I have to complain about this site selling add space to Digigasin. This guy operates out of his apartment. I know because I found it. He took my money through PayPal and never did deliver the order. It has been past 45 days so PayPal won't do anything about it. They told me to go to the police. Digigasin will not reply to my emails and the phone number is just an answering machine. Don't buy anything from Digigasin, you'll be sorry.
I repeat, this site should not let him advertise here!
This site is not selling ads space to Digigasin, it has Google Adsense on it, and Digigasin has payed google to advertise. The ads are placed based on keywords found on the page you're looking and on local information (if you're from switzerland you get more swiss ad's).

I figured it was something like that. I guess I'm just venting...he took 189. Swiss francs from me. It is the first time I've been ripped off on the Internet and it doesn't feel good. I just wanted to warn others about this guy. His business is not professional at all, I know because I went there...nobody home either.
im a webmaster that uses google adsense and you can request specific ads not to be displayed, perhaps xda-devs could do that?
Well I am in Switzerland and the only add that I see at the moment is from Digigasin, change section, same add, go to wiki, same add.
So can't miss him. Looks like Google does not have many customers over here.

I wrote a letter to toppreise.ch where he advertises as well. It has been an eye opening experience. I did my research and still got ripped off. I'm going back to my old criteria, never let a an outstanding order go over the credit card/PayPal dispute period. My Platinum card would have snatched that money back if I hadn't waited so long. My excuse is the holiday season...live and learn.

Yes, why can't you stop this guy. This is really a matter of fraud. One of the reasons that I took a chance on him is because I saw his adds here.
Hello,
I am the webmaster of Digigasin and I must tell you I am highly shocked about what Matterhorn said. I am no crook ! I sometimes forget to reply to mails, that's true, and sometimes deliveries take time ! But one again, I am no crook !!
Whatever the problem is about (and I really don't know what it is about...), this customer will be refunded. My reputation is of value. I've just written an email to this member to have an explanation....

Besides, when a customer buys something with Paypal, he can write to Paypal and the money is immediately taken off my account, therefore the customer is refunded!
So what Matterhorn says is untrue. He certainly bought something in my Shop and the delivery period was certainly long. It is true that it's hard to reach me by phone and maybe I did not see one of his emails..but if he wrote more than one, I don't see how I could not have seen them and give a prompt reply !

Digigasin,
You don't run a business by "forgetting" to answer emails. I placed the order on November 14, 2006, yes that is a long time. I'll reply to you privately as I already have 5 times between Nov. 24, 2006 and Jan 11, 2007. Maybe this time you will respond.

No, you are wrong, what Matterhorn says is completely true. I sent you 5 emails and a voice mail trying to clear this order up and you didn't respond (I have all the records). I called PayPal to find out what to do and they said that because you strung the whole thing out for more than 45 days, that I would have to go to the police in Lausanne since it was past their time period for recourse. That is the honest to god truth.
Don't call me a liar Mr. You are the one that has not done the proper thing in this whole transaction. You took my money when I placed the order and that is the last I heard from you. Now I am taking this affair offline to a private discussion with you, unless you continue to refuse to respond to my emails.
So if you want to preserve any reputation, let's take this matter to private correspondence, or better yet, just refund my CHF189. and I'd be able to say so here and other forums that you did the right thing.
As I promised, I am confirming resolution of this issue. Digigasin has refunded the funds from my order plus some extra compensation. Thank you for the refund.
Still, I think this guy is not doing a good job. Wonder what happen to your $$ if you were not to make noises here.

