So I was probably not the only one who got this text 'T-Mobile customers can now cancel they're contract with immediate effect due to changes in T-Mobiles T&C. For more information call Mobile Outlet' I researched a bit and you don't pay but you can cancel your contract, so what phone should I get now I have a £20 pm limit and will keep desire as my main phone ... BEST PHONE EVER !!!!

sweet dude!
If I were you I wouldn't get a contract with a new phone attached I'd get the cheapest data-enabled sim only one you can, that way you should save even more money!!!
Or you could get another desire and sell one of them on ebay and make a killing....
Might do but I could do with another Android phone to mess around on I'm thinking milestone or maybe Hd2
Sent from my HTC Desire using XDA App
what? I didn't get that text
not so fast!
they have done a U-turn on this now and said that it is only new and upgrading customers that will be affected, so if you havent cancelled yet then it appears you are out of luck as your T&C's are not changing.
http://support.t-mobile.co.uk/help-and-support/index?page=home&cat=DATA_CHANGES
the same thing happened to me on Orange and i got the touch HD, then managaed to leave the contract 2 months in, which was nice!
hopefully you managed to cancel, but LOOIE, it looks like you're too late
I know I called 1 hour late I do use about 500mb so I won't care ... let's all RAM the network so they change it again

I think thats our best bet, otherwise when we come to upgrade they will put us on a crappy data package (or fair use as they like to call it)

I hate T-Mobile!!!!! Well I love them up until now.
Theytold me when I renewed my contract over a week ago that the HTC Desire was in high demand and it would take 10 days to deliver! Ok not a problem they are now telling me though they have no idea when they will be able to get it to me and advised me to phone my local store (as I deal with the contact center). My local store is refusing to answer the phone and I have tried T-Mobile stores all across the county and they all have massive waiting lists and not accepting any more names :-(
They also said they would buy from Carphone Warehouse but none of their stores are answering the phones......
My last attempt one of the suppliers my company deals with on a weekly basis have 5 HTC Desires sitting in the warehouse ready for purchase but T-Mobile are refusing to let me get it from there! I can't afford to buy it myself and I don't see any harm in them buying it from there for me. They gave me the reason that each supplier gets a different price for it so I replied with well I will pay the difference (wouldnt be alot surely) but then they changed their story saying we are not allowed to purchase from companies that are not T-Mobile Accredited!!!!
This is winding me up now. Its my birthday tomorrow and I really want my new phone but I can't afford to buy one myself!!!!!
Sorry just having a rant. Anyone here work for a T-Mobile store and can get me one on my contract?
Man that sucks. I don't think its just t mobiles fault. Htc are having a mere getting hold of the AMOLED screens, as the manufacturers (samsung) are keeping them to themselves for their galaxy s phones. (and are probably enjoying having their main rival in the android handset market over a barrel.)
Could be some time for htc to get the phone altered to use the SLCD screens. Google amoled + htc + samsung for a better explanation than mine!
In the mean time, what is t mobiles "cooling off period" for sending a handset back after it being supplied? You could use this opportunity to try out the competition, and send the thing back before the dead line and try something else!
Make enough of a nuisance of yourself and you may move up the priority list!
Who knows, you may end up liking either a sony x10 or a galaxy s. If I could not have a desire, I'd lean towards the galaxy s.

That's a bit out of order from Samsung, if they had an agreement they have to fulfill it with HTC...
Well when my Desire stopped vibrating I called up T-Mobile (This was within the first week of release) and the rep told me they had around 900 Desires in that morning and by 16:46 the same day they had 54 left. I got number 52 as two had been sold whilst I was explaining my problem. That was in April.
So either the phone is much more popular than I thought and HTC can't make them quick enough (which is likely due to AMOLED shortages) or they didn't expect such a high demand after the initial early adopter phase (First month).
Sounds like you are not making enough fuss to customer services!
I phoned orange up a couple of months ago as I was getting the same stuff.
First they said they were in stock and I could have a really decent contract with free phone!!!, but... literally phoned about 20 mins later to make an order and it had changed to 300 mins less and £50 for the phone! and the best part was they said stock would be another 2 weeks to a month and I can't go on the waiting list as it's full!
Pissed off, I decided to go to high street stores to get a more expensive contract and alas, no-one had any and if they did I was told that the tariff I was on would mean I would have to pay £75 for the phone!!!
So I got home, got myself in a strop and phoned orange to complain, funny enough they added me to the list (before it was full), they said when the phone was in stock they would text me and as soon as the text came through I needed to call them straight away as it was first come first serve after the text was received.
Patiently waiting (not) I decided to call the next day to find out whether it had come in, they said yes and were sending the texts out to everyone now, with 6000 odd people on the list I didn't fancy my chances!
Somehow while trying to get them to haggle on the contract (cancellations dept) which they did in the end - gave me a great contract, god opened up the heavens and I got my text whilst on the phone, the lady sounded like she didn't believe but I gave her the code and she said congrats and that I could reserve a black one!!
The next day there is my shiny new Desire on my doorstep!!!
The End... lol
they seem to have it in stock on the t-mob website:

