Apple targets 8 Samsung phones for sales ban - T-Mobile, Samsung Galaxy SIII

Here is the article. I think Apple is going a little over board with the last line of the article.
In its filing, Apple says this list is only "to address a portion of the immediate, ongoing irreparable harm that Apple is suffering."
Ongoing? Irreparable? So I am assuming that Apple thinks everybody that bought a Samsung Galaxy phone thought they were buying the iPhone. I would love to see an estimate as to how many people really thought they were buying an iPhone when none of these phones had "iPhone" "Apple" or the Apple logo on the phone.

I think it's fixed now. But yea. I think Apple is really overdoing it now. And the article states out of 28 devices. So I don't think this is more or less about patents anymore. It's more of Apple wanting to be the only smartphone out there that American people can buy.

they are even suing samsung for making ''rectangular'' phones.

I don't necessarily think that apples phones are ****ty. I think they are a good smartphone. Samsung and apple are two very good companies. And apple started by providing a quality phone straight across the board and great customer service. So now Samsung finally caught on to the strategy that was obviously working and decided to do the same in its own way.
Android is the kicker that is scaring apple. Because apple is open source and the open community is doing outstanding things and pushing android past its "boundaries". In return this is what Samsung used to become as important in the smartphone market. We see the same in others. HTC...
So because android and Samsung are such a threat to apple, they decide to sue hoping to destroy Samsung's and slow down the android momentum. But now that Google is involved who happens to be a big bad ass. Apple will ultimately lose or setting to drop charges.
This is definitely a fight that can go both ways. And no doubt we are in to experience and epic dual between Samsung/Google (android in general) and apple.

Apple is definitely taking this a bit too far. Insecurity? Maybe. Though Apple's products so far have been really nice, I find it a little disturbing that a patent for designs can even be issued...that too based on the shape. The monopoly that will (?) follow would not be in favour of the industry nor would it be in favour of the customers.

Even though these are no longer premier flagships, the GSII line is still in the upper echelon all things considered.
Though I will admit that the droid charge can be banned from earth as far as that goes.

I am not sure Nazi Apple are targeting Sprints GS2 but I heard rumors that Boost Mobile is going to release that phone for Sprints Prepaid line up.

I've been reading all about this, and I am just APPALLED if I have to pick a word! Apple's mama needs to spank them and put them in time out for acting like a bunch of immature, spoiled, bully brats! These are supposed to be adults, not to mention the smartest on the planet, and their acting like punks! Should Ford sue Chevy for having power windows? Kinda got a lil wordy, maybe a bit carried away Really won't hurt me at all, I just got a lil heated over the fact that they can get away with it and that our justice system is actually that retarted that they would rule in favor and therefore tell the world this is bs acceptable. On a side note, y'all ever seen the LG Prada?(pic below) It came out long before iPhone....hmmmm....look familiar? HEHE I sold my iPad this morning (after reading your post lastnight) to a co-worker here, and agree, I will NEVER buy an apple product again. Got me some spending money, now I am going to buy the wife a Galaxy S3 to. This is her lucky day....

i showed off my galaxy s2 to some of my friends, it seems that all of them claim their iphone is better and all that crap with no backings to prove it, i even told them mine runs at 1.83ghz with a larger screen, better camera and all that

I think an amazing summation of the Apple obsession is the new Samsung ad with all the Apple people in line for the new iPhone. IMO this is the best ad of the year. It's about time that someone at least TRIED to wipe that smug look off of the collective face of iPhone users. iOS is a nightmare. As a former Objective-C dev for the iPhone I'm sure the community has heard all the trials and tribulations of dealing with Apple's App Store process.
Apple is an amazing marketing company. That's all. The are able to sell an inferior phone with outdated technology for a premium price and people LAP IT UP. I for one will never be ashamed to show off my SGS2 to any iPhone user.

That's a great commercial and is the truth.Then at the end the dude said the retro thing. Apple fans always have a way to make theirs seem like the best.
iPhone was cool for 3 months when I bought it, jail broke it, installed cydia, winter board and did some theming stuff. Then I sold it for something else cause it got boring.

Now imagine if Sgs2 have same build quality as iphone, then ofcoz the price must be higher than iphone. And maybe not many people going to buy sgs2 because of the scary price. Unless you're deep pocket.
In my country (Malaysia), iphone mostly use by chinese girls, prostitute, gay, ladyboy, and sometimes you can see 13years old school boys bring ip4s.. Is your friends belong to any of this group?