Yea, but re-runs are good too, cause you never know how they will end this time. LOL.
Actually, I feel really stupid, cause I read the whole thread and didn't even notice the dates till I read your post. What a day!
See my other thread "USB connected" error over and over to get the jist of what's been going on, but basically I've been having a hell of a time getting Sprint to replace my Epic for what is obviously a hardware issue.
My phone was completely EC05 stock when I brought it in, the tech has flashed it back to EC05 twice now with what he calls their "Slate" program, I had a little disagreement w him, so I emailed the manager. This is how he responded, he essentially banned my serial number from replacement at all service centers in the region. Read this ****, it's ridiculous. I seriously felt like everyone at that store are buddy-buddy and that they just make fun of customers behind their back, they ALL had bad attitudes.
"Tyler,
I want to start out by acknowledging your extensive background in the Navy and commends you on your position as a communications electrician. Very admirable of you to serve our country and on behalf of my staff and all of Sprint for that matter, I would personally like to thank you for your services.
As far as this matter is concerned, I appreciate your feedback and I apologize if there is some tension that has formed over this issue between you and our technician.
I have read your email and have discussed this issue with my technician and our senior technician within our district. The conclusions that have been drawn through conversations between you and our technician, as well as applications that were present when originally checking in your device, is that the original manufactures software that comes with the device was modified through processes of rooting. XDA is a common feedback forum often consulted between users that modify their devices that will bypass certain restrictions the manufactures software will prohibit specific conduct per request and demand of the contract between Sprint and the manufacturer. Once this softwares' integrity has been compromised, the manufacturers warranty is no longer valid and even when doing a hard reset to restore the original software, the default software may have glitches from time to time.
As of right now, our district has been notified of this issue and of the serial number of this device, and will not be permitted for exchange at any of our service centers. I apologize for any inconvenience this may cause from your current expectations of our service centers. I can assure you though, I have looked into this matter with great detail and the proper procedure has been followed under our policies and procedures regarding your transaction.
Moving on, I would like to touch basis on the importance we put in maintaining a high standard of customer service at our Cypress location and discuss your concern of the attitudes of my employees. It has been brought to my attention that profanity on your behalf, was used toward them in a derogatory intention that I do not tolerate. I understand the frustration and disagreement that you have regarding our procedures but civility is necessary to communicate effectively. I will not speak for Mr. Hessey while adressing this matter, but encourage you to take into consideration how you played a role in this matter. I welcome you to contact me at the store if you have any further questions regarding my response or decision that has been made in regards to this matter at 7148914911.

That's bull. Try the other service centers anyway if you haven't already. Lots of Sprint techs are assholes, don't let it get to you.
That's why I always say play stupid never mention rooting or anything it always comes back to bite you in the ass.... on a side note You should read them their waranty service on rooted phones.. they clearly state if it is considered hardware and purely nonsoftware they cannot deny you service

you know i always wondered that because i have the paid xda app so even when they reflash it shows up on the market. my screen is going out. it is weird it looks like back in the day with the old cable boxes and you could kinda get hbo but the screen has alot of lines. i have flashed it back to stock about 4 times but every time i go to bring it in the screen doesn't do it so i don't want them to be like there is nothing wrong with this. it only does it on a white screen thou. but the last time it happen my screen had a yellowish tint to it. but it went away. i want it to get worse enough proof to get it replace.

as ****ty as it is to say and im gonna hate myself for doing this but they can do that he cant do it because of suspected rooting but the fact where he says that you used profanity against their employee is why he can do it its in the ToS:
Our Right To Suspend Or Terminate Services
We can, without notice, suspend or terminate any Service at any time for any reason. For example, we can suspend or terminate any Service for the following: (a) late payment; (b) exceeding an Account Spending Limit; (c) harassing/threatening/abusing/offending our employees or agents; (d) providing false or inaccurate information
sorry man this really sucks i still say call and give that jackoff hell just because its what i would do but with that seems like he really can keep you from servicing your phone since that is one of your "contracted services"

The only reason I even mentioned that I'm a vet is to sort of level w the tech guy that I'm pretty tech savvy myself, and that I'm a trained Communications Electrician from my time in the Navy. He was treating me like I'm an idiot, mostly because I mentioned xda it seemed like, and I merely wanted him to stop acting so condescending.

Ok well, the manager claims that policy isn't even valid, and he found this entire forum post, printed it out, and claimed I have committed fraud by posting his e-mail on here.
The only option he gave me is to pay for insurance for the phone and make a claim w Asurion, so I'll still have to pay $100 for a new phone.
All in all I still believe this is a hardware issue and I feel that the manager has been short-sighted in automatically attributing it to roms, etc.
All posts have been edited to remove his name though as he does make a good point with that. I actually meant to remove his name when I pasted that, but I must have forgot.

