway, and if fellow xda members wanted to discuss it further, here is the thread. No disrespect, but you're also basically saying 'why are people talking about sports in the off topic thread?' Same logic.
This has nothing to do with the Verizon HTC One or any other phone. There is a forum on XDA for off topic discussions unrelated to phones, appropriately titled Off-Topic Forum. Nothing personal, I just come here for info about the phone I use and would like to keep it that way. I rather not see the thread popping up to the top every time someone comments on this sometime volatile subject.
Or we could just take the discussion here:

[Q] BOUNTY, why doesn't XDA make a holding?

Just wondering, sorry if this questions has been asked, but i couldn't find an answer.
I see all these posts about people saying only about 10% of the people pay out on their BOUNTY pledges, why doesn't XDA create a holding that pays out when bounty is met? if there is a timed deadline.. (something reasonable like 6 months). that will at least give the developer confidence he will get some reward for working on it. Also it will set a realistic dollar figure.
frankly, rep is one thing, but getting pay for hard work is whole different animal. If i worked hard for days on delivering a solution, you can bet I want to get paid.
I think this will help with growth of XDA too...
sorry just ranting..
Agreed but I'm assuming liability issues.

Bingo!
XDA is not a bank, and that would be a horrendously complicated thing to administer (especially if refunds have to be given at some point).
If I were XDA, I wouldn't touch that with a 10 foot pole.
This is a community, not a bank. It's not the responsibility of XDA to take care of monies and I doubt this would -ever- happen. If this was a device specific forum, it might, but not here.
I'm not going to make a pledge for root. I'll just pay the person who succeeds when they succeed. The whole idea of a bounty is a joke. I've contributed to lots of devs (Chainfire has earned a nice chunk off me) in the past and don't intend to stop now....But I don't need a pledge to be a nice person.

That's what I always say. I donate if/when it happens and donate/support the dev of the ROM that I use the most.

AND because XDA BARELY tolerates Bounty threads and only under very specific conditions. Have you seen how many devices XDA has forums for? Do you know how many bounties are still unclaimed and threads open? How many people would be patient and wait after giving up their money? Then what about time limits? What if it never happens? What about individuals deciding they waited too long and want their money back? What if all money is refunded and it happens right after? There are sites made just for these kinds of things, XDA is not one of them.
