I'm finally getting an Evo - however I plan on buying it from craigslist. There are a few people selling in my area for about $300, but I talked to one guy and he was willing to go down to $200 for me since I asked for $250 but it's a bit of a drive. Now I've seen good deals like this before, but the guy seems a bit skeptical but having delt on craigslist before... I know some people are just like that.
The phone (HTC EVO obviously) is brand new and un-opened, but I've never seen the box (other than the picture he sent me of it) and I wanted to ask if there was anything I could do to make sure it really is brand new and has not been opened or replaced with rocks! I could ask him to open it in front of me... if there is nothing wrong with it as he claims then he should have no problem doing it since I'll be buying it.
That's my only idea.
Is there a way to find out if it's stolen or blacklisted by sprint?
Any help is appreciated.
You can ask him for the ESN, then you can call sprint and ask them is it is clear for activation....if so, be sure to visually inspect it to ensure that is the one you are buying

Askfor the esn and call sprint and tell them u wanna do a esn check then check the box its not like sealed or anything it just slides open but inside everthing needs to be sealed in plastic battery phone and ask l phone will have a sprint screen protrxtor on it thats new I get evos all day fromsprint for 300

i purchased my last phone, a Touch pro this way. met him in a parking lot(walmart, HIGH traffic) popped open the phone, called sprint, told them the situation(they were cool with it) read off the ESN, came back clean, done deal.
I very much recommend bring a buddy or two. just in case!
I got mine off Craigslist, I just met the person at a local Sprint store and had the sales rep check it right there, he even called into the activation center to double check for me. Then took it home rooted, blah blah, and then activated later on the website.

The best option would be to contact the seller and see if he would be willing to complete the transaction at a Sprint retailer. This way you will be in a public area, and it can be checked prior to handing over the dough. Good luck on the transaction, and enjoy your new EVO.

I got two calls back last night, one of which would meet me at the sprint store! Her Idea too. But on my way out she called back and said she had another offer for more money... And I wasn't about to start a bidding war for her benefit so I was upset and went back to my original seller. The guy lived super far but I was potentially getting a great deal. Once I got there, I checked out the phone and tried to get a good read on the seller... he was VERY strange as most everyone I've dealt with on craigslist have been. This is my first craigslist phone purchase however.
So I called sprint, did the number thing and went through hours of customer service crap. Turns out, the guy has a business account (probably a made up bogus business but with a real fed tax ID and crap - anyone can start a business) and he buys the phones with pre-paid visa's, like you would use when making online purchases or give away as a xmas present. So these visa's look just like debt/credit cards that his "Business" would use and he gets the phones with plans so they're discounted (even though I can't see how he would get the MIR??). Once discounted he sells the devices or 'the hardware' for profit and at a good deal (seemingly) to the consumers like myself. I'm not sure how he makes much profit considering the EVO is $200 after MIR not to mention he had to have paid the first month of service and other fees/costs.... Maybe he was genuine and just bought the phone and changed his mind... but it seemed very skeptical.
Ok so the purpose of using the pre-paid visas was that in 30 days when the new billing cycle comes... Sprint will not be able to bill his visa because its out of money! It's not attached to his name or business like a normal credit card would be and now they'll try contacting him but I figure he'd probably just ignore them. Then a cancellation fee would be added ($200 more) but that wont get paid either and then I would assume Sprint will blacklist the ESN untill it's bill are paid.
What do you guys think? There was a lot more to the story so it may be hard to figure out what he was doing exactly. Maybe he genuinely was ignorant. Was it smart to not buy the phone off him? (even though it was only $200 unopened)
I had some people come to my home that were selling something on Craigslist. That night my home was burglarized. Figure it out.
Craigslist can have some good people on there but so many scumbags it isnt worth it.
Well I think it's obvious you should always meet in a public place. I would NEVER tell someone to meet me at my home!
this guy sounds shady and it sounds like Sprint not activate that phone if it's attached to an account that owes them money.
I think insurance is a good idea for my new phone. I have looked at SquareTrade and Ensquared. I am going this route b/c I am with TMobile and have an unlocked phone. (I am on a grandfathered TZones plan...)
Do you all have any experience with either of these companies? I have a 35% off code for S.T., but they do not cover theft?

I'm in the same boat as you. GSM GNex on T-Mobile. It would be pretty awesome to have the peace of mind of replacement insurance in case I break or lose mine.
Anyone else have any other recommendations? In the mean time, I have to renew my renter's insurance. I'll see if they have any way for me to specify the phone under the policy.

I added the Tmobile insurance when I bought my Vibrant last year. It is provided by Assurion, so I called and asked them if my GNex is covered and they said it was. But....and here's the kicker.....they told me I could only replace it with a Tmobile provided "then current" phone. Yeah right! Like I'm going to accept a Samsung Hercules as a Nexus equivalent, and that is after I pay the deductible? No thanks. I'll save my $8/mo. I was expecting this response from them anyway, so I wasn't surprised. I did ask if I could simply pay the deductible, they cover the rest of the cost of my GNex purchase price, send me a check, and I'll replace the phone myself and send them the old one. I liked the idea at least. LOL
I have SquareTrade for my Nexus S and iPad2. Will probably use it again for the Galaxy Nexus. They also give a lot of discounts if you look out for them.
Just FYI, I contacted squaretrade and they DO NOT cover the galaxy nexus GSM version, since it isn't officially a USA phone.