IMPORANT NOTE: (Placed at top of this post because with the progress we are now seeing I feel the purpose and use of this thread has changed and this is now an important point to clarify).
Back-light flickering Vs Screen corruption
The fact is, I think these two issues have been getting confused by people since launch.
I am 100% confident that the screen corruption will be software and will be fixed. The flickering back-light issue however, I believe is likely to be hartudware.
In the interest of separating these two issues, and for clear conversation about them I suggest the old vhs player effect be referred to as corruption and the flickering back-light be referred to as flickering. If everyone who reads this sticks to that convention we have our first step towards separation of the two issues.
I have described both to HTC in great detail and hope that they understand the two separate issues and will communicate we me about both.
----------------------------------------History of this thread------------------------------------------->>>
I am a proponent of HTC and have faith in their intention to resolve the screen flicker issue. I have been worried about this screen flicker situation however. The main issue I have is that all communication from HTC thus far has been that they are looking into the problem and have no answers yet. That is perfectly reasonable, I'm sure they're making every effort.
The worry is that after 28 days a user is no longer entitled to a replacement, just a repair. This seems very unfair given the circumstances, i.e. We are being asked to wait for a resolution but have no indication of how long that will take and may all be looking at lengthy repair time rather than replacement.
With the advent of HTCdev, many users want to (or already have) root their phones but have to agree to void their warranty to do so, this just adds to the urgency in getting a resolve.
As an owner of several UK businesses I have been able to gather a number of names of people willing to embark on a class action in order to obtain a court order forcing HTC to make a pledge to replace all handsets that are outside the 28 day replacement period in the event that it does turn out to be a hardware fault. None of these people is legally obliged to be included in this class action. By agreeing, they are simply stating an intention.
I have not posted this here as I wanted to get enough people on board to embark on this project before bringing it to the wider community.
I decided today that it was time to take things to the next step and contact HTC UK Ltd and ask for such a pledge.
Today I have spoken with Robert Collins, the Customer Experience Manager for HTC Europe. Robert seems to be a reasonable man, he has agreed to look in to this for me. Robert was driving when I spoke to him so he got a member of HTC staff to call me back and take the details of the situation from me. This has happened and I am now waiting for a response.
The idea is not to become aggressive with HTC or demand any action to resolve the fault, the aim is simply to get them to pledge to replace the handsets that are outside the 28 day period if, AND ONLY IF, the issue turns out to be a hardware problem.
This feels like a reasonable request since we are currently being asked to wait until they have identified the problem.
So why am I posting? Well, I would like to invite any EU members here to add their names to the list. Please just state that you are an interested party and would consider joining a class action. Please don't discuss the merits of this thread, the legal implications or anything else other than your interest. Please also state what EU country you are in as I have not yet taken any official legal advice so it may only be possible for UK members to become involved.
I expect the outcome of this to be that HTC UK Ltd, and hopefully other international branches of HTC, will make such a pledge but I am, in principle, willing to embark on a legal recourse if necessary.
The most important point for me to get across here is that the intention is NOT to start a fight with HTC unnecessarily, the best outcome for everyone would be to obtain the pledge as described and go on enjoying our devices while they work on the problem.
This has also been posted over at MoDaCo - Please DON'T put your name in both threads
UPDATE: I have had another call from Robert Collins. He assures me they are taking the situation in hand and are eager to make sure their flagship device remains among the best on the market. He stopped short of saying a pledge would be made but indicated that he understood the issue with the 28 day return/refund/replace period and wanted to ensure sales etc are not effected by the issue. He asked me if I was in direct contact with all signators and I responded that I wasn't but that if a written pledge was provided to me that I would pass it on to all concerned via the same networks through which I obtained the names. I also told him about this thread and the one on MoDaCo.
I have to say Robert Collins and HTC have been incredibly responsive to my communications and in my opinion, the pledge I have asked for will probably be made. Let's hope so!