I'm an apple lover. I have had amazing experiences with Apple in terms of both product quality and service. When the iPhone first came out, of course I wanted one. But then I saw the g1 and feel in love.
My love for Apple ends with their laptops because why spend more for a desktop with less performance that can't be upgraded. I will only ever buy Apple laptops for the rest of my life. Period. But when it comes to my phone, I want it to look and feel like I want it to. And my treats change quite often.
However there are people like my wife or my mother who don't need that ability. They want to be able to change the wallpaper and then they want it to just work, and for people like that, an iphone is perfect.
There is no such thing as better, both types of device have a purpose and a valid customer base. That said, do I like to show pugs my huge screen to my iPhone loving best friend? Yes. Does she like to bring up that she can go days with not charging? Yes. Both have benefits.
Except wp7. That just sucks.

I agree. Apple is amazing and all, but our phones outperform it and have more features. But yhr thing is, Apple has a name. How did they get that? By supporting their products. All iPhones get timely updates and excellent customer support. That's why people stick to apple more. We still haven't gotten wifi calling even though it was promised at purchase. Blame T-Mobile or Samsung, but if an Iphone had a similar issue, an update would be expected within one to two weeks nno matter what the carrier is. Another thing is that unfortunately until Apple adopts a certain feature (NFC for instance) it won't go mainstream that can be used anywhere and everywhere. Don't get me wrong. I am in NO WAY an apple fanboy, I love android and live my S2. But you have to give them credit for what they do right.

Now that the 4S is using a core supplied by samsung, I would only imagine more of the iphone is actually made my samsung.

...depending on the user that is. There is no best phone for EVERYONE. Too many variables and individual desires and tastes to claim one is universally better then an other one. Pick the one you ultimately prefer and that one is "better" for you.
Additionally, most Android phones have a very limited shelf life in terms of performance and features. Within 6-8 months something better will replace it.
Back on the question regarding brands....My honest answer is yes it does matter to me at least. Example, I would rather pay more for Levis over a brand like Wrangler or something similar even though they were the same quality.
I keep asking this question to isheep people. What happens when the iphone murders all competition and its the only phone you can buy. Cause lets face it companies will sell what makes money. And apple is gold.
I think its fine to buy what you like but not giving the competition a chance is just bad for the economy . Its just like if we all bought at walmart and not target.target would only be right in closing down thus losing all the jobs as a result .so no i wont by the "honda civic" of phones. Ill stick with my gas guzzling tinkering muscle car of a phone.

i definitely agree with you, just look at the desktop market..
i see a bunch of people claiming how imacs are better..blah blah...
but..
it uses the same hardware, hell..lower end hardware compared to everyday pcs, it's restrictive and extremely overpriced(i've successfully combined the same build as a 2000dollar imac for 600dollars on newegg)
now the pc dominates the macs, theres definitely no arguments about that..and they've already overpriced their computers..what do you think would happen when microsoft is out of the equation? computers would cost more than 10grand/pc
and performance per watt would probably go up by 10% per year, instead of doubling per 18 months now(according to moore's law)

Yes, android phones gets replaced rather quickly, but if you used your brain a little, you'd realize that's the result of competition, manufactures push out new phones every now and then to compete with each other, so not only do we get higher performance phones but better price points as well.

You gotta hand it tohem for still being in the game for providing an OS that is practically unchanged over the years. Goes to show how far brand power can go. I have seen android evolve over the years since the g1 but I would say the target audience is everyone. Anyone can buy any kind of android phone within any price range. I would say there is a specific audience that is targeted with apple. They have loyalty with them and others will follow, possibly breaking the bank to do it. I have worked for plenty of doctors and none of them owned an android phone. Mostly apple products and would upgrade when a new one came out. Why? Because they have the funds to do so.

With apples iphone sales slowly declining and losing loyal customers, I don't see this being an issue...not just with the phones, I am reading alot of fanboys upset about the new mbp and how everythings soldered down making it near impossible to upgrade or repair....
Apple will fight tooth and nail saying that other companies stealing patents are the reason they are losing business, but they are really doing it to themselves being greedy.