Judging by reports, galaxy s is the best sold phone in South Korea ever since it was released, and it surpased Iphone in sale numbers around the world. Samsung is planning to sell 10 million pieces of this phone...
T-Mobile and their stores are getting regular deliveries but because there is such a backlog they go before they even reach the shelf!
I spent the whole day on the phone to T-mobile yesterday they were phoning around all the stores in the county as well as Carephone Warehouse (who none of their stores were answering)
There was stock at one of our local suppliers but T-Mobile refused to purchase from there.
I finally late yesterday managed to get hold of Carphone Warehouse local to me who told me they had sold 10 that day and there was 1 left so I told them to hide that phone and keep it for me and went down there after work and collected so I finally have my Desire
T-Mobile did lie though and said it would be free but I had to pay another £30 to get it :-( - Better than waiting for months though
By the way I don't like the Samsung's
Not a device for me
Good news. You'll love this phone. Give the battery a few charge cycles before expecting to see it's full performance tho. Its worrying at first!

You should have switched to another network
Well wr8_utd, There is that option but using the points below you can see why I dont:
> o2 - Had very poor experiences and hate them - My company used them as well when I fist joined and nothing but problems
> Orange - Poor to no signal in my local area
> 3 - Heard lots of problems about them
> Small dealers like Tesco - Can't offer me what I want
> Virgin - My dads on it and he doesn't get a signal anywhere! No point in having a mobile
> Vodafone - Possibly a viable option - Who my company is currently with and apart from two months having a bill around £6,000 for one handset they have been good.
> T-Mobile - I have been a very loyal customer for I think it must be about 6 years now (back when they were 1-to-1?) That gives me negotiation points
> T-Mobile - I have brought many customers to them over the last few years through my account - again adding to my negotiation powers
> T-Mobile - Always offer me exactly what I want (even when they don't have a contract that offers exactly what I want) - For instance When I wanted the HD2 to get it free their cheapest contract was £40 per month. I told them I wanted that phone for free but only pay £30 per month + wanted unlimited internet but I was happy to juggle min and texts with them and they were happy to comply
> T-Mobile - One of the best Customer Support Centres I have ever experienced. apart from one or two prats over there who don't know what they are talking about they are normally very kind / generaly know what they are talking about / normally answer quite quickly (until recently but select that you are leaving them and they answer very quickly )
> For what I am on every other network seems to charge me more
> HTC Desire - Seems out of stock with every network...
Now you can see my logic behind sticking with them.
Hehe yeah I can see why now
Is it out of stock at stores as well now?
Oh and how is the 3 Network?
As I said above I haven't personally used the 3 network but I haven't heard a single good word about it, its all been bad so I am not tempted to go near them.
All the T-mobile stores have massive waiting lists, Online shops all over the place say out of stock. All my suppliers at work apart from one our out of stock (even the mobile specialists suppliers are out of it) So I imagine its the same all round. The trick is to keep trying every day I was lucky, Our local carephone warehouse received stock in the morning I was ringing them all day but they were under staffed and too busy to answer the call. Finally got through to them abour 2pm and they had one left which they hid away and reserved for me
Nothing wrong with 3 UK service is improved from their call centre and shops are fab .. good deals as well plus the bombed all other companies out of the water £349.99 for unlocked unbranded desire when they first came out
Give em a go oh and very few two year contracts most eighteen months
Sent from my HTC Desire using XDA App
Oh forgot to add they were poor at beginning when they first started hence poor reports but honest they are probably on of the best now (just get unbranded handset if you do their firmware updates are the only issue )