IMPORTANT: Please copy and paste the list and add your name to it.
UPDATE: 25 Apr
I have just had a call from Robert Collins at HTC. He is preparing a statement to send to me. It seems like the goal may have been achieved although I don't know what the statement says yet and wouldn't want to speculate unduly.
UPDATE: 26 Apr
I have just called Robert Collins again. He is just about to go into a meeting to discuss this very point and will have something to me by late morning/early afternoon. He said he will call me to confirm I have received it.
UPDATE 26 Apr - left up as it feels dishonest to remove it but now surpassed by another update below
HTC are pathetic, It's time to get serious over this.
The statement emailed to me was...
Dear Charlie,
Good Afternoon,
HTC is committed to delivering a high quality product and great experience for all our customers. Some minor quality fluctuations are not unusual in consumer electronic manufacturing and there have been a few, isolated reports of this issue. However, HTC will address each reported issue. It is HTC's policy in Europe to provide in-warranty repair and support for device defects and malfunctions for two years and HTC is committed to delivering a quality experience without exception. We would encourage customers to contact our Call Centre for individual support. For details of opening hours please see our website at www. HTC.com
Regards
HTC
Furthermore, Robert Collins had said he would call me to ensure I had received his statement, he didn't, neither would I, given the lack of any meaning and my likely reaction. In stead, he has, in my opinion, hidden behind a protective barrier by asking someone else to send me this meaningless paragraph of text. Because he didn't call I actually thought the above was an email coming a result of my communication with HTC support until I called him to chase the email. This is staggering, he may as well have simply said "contact support" when I first spoke with him rather than feigning interest.
It is clear to me that HTC are not taking this issue seriously and have no interest in users difficulties. Their email as good as says that we should all return our devices.
This is, in my opinion, a calculated decision to allow the faulty units to continue to be sold as it will be cheaper and easier to repair them once they have worked out the problem than it will be to deal with it in a conscientious and pro-active manor.
So where are we, HTC accept it is a known problem and it is common enough that all the staff at chat AND phone support now seem to know about it but they don't know if it's hardware or software, there is no information about time scale or what they intend to do in the event that it is hardware. I am of the opinion that this is a hardware issue, if something in software were causing the screen to flicker it would be all handsets and we would have seen some kind of pattern by now, I believe the bulbs for the back-light simply flicker intermittently with the effect being more visible on certain colours.
My advice to you all is to return your handsets, not for replacement, but for refund, and to await further news. If not, in my opinion, you face the possibility of being left with one option, repair at some unknown time in the future once they know what is causing it, in a long queue and facing possible shortage of parts. Don't forget, you've all got the new cut down sim cards now which are useless in most other handsets as well so ask your carrier to send you a new one!
I am very sorry people, I have let you all down. I was led to believe by Robert Collins that some meaningful statement would come of this.
I am trying to get some decent UK press coverage of this, they deserve it. I am not one to cross, they would have been better off teling me they were not interested in my list of names from the off and redirected me to support. It's a red rag to a bull now.
I also had a bit of a battle on my hands dealing with T-Mobile. They did not want to accept my handset as a return simply because "this is not a known issue" parrot style, like he was reading it of a screen. What's that got to do with it anyway? I am within my 28 day statutory return period. This leads me to believe it is very much a known issue and they are loathe to accept returns on it because they know they are going to loose a lot of money.
UPDATE AGAIN - 26 Apr - A U-TURN on my part
I have just had a call. This is a game changer. The head of customer service for HTC just called me from Denmark, it's 9.30pm there! He was very apologetic about the email that was sent to me and explained that from their perspective a statement for distribution to everyone couldn't be very personable or individual. He also agreed that it wasn't informative and regretted that. He told me they DO KNOW WHAT IS CAUSING IT and they are working on it night and day. He was extremely humble and pleasant to talk to. I explained my exacerbation over waiting 2 days for someone to write 2 lines saying contact support and told him I had ranted on the internet and told all the signators to return their devices and he said that's exactly what he would have said, no one should have a sub standard device from HTC. However...