It's just the basic forms of technological evolution. We've seen what phone such as the Samsung Galaxy S3 brought, they bring so much more than the iPhone 4S or maybe even the rumored "iPhone 5". Like honestly Apple is slowly becoming a monopoly, if anyone knows history Standard Oil was seperated into different oil industries because of actions that were harmful to the consumer/ government/ and other industries. Apple, being a large company, would try to take out any sort of competition that would "try" to honestly throttle their sales of their product. Customers all don't want to be tied down to a single phone. Just like people have different tastes in food, clothing, and other marketed products, they will also continue to have different taste in phones as well. It saddens me because my first phone was an iPhone (1st Gen) (I was 17 at the time) and I was proud to have it. But after seeing other phones that bring better features and finally ended up getting better and more phones that have better use to me. I get disgusted by the fact that Apple is using tactics to obliterate competition. Tactics that will not only hurt the industry such as Samsung, but also the consumer because I am 100% sure that this Android community will want to have iPhones only. What ever happened with that patent that Palm had for the phone app? It was rumored that if that was ever brought to court all iphones would just become ipods.

Doesn't Google have it's own arsenal of patents it owns from Motorola mobility... as in first cell phone. If Apple doesn't play with Google, they could say "fine... you don't want us to have a touch screen... you don't get to have a cell phone."

Yeah, apple won against Samsung, lol but they royally pissed off google. Google just bought out Motorola patents.. And in turn just started and infringement copyright suit against apple for using Motorola radio patents. No more iphone,ipad,ipod being shipped to US, Australia, or the UK till after a ruling lol.. Guess they should have played nice.

Yeah there's really no "taking the high road" on this one. If apples not going to let up Google should just fire back with all they have. I hate to say it but its clear apple will never stop with rediculous suits, so Google should follow suit. Let em have it.
I made a pinewood derby car in 1989 that looks a hell of a lot like the iPhone 4, think I should sue too. And just like the iPhone it would have had to cheat to win.

Apple only superficially won, it will more than likely be drastically reduced or overturned rom appeals. There's no way in hell those jurors answered all 700 questions on the juror petition in 21 hours, that's 100 questions every 3 hours. And the jurors admitted they made their decision the first day. I guarantee you not one of those 12 people understood anything about patent law before or after they found in favor of apple, and i guarantee you more than 70% of those jurors own ipads and iPhones so of course they will rule in favor of the psuedogod crapple and all of their ifail products. Its utterly ridiculous. Not to mention all of apples patents on software was opensource software no one patented because it was opensource so apple just stole it and patented it to claim rights to it and try and stop android because they are losing their market share due to them not innovating anything and just slapping a new number on the same tired OS and device and selling is as a new breakthrough product. Sooner or later people are gonna wise up to the scam and stop paying 600$ for the same device they already own cuz it has a few new apps a new product number and is claimed to be brand new, when really its damn near identical to what they already own.

How about somebody come up with something totally different than what is out there now? HTC, samsung, motorola, lg, or even apple. Ya the S2 is when they started to say let's make the iPhone but bigger, faster, better, stronger. This is not good for Android, ultimately the customers pay in the end. And was this a surprise to anyone Steve Jobs' dying wish was pretty much get rid of Android by any means necessary, it is probably in Tim Cooks contract somewhere to be rid of Android by 2015 or something. I mean Jobs said go "thermonuclear" on Android, I'm pretty sure they are prepared for this fighting back and they do have a hell of a lot of money to the extent last year they were trying to figure out were to spend in the company because they had so much laying around. Anyway screw apple, they suck. They are suing over old devices anyway.

“When I got in this case and I started looking at these patents I considered: ‘If this was my patent and I was accused, could I defend it?’” Hogan explained. On the night of Aug. 22, after closing arguments, “a light bulb went on in my head,” he said. “I thought, I need to do this for all of them.”
Word on the street is that this so called jury foreman has his own patent for something I dont know what and that he came under dispute over it. This jury foreman LOST that dispute and had a axe to grind hence on why he said I need to do this for all of them.
This whole trial was nothing but a rigged scam and a fraud. The judge and get this worked for the law firm that handles apple's patent cases. Yes she used to be a lawyer that worked for apple and apple was a client.
Now you have a jury foreman who had a axe to grind because he lost his patent case
Too much BS in this case. The deck was stacked from the gitgo against samsung. Pretty funny tho that in Asia and even the EU samsung is kicking apple's arse and winning cases.

