I Have 9 more months left on my contract, but for some reason, I am eligible to upgrade, so I think I am goint to do that.
If I upgrade, what will happen to my contract? is it 9 months plus 24 more months? or just 24 months from the day I upgrade?
I also hear many known issues about this phone, so if I buy the phone through wirefly and have issues on my phone, can I still go to t-mobile store to get it exchanged?
Thanks.
a simple call to customer care will give you the most straight forward answer and its 611 on ur dial pad...
Would be just 24 months. Better snatch up that upgrade asap.

Your contract is extended 24 months from the day you start your new contract. If you buy your phone from wirefly then you will not be able to exchange it at a tmobile store, we cannot do returns/exchanges without a T-MOBILE receipt that has the transaction #, Original Transaction date, Phone # of the customer and other information needed to process the transaction. You will have the manufacturers 1 year warranty and whatever return policy they have for wirefly only unless you get the Premium handset protection on you phone line through T-Mobile.

If I bought from TMo, but through customer loyalty, do I have to deal with them or can I go to a corporate store for an exchange?

Through phone and online can not be exchanged in stores

If you got it through customer care, you have to go through them. The only way to exchange it in store is if you bought it in store.

Where ever the phone is purchased is where it must be returned/exchanged to. In our retail stores we must have the original receipt to be able to process a return/exchange for a device. The only thing we would be able to do in the store for a device purchased else where is a warranty exchange through the manufacturer or insurance claim through Asurion if the customer has Premium Handset Protection on their line.

I have the Google I/O EVO which i got for free.
About two weeks ago in activated it on my account as a new Sprint customer.
Sprint locked me in on a 2yr contract as i am a new customer, even though i did not get a subsidized phone from them...
Now i would like to cancel my account before i reach 30 days to avoid the ETF.
My question is:
Once my account is canceled, can i go ahead and sell it on ebay or do i need to ask Sprint to do something with the device ESN before i sell it?
Is simply canceling the account enough?
I also asked the Sprint rep if once i cancel the account i get to keep the phone (as it was provided to me by Google at the I/O), they did not know how to answer my question....anyone knows?
I want to sell it and me sure the buyer can activate the phone without issues and i have never done this with Sprint.
The phone is yours, and make sure you get them to remove the sn from the account.

After you pay any and/or all fees off on your account that is due, Sprint will free the phone up to be sold or do whatever you wish with.

Since you got the phone from a 3rd party and not Sprint you should be able to keep the phone and not return it.

I'm in the same predicament as you are. How dare Sprint lock us on a 2 year contract when we didn't get a subsidized phone (Google I/O HTC Evo 4G) from them. Actually the customer rep. I've spoken to who set up my account told me not once but thrice that I won't have a 2 year contract. Aside from that, she also said that she was able to waived the activation fee. But when I received the confirmation email for my Sprint Wireless Service Plan I've noticed that there's a contract on it. So I'm thinking of selling my Evo as well.

I was reading over the contract that I received after doing my upgrade this morning at Best Buy. I notice the $36 activation fee, the $350 advance devices ETF but still 30 days Sprint guarantee to opt-out. Wondering if this is the same with other people that activated with BestBuy also? Also if Sprint store activation still have the 30 days?
Negative..14 days to opt out, after 3 days you have to pay restocking fee, $350 early termination fee at Sprint store. They just went over this with me

I'm glad you posted this. People in our state need to know their rights. We DO have 30 days. I believe this is because of AB1010 in 2006 or 2007, but not sure.
I saw and heard the girl at BestBuy bring out the new Sprint subscriber agreement and thought boy am I glad I didn't get one of those. But yes they are active at BestBuy. I'm sure they will still enforce it with me even thought I didn't get one.

SERIOUSLY WTF happen to the LAWS!!!!! like I mentioned in another thread, is there not just a California Law, but a FEDERAL law created by the Federal Trade Commission that generalized the 30 day return policies for ALL BUSINESS SALE AND TRADE. its there for the good reason so business's cannot take advantage of Consumers RIGHTS for sale of faulty goods and or services. This is to prevent them from STEALING your money.
I guess companies are really getting bold right now that the economy is so messed up they are feeling too Arrogant that people don't have money to take them to courts or something.
Wake up people our freedoms are getting taken away from us slowly.