And This is the good bit. He is going to get proper info from Taiwan for me with updates on progress and information about the fault, he assures me they now know what it is too. I made sure he understood that there are 2 faults, I called them screen flickering and screen corruption and described them both as at one point he was talking about the corruption on the task bar and then subsequently in the camera and video's etc and I was talking about a flickering back-light bulb so we should get info on both.
I know we've been here before and I ended up looking a pillock but this really feels different. He rang me and suggested sending me out information which is specifically about this issue and not just canned responses that mean nothing. He said it would be great if I would post that information online but that it was up to me, I think he was worried I'd feel like I had to stand up for them or become an evangelist but I know what he meant, I really believe he just honestly wants to pass on information to help his customers. We'll see what comes of this, I have his mobile number and he said I could text him any time. He said he hoped he could get some info tomorrow but clearly didn't want to commit to that at 9.30pm, I can't argue with that.
This feels like the HTC I know and love again.
UPDATE AGAIN - 27 Apr
Message received just now: approx. 1700 British Summer Time (GMT+1). The two issues he mentions are the screen corruption and back-light flickering.
First of all thank you for your reply earlier today. The content and descriptions were very valuable and I have taken the liberty to share your findings with my colleagues in Taiwan.
It remains a priority for HTC to continue to investigate and work to resolve all reported issues, including any potential hardware or software updates related to your case and to those of any other customers who experience problems. Currently, we are not in a position to provide you with a final conclusion regarding the two issues that you have reported, however we are taking your feedback seriously and have a dedicated team of people investigating the root cause of those issues. We are more than happy to provide you with further updates when we have them however, before we do this, it is critical that we have all of the facts. HTC remains laser focused on delivering a high quality experience to our customers without exception and we appreciate your continued patience whilst we work quickly to address this issue. We anticipate being able to provide a more detailed update early next week. In the interim we encourage any customer who believes that they have a faulty device to contact HTC directly for resolution.
I like "laser focused" and "dedicated team"...
I think we're getting somewhere here, very promising.
Update - 2 May...
Just had a call from Robert Collins at HTC. Apparently they know what's causing it and are working on a fix. 1.29 is not an attempt at fixing the flicker but another update is coming soon. I let them know about the Mandarin or Cantonese text in the French locale in 1.29 yesterday (posted by Simone on here) and they have passed this on for correction. I also mentioned the rapid fluctuation in CPU frequency when the ONDEMAND governor is used and they ate looking at that too.
They will let me know when there is more to tell.
As far as updates go, I have returned my branded Tmo device and gone for an unbranded device. Tmo said to me to expect 1.28 by the end of May, where that leaves Tmo branded owners for 1.29 and beyond I don't know but it seems pretty hopeless for Tmo owners right now. I would personally return any device eligible for return to Tmo, then walk into carphone warehouse and they'll match what ever deal you were on with Tmo and give you an unbranded phone. I should add that this last part is my advice and is not something HTC have said.
Update(ish) 15 May...
Not really an update...
In the interests f fairness, I did get a heads up about the 1:29 update but by the time I'd noticed the message it was old news. Just to reassure you guys that this source hasn't dried up, just nothing new to say on flickering. I think some interesting news will come in the not too distant future.
(Final?) update - 21 May
I know that it has been said many times already but I just had a reply from my contact at HTC (he's been off for a few days) confirming that 1.29.xxx.11 will recalibrate the screen over the course of a few days. I had no reason to disbelieve anyone else's info but to hear it from the horses mouth (from my perspective) is more final.
Let's face it... 3 updates in quick succession, so many positive changes, all promises kept, HTC F****in' nailed it. Eat your heart out Samsung!
Update 14 june
So where are with with this. I have seen little to no improvement and have today asked HTC for more info. I am reading that some who did not have flicker now have. I am not reading from anyone that it is fixed but people might just not be saying so.
Let's hear from some if you what your experience is.
Thanks