2 other option is
1) Get them to buy a nexus one for you and flash it
2) Get a wildfire
I intend to get one of the 3 Desire deals and unlock it. Will I have any issues after I unlock it?
meteor
i had problems getting my desire too, it was meteor in ireland i vent to 3 shops and they said they don't have them in stock and the third shop guy said they dont have it and he offered legend instead but some miracle happened when i said no he went to check stock second time and he brought phone over, they are acting strange ..
i hate t-mobile i have been with them over 8 years and they still treat me like S**T i only stay with them as its cheapest option but there like virgin terrible Cusomer support but as long as you never have to deal with them its mostly good. i personally went and got a desire off ebay 280 new, and a £10 pay monthly sim which was cheapest option and didnt tie me into a long contract which i hate especially with a company i dont like lol. mind you all phone companies need a slap for using the word unlimited to mean limited how much more proof do you need the benter then a 50p note.
I purchased my desire back in April from mobile phones direct. It has been fine up until last Wednesday. I can get online fine via 3g but I cannot make or receive calls or sms. I called t-mobile who did some tests and came to the conclusion that my handset has been blacklisted.
I purchased the phone brand new so it wasnt pre owned. It is locked to t-mobile.
I find it strange that my data still works. Can anyone confirm that the operator is correct, my handset it blocked for calls and sms only?
Anyone else have their handset blacklisted and got it unblacklisted?

Ages a go I remember reading about a blacklisted Nokia, where the service provider just blacklisted the wrong IMEI. They got it de-listed (?) After almost a year when the phone was worth nothing and was simply outdated.
I know that changing the IMEI would de-list it if it is, however that is illegal. And probobly no way of doin it on the Desire.
Sorry to hear man. Go to your service provider and talk to them. They clearly got something wrong.
All the best,

I have called mobile phones direct and they sent me back to tmobile.
Eventually, they said the handset has been blacklisted due to fraud. The person who "owns" the phone has requested it or is being investigated for fraud and there is nothing tmobile can do.
I need to get a replacement phone from mobile phones direct.
Is that crazy.
I think I will be buying straight from tmobile next time

So, what you are saying is that "Mobile Phones Direct" has sold you a phone that they didn't have the right to sell you as they bought it from the "real" owner?
As I see it, there can only be one of three possible legal owners. You, MPD or the person who provided it to MPD. Which one of the three has caused the blacklisting?
There is something very fishy going on here, possibly the old scam where someone gets a phone upgrade on contract, sells it on and then tries to claim the insurance for it being lost/stolen.
Sounds like that to me...but why are MPD selling it as 'new' when it isn't? Surely they owe you a new phone?
I also bought mine from MPD and the same thing happened about a month ago. It took T-Mobile about 2 weeks to sort it out - be prepared to be without calls/texting for at least this amount of time!
It was EXTREMELY difficult to speak to anyone that knew what was going on - they consistently said for the first 10 days that it was NOT T-Mobile that had requested the blacklist themselves but a third-party.
This turned out to be wrong in the end, and it was the T-Mobile fraud team themselves that had blacklisted the phone since they had been investigating MPD...
Your best bet is repeatedly to ask to go through to tech support and mention the fraud team - I ended up speaking to someone in one of the tech-support teams in the North-East/Scotland after about 10 days who managed to have direct contact with the fraud team, and they finally told me what had happened.
I think MPD are known for this practice to be honest - their registration process is a little suspect, and T-Mobile have clearly been investigating them...they told me I was not the first person to get a brand new handset from MPD only then to have it blacklisted in this way...
I'll never use MPD again and I urge others to not touch them with a bargepole!
I am glad I am not the only one. I called MPD and they are waiting on tmobile now. I hope they will be quick.
Ironicly after 1 day of purchasing the contract with MPD tmobile called and offered me the same deal for £50 upfront. I think a mear £50 is worth it knowing this kind of thing won't happen

dying to get this phone, but need to get directly from orange for F&F discount!!
It's not coming to Orange according to what i've seen on their facebook page. They decided it's not worth bothering with and recommend people asking for the Nexus to go for a Note instead!
You can get it in other places on Orange which is obviously no good to you, i simply mention this for the purpose of helping others who don't necessarily need to buy off Orange directly.
No.

After checking with T-Mobile I upgraded through mobileshop.com and still kept my F&R discount. I actually got the phone totally free on flext 35 with my 1/2 price line rental for life with the F&R. Thats 17.50 for 24 months
You might be able to do the same on Orange. Call them and ask them if you can upgrade through a third party. As long as its not a new connection it should be ok.
EDIT: your profile says you're on t-mobile?!
I am currently on T mobile, but have a friend who had recently started at orange, so was going to change to them.

Ahh.. when I got my f&r discount from T-Mobile I was already in contract. You should check if you can sign up for a contract then apply for the discount.
That way you could go with phones4u or mobile shop then add the discount?
Remember you probably can't claim cash back by redemption tho as they'll see the discount on your bills.