Personally I think if apple gets away with this and I half hope they do. The lobby,election year, and public out rage could cause patent reform. If Samsung loses big, google loses big etc bet on hardcore revenge and every dollar they can spare buying sennitor and representative votes

"The first points of concern were identified shortly after the initial decision was revealed, with Samsung spotting – among other things – that the Intercept smartphone and Galaxy Tab 10.1 LTE tablet had seen damages awarded despite not actually infringing. That forced a recalculation, dropping more than $2.2m from the overall damages.
Potentially more concerning – or good news for Samsung’s appeal, depending on how you look at it – is the jury’s apparent lack of interest in the instructions, which contained 700 questions to be considered. The complexity and number of those questions – spread over a 109 page document [pdf link] – stand in contrast to statements by other legal experts that suggested a “consistent” judgement among jurors and “thoughtful” answers were sufficient to indicate a solid verdict.
“If the jury rushed so much it assigned $2 million dollars to Apple, and then had to subtract it because there was no infringement, it raises a valid question: what was the basis for any of the damages figures the jury came up with? If they had any actual basis, how could they goof like this? Was there a factual basis for any of the damages figures?” Groklaw
Meanwhile, juror Manuel Ilagan suggested to CNET that the process had been made “faster” based on initial assumptions of prior-art and that the group later realized that each had decided Samsung had infringed “on the first day.” Ilagan mentioned that “the e-mails that went back and forth from Samsung execs about the Apple features that they should incorporate into their devices was pretty damning to me.” Foreman Velvin Hogan also revealed that the jury’s motivation was a message “sufficiently high to be painful [to Samsung], but not unreasonable” rather than “just a slap on the wrist“; that’s despite an note in the instructions making clear that any penalties should be compensation not punishment:
“The amount of those damages must be adequate to compensate the patent holder for the infringement. A damages award should put the patent holder in approximately the financial position it would have been in had the infringement not occurred, but in no event may the damages award be less than a reasonable royalty. You should keep in mind that the damages you award are meant to compensate the patent holder and not to punish an infringer”
There has been no shortage of opinion and speculation shared about the Apple vs. Samsung outcome, by a wide range of experts. It’s worth noting that Groklaw approaches law with “open-source principles” in keeping with its community support of Linux and the open-source movement; that’s not to say it cannot put together a measured view of Apple’s legal case, of course.
Samsung has already confirmed that it intends to first challenge this ruling and, should that process fail, present its case to the Appeals Court. Apple, in the meantime, is aiming for an injunction against multiple Samsung products, with the date for that injunction hearing tentatively set for September 20. Justice Lucy Koh could also opt to as much as triple the jury’s damages decision, to more than $3bn.
Still, Samsung isn’t happy even with what legal avenues are open to it. “It’s absolutely the worse scenario for us” an unnamed senior Samsung executive told The Korea Times, with an emergency meeting called between the chiefs of the corporate strategy, mobile device, and marketing divisions. Some patent experts predict Apple will now be less stubborn in its patent cross-licensing negotiations, having left Samsung weakened in the courts, with particular interest in the Korean firm’s 4G LTE technology. LTE is expected to feature in the new iPhone, with Apple having opted to leave it out of models to-date over concerns about 4G battery life."

This is like Ford suing Chevy because the Silverado has four wheels just like the F150. How can anybody patent what is clearly the most practical way to design any other similar device. The jury was full of idiots, this much is clear. Seriously, do they expect all other devices to be shaped like the iCarly Pear Phone? If two devices running completely different operating systems are capable of executing similar tasks, the software still has to be written differently to be compatible with either iOS or Android. Can one flashlight manufacturer sue another because both their products produce a beam of light but one uses power switch to activate it and the other has a push button? Why doesn't anybody directly involved in the case think about these things?

They are not the most valuable company in the world not by a long shot. Last year Apple was #43 by the way Samsung is #10. More Wall street spin....trading valuation vs real equity are two different thing... If you try to figure out the true value of Samsung you will see they like to hide facts behind subsidiarie revenues and veiled revenues. Samsung corp and subsidiaries value is almost impossible to figure.