Can I ask what exactly is wrong with a repair over an exchange if it fixes the issue? This is more me wanting to know as I've just arranged to get my One X repaired because my retailer (Affordable Mobiles) refused an exchange saying nothing was wrong.

What is bad for a repair is that it's not very good for a device to disassemble it and change components. + it's oftenly not very well done. It actually killed my HD2 so...

Answer: When they resolve the issue, if it's hardware, there will be a LOT of handsets to repair. These repairs take long enough under normal circumstances but in that situation the queue will be immense. Then there is the likely shortage of parts and possibility of prioritizing retailers for supply.
The point is. I'll take a refund now and buy something else or wait until it's fixed to buy one. Then there is no risk on my part. If HTC make a pledge now they can prevent the mass return of devices and keep us all happy and waiting patiently for a fix.
I have answered this but this thread wil serve it's purpose much better if it simply remains a list of names. Please let's not turn it into a discussion of the merits of what I'm doing. Thanks!
Since indiegogo apparently thought the best way to dodge accountability was to poof the entire campaign on their site, I figure a thread here is warranted. Please post if you never received your door as well. I'm rather curious what percentage of his orders actually did get filled.
As for myself I emailed indiegogo and PayPal and neither seem to be inclined to take much action to actually get anyone's money back. Perhaps if there's enough of us an action can be forced. I really don't like the idea of letting this slide
Having received the email explanation today about the doors, I made the thread title more hospitable. I already went and grabbed another door from Gruber which I'm happy with though, so will be requesting a refund myself. How that turns out will decide how I feel about this.
Yeah same boat here. Not exactly thrilled that my attempts to contact both through the indigogo site and to 0Mie himself on xda have gone unanswered. I contributed I think about the 8th of March, and not long after that would have been the last email update I received from him about progress and dispatch updates.
Wow - I came here just to post this thread...
Never received the battery door, and PayPal closed the dispute because the transaction was more than 45 days old... That'll teach you to give the benefit of the doubt to the person. Did ANYONE receive a door? The contribution level got up to ~$7,000... He had a website up for a few days, but it looks like the domain is no longer registered to him -- Who-Is registry.
Does anyone know who this guy is? I found that Indiegogo thread here on XDA...
Wow ...I guess he was on some news sites as well ...damn ..

Well - looks like we're SOL --
utcu said:
He took my $65 contribution for a battery cover and spare battery, as well as many others' contributions and disappeared. The last I heard from him was over a month ago. He sent out an email saying some of the covers were done and that he was working on others and if anyone needed to get a hold of him to contact him through his site. (andetch.com)
As of a week or so ago, the site is no longer active, indiegogo and paypal have pretty much told all of us we're SOL, and people who were told their doors "were shipped" never received them. Both of the sites he operates from have been taken down and no one can contact him on his Google+ page either. I would never talk negatively on someone without good reason and I'm not sure if maybe he had something come up and couldn't follow through with the project but any type of response or refund would be nice. Here's the original project page with comments from many other unhappy contributors. http://www.indiegogo.com/Galaxy-Nexus-Laser-Etched-Doors?c=comments
It's very awesome how Gruverdesigns is helping all of us out. Dealing with them has been a great pleasure thus far. They actually respond to messages.

I hope this guy goes to hell, seriously... I was one of the first people that contributed when I saw his campaign and even helped promote it a little bit. I feel betrayed and it makes it even worse that I helped promote this liar.
And I'm in the same boat, haven't received any updates, emails, or battery door yet.
Still had his google plus page from early in the campaign. This is what convinced me he is dodging rather than just MIA for some real reason. The plus page has been unused a while, but there's a tweet a few days back, and we're adding stuff to our 'wish list' on april 10th...which is after my 2nd polite email inquiry about what the status of the campaign is...

The whole thing seems so weird though, the guy has been active for 2 years with that name and done other stuff, no real reason to burn people now.
he was on all the big sites , someone tell these sites

I had spoken to him about a month ago. I want to give him the benefit of the doubt but that was last email I received from him. I even got a stamp.com tracking email a week after he met the minimum requirement but never received anything number never even updated.
I donated back when the funding was only $30
I still haven't received my door....welp
I received mine. I ordered it on March 12th via his website (they day before I ordered the Google limited from ebay) and they both came in on the 31st. I had to contact him via an xda pm after a week of not hearing anything about the shipping though, but I eventually got it. I think he said he got swamped with orders plus was busy at work so he got delayed getting the orders out.