I know, can't even cancel my contract now, only way to get away from this company is to sell my one x and cancel the contract. Even worse is half of their employees don't work at weekends.
Also the phone has a different imie to the box. So if I try to get a repair from HTC I can't because the stickers that come in the box don't match the phone. Really pissed with the company. Also have had to pay £14 for postage twice and neither time been refunded

So I started my first contract yesterday with phones4u and the plan is rubbish £37.00 a month with 600 minutes and unlimited texts and 750mb. I filled in a sheet known as are you happy and now they are using that against me to say I was happy with the purchase and their are no exchanges or returns. So I was thinking do any of you know a possible excuse that would give me a exchange or return. The only think I have came up with is to tell the head office of phones 4 u that the o2 signal is no good in my area and I want to return the phone or change carriers the phone is a htc one x white. I did ask phones 4 u for help on this problem but they said they have no power over the contract and only the head office so I will ring them up and ask them can they knock the price down but I would rather return the phone. I need a good reason to return it or exchange it any ideas would be greatful I have used the phone and sim but this doesn't make any difference because when I was returning it today it was sealed and they were not bothered. When I went to phones 4 u yesterday I told the women when she asked me about my budget that I do not want a contract higher than £36 but the sales women failed to acknowledge that and still offred me a crap plan. I was going for a better deal but orange declined my credit check but o2 didn't. The sales women told me that yesterday she told me that after I sign there are no returns but I can't remember.

Think ur stuck in that contract, it's down to yourself to read what your signing before you sign it.
As for saying you have no signal, they will probably check how frequently the phone has been used to make receive calls and texts to see if you really do have signal.
If you have been missold the contract though you may be able to get somewhere, but at the end of the day you would have been giving a chance to read the contract before signing away.
Sorry to say I think you may be stuck.

As far as I understand it (somebody will correct me if i'm wrong!), in this country you have a 14 day cooling off period after signing up for a phone contract were you can cancel it without having to give a reason.
I got exactly the same deal as you on t-mobile through buymobilephones.net for £26 p/month so that deal is very poor.
I suggest you ring phones4U and tell them you would like to cancel the contract and quote this '14 day cooling off period.'
14 day cooling off is only for online or phone sales not shop. When you approach the store and sign there isn't much you can do.
Sent from my HTC One X using Tapatalk 2
Yup you are stuck in the contract. I have only managed to get out of 1 contract but that was only because 3 killed the mast in my area and left me with no mobile signal for over 2 months. It took me another 4 months to get out of the contact ( and this was not easy ) but eventually after getting in touch with the comms regulation board they admitted that there was a loss of signal in my area (after they tested) and release me with a refund and no extra charges.
So if you do try to go down the route of no signal be warned they will test and check.

In what way did the contract trick you, as your thread title claims? You must have known what you were signing up to (and if you didn't, well...), and you apparently even told them you were happy with it.
Maybe you've changed your mind or seen a better deal and you're not happy now with paying £37/month, but that's a different matter.
Sorry if that sounds harsh, but there are far too many people who rush into long term commitments (of all sorts) and then scream "it's not fair" or "I didn't know".
Even tho phones for you say they have a no returns policy you can 14 day it! I 14 dayed a note this year as the vodfone signal in my area was shocking. Phones for you cancled it there and then. If they feed you with some **** and bull explain to them that if the signal is not serficiant in your area they cannot provide you with a full serive. This info came from someone that i no at carphone warehouse who used to work for p4u

1st mistake: you went to phones4u
2nd mistake: you signed a crap contract
sorry if it sounds a bit harsh, but if you knew it was a crap contract why did you sign it? But I do want to help as I know how you feel as I've had a bad experience with them before and knowing what they're like they more than likely pushed and pressured you into signing that contract.
phones4u sales people in their store are dicks, all they do it want to make a sell and then never see you again. they don't want to hear about any issues you're having or help you out at all once they've made the sale.
they used to say contract phones could be returned within the 14 cooling off period provided by the network provider but they seemed to have changed their tune now. see link:

the best bet you have now is calling phones4u customer service line, they are a heck of a lot more helpful than the sale driven idiots in their stores:
you should be able to reach them on 0800 0725858 or 01782 673100
also a piece of advice, if you have spoken to customer service and they authorise the return make sure you get a reference number and then get to the store while the customer service lines are still open, otherwise they will make excuses like, no we don't take returns, can't find you case number on the system, well can't speak to customer service now as they are closed, you'll have to keep the phone (this happened to me)
o2 has a 14 day cooling off period which you can cancel and return the phone, but I am unsure of what the agreement is when you don't buy directly from them. But you can also call them for free from you o2 phone, on 202.
hope this helps you get this sorted, also if you feel that the people in store did not help you and pressured you into the contract, being unprofessional etc you should also make a complaint to the head office after this is all resolved and they may offer you some compensation.
btw, you will always likely to find a better deal online. and next time avoid phones4u like the plague, and always check if there is any cancellation policy. if not do not sign anything unless you are 100% sure its what you want and its the best deal.