Every damn day now it's "omg! I didn't know it could do this!", "did you know there was an app for that!! and a widget! I <3 widgets!!"

Too funny. I grabbed her the Tmo slider G1. No data on that or the MTouch 3G. Finally after years, she's on sprint with data. She's so cute how excited she is to have a baller phone AND data service.

My fiancée wanted an ifail so badly until i told her I wouldn't b seen with her using that thing...lol.. we both sport the note 2 now...hehehe.. now if only she'd let me root it for her so she can see what it can really do!

The funny thing is, that this phone was already a beast without root. I'm not dissing apple cause it's a great phone but my thing is, there are so many more options.

I had a friend who was Iphone 5 all the way. He even ran his mouth how dumb of a decision it was. untill i bought it and he couldnt keep his hands off.

My girl has iphone4 and says she has no special loyalty to Apple so I had her play with my note 2 a bit. The size is way too big for her hands, comical really, but that's no problem there are other great phones.
You know what it came down to? Bejeweled Blitz.
She plays that game constantly and there is no equivalent in the android market.
There are several bejeweled clones and one real bejeweled2 from EA, but it turns out they all suck.
The apple version is perfectly responsive. Every time you touch anything it reacts immediately no matter what else is going on elsewhere on the screen at the same time. But on my phone it won't even register trying to swipe new jewels until the explosion animations from the last move are all done playong out. This is on a note2 that's even somewhat debloated because I deleted all the services and junk for weather, stocks, social integration, allshare, sysscope, smart device manager and touchwiz. There can't possibly be a cpu issue. And this was the real game from EA/PopCap not the small indipendents.
I never play any games so I would never have noticed this. But just watching her try to play a simple game on the supposedly highest end badest badassest uber phone was pretty embarassing.
She actually said it's not necessarily a deal breaker but I believe in quality of life. If that's what she likes and Android can't provide it then that's all there is to it. Guess she gets an iphone 5 even though she lives with an Apple hating unix sys admin.
I actually blame Apple more than Android or the game developers. Apple forces developers to choose only one platform to invest their limited resources by blocking use of cross platform tools, and few developers can really afford to support multiple platforms the hard way without cross platform tools.

There's nothing wrong with Apple products. They cost more and it's a closed box but it if you download something from the App Store, it works. No force close, no lag, nothing to complain about. The tablet apps are actually designed for tablets and for the most part they get updated with every iteration of iOS.
I love my Note and the Galaxy S2, Thunderbolt and Fascinate that came before it but I've never once got pissed off at an iPhone because the lock screen wouldn't come on without lag or the gallery froze the phone. The gallery in MA7 makes me want to punch a baby in the face.

Actually apps on her phone crash all the time. Depends on the app. We both use a unique app called guidebook. The android version works fine for me on both my ltevo with gb and the note2 with jb, but it crashes constantly on her ip4.
And half of her apps are old because they now require ios5 or later. She's on ios4 so she can't update any of those any more. And she doesn't want to update ios because she has good google maps right now.
The closed nature and vendor lock in and nanny app blocking ultimately causes more problems than it solves. It's ultimately a self-defeating dead end. It's only good for one thing, making a few people money right now. It's bad for both users and developers.

Lol apple has force closes they just dont tell their sheep cuz the assume they are dumb enough if a dialog doesn't show they'll just assume they caused the app to disappear . Theres nothing about apple at all appealing. Yep that's a solid argument.
Please tell me more about how you only support companies with pure business practices. Or perhaps how you speak out about all crooked business practices, and not only Apple.
I would imagine a thorough review of Google and their business practices may enlighten you- but that wouldn't be fun, would it?

Then quit being hypocritical- acting like using Android makes you a saint vs. Apple is a joke, plain and simple.
The fact of the matter is current patent law in America is disgusting. Can you blame Apple for exploiting what is terrible law? Absolutely not. Same argument a majority of the people are making against the rich and the current tax code.
Fact of the matter is a majority, if not all, people here are making an argument based solely on emotion. To state it in terms more complex than "Android v. Apple" is, at best, false.

Well most companies don't buy themselves frivolous patents and then use them to sue their competitors into submission. They usually work harder and pay people who have the skills to put them ahead instead of trying to cheat their way to the top. there's a difference between companies cutting costs by outsourcing work and companies cutting costs by stealing the work.