Considering the amount of received vs not received, I doubt it's just a "I got really busy" scenario...
The lack of communication is also troubling...
Oh I totally agree. Especially when in the first pm I included my Google checkout order number and his reply back was "did you order GSM or cdma version". Ugh really? That's why I included the order number

I paid for my gsm door plus international shipping early on and got a couple emails early on but nothing for ages. No door yet. I have given up on ever getting it...
I would love to be able to take back the other post I made in the other thread. He was nothing less than great to speak with at the beginning of the campaign. I'm definitely frustrated at this point though. No responses to emails or inquiries just seems too suspicious. There's also the matter of his sites now being inactive. If I end up getting a response, a refund, or what I paid for I'll be more than happy to delete the posts I've made.
I think we'd all love to give the benefit of the doubt, but the ball is very much in his court to respond and he isn't at all.
His profile shows activity on xda after this thread began yesterday. If there's an explanation, we're listening.

Exactly - I think the majority of us understand that life gets in the way, and it's not always possible to finish what you start -- but a refund is at least needed. As it stands now, he stole the money.
Found a google profile for his website but like everything else there hasn't been any activity since mid March.

THIS THREAD HAS NOW BECOME AN APOLOGY FOR ANY INCONVENIENCE CAUSED BY MY REVIEW
AND FOR ANYBODY WHO HAS PURCHASED A DEVICE FROM THE SCAMMERS I NOW KNOW CLUB1941.COM TO BE
@ivivdim created a separate thread about this seller due to @OscarBlue researching the seller and finding many perculiarities about the site in question
http://forum.xda-developers.com/general/general/experience-comments-club1941-t3043990
after reading a thread over at china-devices.com today 05/03/2015 that a user posted about receiving just a screen protector instead of a tablet and power bank
http://www.china-devices.com/Thread-Be-careful-Club-1941-com
i have now decided to amend this thread OP with an apology for any and all people who were taken in by this scammer and made a payment to them and who now have to go through the process of a dispute with paypal or their credit card company to have their funds returned
i do not know how to apologize enough for my actions in posting my review here that made all the people go and use this site and i have decided that since i am one of the few people who received a real working device that i will host a giveaway of the device i received by way of an apology for any inconvenience caused by my actions
i have asked @OscarBlue to help me with this....and if he does not then i do not blame him as i would be very angry myself if i had read the review i posted and then made a purchase with this company only to find out that they were scammers
i thank all of the people who warned me about this potentially being a scam and am sorry i did not listen to your advice and question the companies motives myself
what i have learned from this experience is to be more vigilant before jumping in at the deep end and dragging other people with me...and to do more research before commiting myself fully into such endevours in the future
please if you are interested in joining the giveaway for this device i will post a link soon here in this thread
it will be at my expense and i will pay for all shipping anywhere in the world to deliver the device to whoever receives it
this will be done as a small way of saying sorry for any hurt i may have caused anybody by my actions
mrsim

He is being paid to do a review. I.e., he will get his phone refunded if the store is satisfied with his review.
The problem may be that these trial devices may be the only devices shipped from that seler.
They are selling enourmous numbers these days at very low price of cca 170$ for a 3GB version of Jiayu S3. Maybe even lower in some cases.

21 days after you made your payment the funds are normally released by paypal and the seller can do what he wants with the money, unless you file a dispute with paypal, then the funds, although they are in the sellers paypal account are put on hold, and the seller cannot access them until the dispute is ended, you can end the dispute at any time if you are happy with the sale, the seller can end the dispute at any time by issuing a refund. I ordered one of these phones from this seller and was suspicious of the website, so I opened a dispute and the seller issued a refund straight away, despite the fact that the seller said he had posted the phone and issued a tracking number, he had until 19th march to respond to the dispute but chose to refund instead, draw your own conclusions
Also the agent at paypal told me that if I didnt file a dispute and the sale later was found to be fraudulent I would still get my money back from paypal, although I wasnt told how long that would take, nor what evidence I would have to produce.
Edit... I have since found out that paypal only put a 21 day hold on your funds if you are dealing with a new seller, or if the seller has problems/disputes, otherwise the funds could go directly to the seller, unless you open a dispute.