Federal law pretty much says that if you purchase an item and it isn't defective, its yours unless the store wants to be nice and exchange it for you. Sprint can say "All sales are final. No returns," if they want to, unless the item is defective.
Individual states may grant more rights, of course. Like California.

BestBuy is NOT the service provider. You have 30 days to return the phone, fine, but 14 days to cancel service and not be held liable to the contract term. Don't confuse the two. Be careful and triple check the details with Sprint directly as well. Never hurts.

Yes Best Buy is not the service provider, this was understood by myself. Best Buy have you to agree to a contract and who is this contract for? Sprint. It doesn't matter what the Sprint's store or even Sprint.com has as their Subscriber Agreement. I didn't sign or agree to those terms. While in most parts BB's contract might be the same as Sprint but I only agree to the term in the one provided to me by BB for Sprint. It's clear that Best Buy did update the terms of their contract for Sprint subscribers as the ETF is now $350 for smart devices. The way that I see this is if there were to be an issue with the 15 or 30 days Best Buy would have to resolve it and not Sprint.
BestBuy can't resolve anything with the service contract term, as the service is provided by Sprint whether BestBuy makes a "honest mistake" or not. They can only resolve any 14 or 30 day return issue with the hardware.
So if you're going to rest on the laurels that if BestBuy makes a mistake and tells you 30 days cancellation when in fact it's 14 days and then BestBuy has the power or ability to "fix it" on their own, think again. All BestBuy can do to fix their boo-boo is call into to a Sprint customer care line (like any customer would do as well) and try to explain that they made a mistake. A word is good enough for the wise.
Yeah our (Sprint) activation fee went up to $36.00, but that's to ensure the monthly cost is going to stay lower.
Exchange policy changed to 14days verses 30 I believe they did this to reduce some overhead of people returning the phones. There is a $35.00 restock fee.
If you want to return the phone do it with in 3 days that's the only way for the activation charge to be refunded.
Now keep in mind guys/gals if you bank with a credit union you get 10% off your monthly bill, and you don't pay the activation fees.
Ok, I'm trying to weigh my options here. I have unlimited data and have no plan on ending that until they force me to. I have looked around and have found that a new HTC One still tends to go for around $500-550.
However, Verizon's ETF is $350, and now that the One can be had on contract for $50, it seems to me I could have the phone and only be out $400.
I actually ran this plan by a Best Buy employee as well to see if they could warn me of any pitfalls, and the guy said there would be no problem. But, I seem to find you guys know more than the guys at Best Buy or Verizon! So, here's what I had in mind...:
- Start a NEW LINE of service, not at all linked to my existing account, get whatever cheapest plan they have, and get the One for $50
- Wait out the 14 days "worry free" period, so that I am past the point where they would just want me to return the phone
- Cancel the service, pay the $350 ETF (plus a possible pro-rate for the half-month of service?)
- Profit!
Are there any catches? Any pitfalls? ANY way that I can screw myself over by doing this? Also, at what point can I switch the SIM card from my current phone over to the new phone? Right away or do I have to wait til I cancel the service? Do I need to do anything on the Verizon website as well? I have bought a phone outright for my wife and just switched the SIM and it worked fine.

Ok so as far as you know, what is the cut off where they can no longer ask me to return the phone, but will not charge me the full retail price of the phone either? After conversing with the Best Buy guy, he said this cut off is 14 days, after which they will not allow me to return the phone, and would only charge me the ETF, not the full price of the phone. Is he full of it?

NOT TRUE. I just opened up a new account to get the phone for $149. It was my only choice since I have a concession account and Verizon would not sell me the phone unless they could attach it to a consumer account and I wasn't about to pay $699 at Best Buy. I cancelled the next day over the phone. The rep told me I was within my window to return the phone. I told him that I wanted to keep it and he said that was absolutely fine. Got my final bill about 2 weeks later and was charged $350 ETF, 1 day service $3.50, and $11.48 in taxes. They tried to charge me tax on the Activation fee which they eventually reversed since the account was cancelled within the first 3 days. In the end I paid a total of $565. The cheapest retail is at a VZW corporate store at $599. I was satisified.

great info here, thank you. This is right in line with what I was expecting. Based on your experience, and the fact that the phone is now $50 on contract, I would say $465 is probably a good ballpark figure for what I should expect my total out of pocket cost to be for the phone.