Seems like filing a dispute is reasonable way of protecting our interests. Would you mind telling us what reason of dispute you chose and what did you write to make your statement understandable as disputing to make money freeze for more than 21 days?
I tried myself this few minutes ago but not sure what to write not to be understanded as a panicking one by PayPal service.

also everybody is entitled to their opinion and i fully agree with you that it is better to err on the side of caution...there are a lot of scammers out there i am glad that you are warning people let's just hope that they all are using paypal to purchase their devices as this is a 'safe' way of doing buisness on the internet
i myself paid with paypal and it all went very smoothly
i read over in s7ylers thread that some people had problems and were offered the chance to pay with western union...never ever pay with western union as there is no option to get your money returned to you if you do get scammed

I used the grounds that the item had not been received (even though it had only been ordered a matter of hours) and in the message box I just wrote, I do not believe the sellers website to be genuine. and then I think you are given a date that the seller has to respond by, in my case 19 march, i believe if you need to extend the dispute beyond that date, you have to escalate the dispute before that date is reached, I'm not entirely sure about that as I didnt get that far, as I got my refund right away.

i cannot speak for the seller on their reasons for why they instantly refunded you your money, but you are correct in that paypal WILL refund your money if you do not receive the device or if it appears to be fake, the evidence would be the paypal payment that you made, tracking number given to you by the seller, and also any email interaction between the two of you so my advice would be to contact the seller and strike up a conversation talking about the device and delivery method, and payment, also a screen shot of your account details with the item in question from the seller would also be good
these will all contribute to you receiving your payment back from paypal...hope this helps.....
edit: forgot to mention connect the device to mtk droid tools either record this from receipt of the item at your door till the spec info pops up on droid tools or just take a screen shot

Congratulations mrsim, you have done well, if you google 'club1941.com review' you come top of the pile, you know why? because you are the only person who has ever received anything from that site, They must have thousands of orders by now, but they're still sending them out, must have massive stocks I guess, odd how some of the other suppliers seem to be having difficulty obtaining this device, must be their massive buying power, as a worldwide Wholesale/retail outlet, with years of growth behind them(from their 'about us ' page) just google the name and you'll get some idea of their history, except it only goes back to January of this year, never mind, check out the glowing reviews for the 600 odd items for sale on the site, strange the only items with reviews are the Jiayu S3 2 and 3gb versions, oh and they dont seem to be proper reviews either, never mind I'm sure it'll be ok, at least you can claim your money back from paypal.
there's none so blind as those who will not see
Congratulations oscarblue48. You got your money back. what was the dispute you had again please ? What would Paypal do if they did'nt have people like you ?
Surely this seller has done nothing wrong yet so why not give him a chance ? Its not thousands of phones anyway judging by his order numbers its more like 30-40 per day. Also his address is Shenzen so maybe his brother or wife works in Jiayu or there could be thousands of reasons why he has access to phones. fact is the S3advanced has been released and reason most of Aliexpress sellers havent got them yet is they are not yet back to work after New Year.
BTW thanks Mrsim for another great review for what is obviously a great phone.
Oh the only connection to Club1949 I have is I got a tracking no for my purchase S3 advanced from both Paypal and club1949 so no dispute until I have something to dispute about.
Geting a bit feisty in here...is there some 'history' that I am not aware of as a newcomer? At the very least this can be a thread about club1941.com so the main thread can be left to the actual phone.
Yes it seems silly cheap, but there is still that PayPal safety net, which you don't have at dhgate etc. It reminds me of a site called mionbuy.com -cheaper than all the others I could see BUT no PayPal which is why I didn't buy from there. I still cannot see why they would offer PayPal knowing that if everyone complains(which they will in the event of a scam) they won't see any money. Unless they have found a way to defraud people via PayPal-does anyone know if this can be done ?
So who is sticking with it and who is baling?

And more to the point, instead of pointing out a site is too cheap , why not scrutinise somewhere like efox which effectively rips people off by simply erasing $, then printing €, and THEN they have the barefaced cheek to charge for shipping! Then you might have no choice to buy an sd card! And people buy from there! Mindboggling.
seems like a pretty honest review to me so well done for scoring a free phone! I'm not bailing just yet as surely we are protected by paypal aren't we?
was surprised to see there is no led notification as thought that was pretty standard these days and also disappointed about the poor camera(expected better) and not so good twin speakers as I chose this phone partly because having 2 speakers must be better than just one! maybe I will bail and change my order to the ecoo aurora also with twin speakers but mounted on the bottom bezel not the rear so should project the sound slightly better, might save another $10 as well