If that is what they told you, that is complete bull****. That's a bs line that INDIRECT stores tell their customers. I know this because I was a store manager for one. The indirect retailers get paid when you buy a phone. When that phone/line is canceled a DAY before 6 months in term, they get their money taken back from them. Any new line or upgrade needs to be active for a complete 6 months before they are free and clear of returns and chargebacks. You tell them to shove it and call their bluff...Corporate Verizon should have NO problem doing this, I've seen it done. Hell....I've done it, but do it at your own risk because I don't work for corporate and never have, so idk what kind of guidelines they have about these types of things...
EDIT*** I thought you said the store TOLD you that, I misread. You WORKED for Verizon? Was it corporate or indirect? I've done this before, and have helped friends do it as well and there were no issues....

Ok, to play devil's advocate here.
1. Don't do it at an indirect. Best buy may be ok because they're large, and probably wouldn't notice/care enough to come after you with a chargeback. At my indirect you sign a separate contract saying if you cancel within 6 months, we will bill you full retail on the phone or you must return it to us.
2. If you cancel within the first 14 days, YES, corporate can bill your account full retail on the phone. Most carriers have a "gaming" department that handles cases like these.
(Source: I used to work in a gaming dept. Charged a guy full retail on 10 blackberry bolds )
3. You'll have the cost at the POS, a $35 activation fee, half a month of service, and the ETF. Just be aware of all of these.
4. When you call in to cancel DO NOT say it was lost/stolen. Don't want your ESN getting flagged

No, you can't take it back to a store. You can call customer service and explain that you want to replace a faulty phone. They will either tell you to ship back on your own dime or they will give you a prepaid shipping label. Insist on the prepaid shipping label and make sure you bring up the restocking fee etc. I hate dealing with returns on internet orders with T-Mobile. It can be quite the hassle.
I've returned 4 phones in 3 years. 2 were horrible expeiences. One incident took 2 months to resolve. Tmobiles return warehouse is a 3rd party Tmo outsources to. Communication between warehouse and Tmobile is horrible.
Here's the best tip you will ever get from someone who has made over 15 exchanges with TMO:
MAKE SURE YOU SAVE YOUR TRACKING NUMBER AND RECEIPT.
I need an exchange, and because I'm in the buyers remorse period I have to ship the phone back on my dime (They will re-imburse), and once they receive the phone, I was told I needed to do another JUMP upgrade. What a disaster. The other thing I can do is wait for the 14 day buyers remorse period to expire then get an exchange but they can't guarantee a new phone. I have no issue with T-Mobile service where I live and play, but they are a friggen disaster to work with CS wise.
So, this is weird. I decided yesterday to return my Note 7. I bought a different phone outright so I can get my upgrade.
When I got home I noticed my receipt said 0.00 refunded. I called 611 and the rep had no idea so she called the store and we got on a call together.
The rep is stating that it will take up to 3 billing cycles for me to get my refund because the original purchase date was back in November and we're outside the 14 day window from the replacement device.. That doesn't make any sense. Can anyone confirm this?
What, you left your Note 7 at a corporate store?

I am to get a full refund. I don't want to burn an upgrade in the process.

What happens to the device payment agreement I have for my Galaxy Note7?
Your Galaxy Note7 device payment agreement has been automatically canceled, and you'll receive a bill credit for any payments made towards your installment balance.
Additionally, you'll receive a refund or bill credit for any taxes, down payments or upgrade fees you may have paid. Please allow 1-2 bill cycles for credits to apply.

You'll get a refund in 3 billing cycles... IF THAT.. and while you are at it burn an upgrade unless you have an extra loaner phone .. or willing to pay full price on a device
i bought mine on a 2 year contract, after the first recall i took my phone down to the store, and the sales rep rushed through the exchange, and marked me down as a payment plan, so i have to wait longer to get my money back that i paid on the 2 year contact, because the sales rep was upset and rushed through the exchange. a bit frustrated, and have to wait till december to see the credit (which better be there) and i dont want to get a new phone during this period, because i dont want to mess anything up on my account now... so in other words looks like there is a bunch of us waiting for our money

That doesn't answer my question. If I return the phone directly to Samsung, where is the benefit? I still don't have a phone unless I burn an upgrade taking an inferior phone.
I paid outright for my phone and received my refund in 3 days.