And FYI Assurion is a complete joke and waste of money. When the Nexus One was released I switched to T Mobile to get it. After about two months I dropped it without a case and shattered the screen. I called Assurion and they refused to replace my phone with a Nexus One. They said a MyTouch 3G was the best they could do for me. I spoke with 3 people there and they all told me the same thing. I finally resorted to calling HTC and filed a claim with them directly. They over-nighted me a replacement Nexus One and I sent my broken one to them. I had to pay $120 for the replacement but I was OK with that.
Needless to say I immediately cancelled my Assurion coverage and will never use them again.

No problems that I am aware of. It was an easy process online. Paid thru PayPal. They sent confirmation, invoice, etc...I feel better now when I leave the house. I am paranoid that my phone is going to be stolen.

Im not sure if they have geek squad were your from but, at best buy mobile, (that carries geek squad) they said I would be covered completely, for just 10bucks a month, & they give me a brand new one; only wouldnt if phone was lost or stolen, I have to have the defective one to get a new one free of charge

I bought a galaxy nexus for expansys usa, the phone is working well and is in perfect condition but 4 days after i got it i saw that it has a crack in the inside of the screen, top left corner
I think that is a product defect and not a damaged that i did, because everything else is in perfect condition, the outside of the screen is not damaged.
Now expanxys is telling me that I am in my own, that i have to deal directly with Samsung the manufacturer.
I feel cheated i thought i had 15 days to return a product that has a clear defect.
Beware they will sold you a broken product and will not accept a return
OP, did you use American Express?
AMEX will refund you the money IF the the online retailer will not accept a return.
AMEX will also give you accidental 90 day warranty damage (if you really need to use that excuse).
That's the risk you take by buying from an online retailer instead of a brick and mortar. And it's not as big an online retailer. It's a small retailer in the overall scheme of things.

Wow, this is not the kinda thing I wanted to read while waiting for Fedex to drop off my GN from Expansys. I'll have to thoroughly check out the phone as soon as I open it and make sure there's nothing wrong with it.

That crack is a known defect. Search this forum for "hairline".
I bought an n7000 gnote from them, but requested for an RMA before it even shipped to my house. I had the RMA printed and ready to go, but upon receiving the phone, the seal on the phone box was already broken. Now I was thinking it was a customs thing bc the US power supply that they included was outside of the box.
Their return policy says there's a restocking fee for any returned non-defective item that is open, so I gave them a call to inform them that the seal was already broken. The CSR told me that it shouldn't have been broken, even though it was an imported international item. So I was gonna get hit with the 10 or 15% (or whatever it was) restocking fee.
I called BS on them, so now its under investigation.
Bottom line is you deal with expansys, you do, unfortunately, take a risk.
They should exchange or refund your nexus. Even if it might be samsung's fault, it's still within expansys' 2 week window for exchange/return.
I'be bought two from Expansys (yakju) and they've been perfect (GSM). They do have a return/exchange policy. If you return, they charge a restocking fee.
Have you called them to talk it over or are you just complaining on the internet? Call, be firm but polite (i.e. don't pounce on them when they answer, demanding an exchange).
I found the tread about the hairline crack ,but it looks like Samsung has not admitted that this is a manufacturer defect so the retailers dont want to exchange the phone under manufacturer's warranty, and you are hit with,(IT IS A DAMAGE CAUSED BY THE CUSTOMER) even though is clear that so many people can not have caused the exact same damage to their phones

I remember why I don't spend money with these people. Some of the worst customer service I've ever encountered. Call back and firmly force them to return it, refund your money, and choose another place that actually values your purchase.
The best way to show a company who is boss is to vote with your wallet.
I called back Expanxys USA, first the exchange department is a voice mail you can not talk to anybody there , then customer service told me that they can not do anything about my problem, that it has to be trough the exchange department email, ok i sent then another email.
After that i called Samsung and they told me that my phone was not registered and it would take 48 hrs to registered,ounce this is done i am going to send my phone to Samsung,the guy in the phone told me that if this problem is a customer damage it is not covered under warranty.
Now i am going to go with all that process, i let you know how they rule, if the problem is a manufacturer problem or not

forgot to tell you. the expansys returns/exchange department NEVER answers. I left 3 different messages from them, but no return calls. I suggest if you do need to contact them, email is the best way. Although it takes a rather long time for them to reply, they've replied to all of my emails so far.

i bought my Note and my Nexus through Global Mobiles (fulfilled by Amazon) and the service was fantastic.
ended up having a problem with the Note and sending it back, no restocking fee, no problems.

Also, tell Expansys that if they do not refund your money you will dispute the charges. Retailers are penalized and can even lose their ability to accept credit cards if they have too many chargebacks

I went to Best Buy and was told that they don't sell the Nexus without a plan. Fine.
I went to the local Rogers store and they wouldn't have stock for a week. Fine.
I check out kijiji.ca. I found a BNIB Gnex in Northbay. I drove through a raging snowstorm to buy it that night for $600.
Cool! I got a Nexus!
Months go by. Fast forward to this afternoon.
'Hi, I'm constable blah from the Northbay Police Dept. Do you own a Google Nexus?'. I'm thinking to myself, 'oh no, this can't be good...'
I have to turn in my phone by Monday afternoon. AND I'm out the $600. AND I got no phone.
Moral of my sad story, always buy from the store. Not some guy on ebay or kijiji.
What lesson have I learnt. Be patient and buy from a store. Don't be in such a hurry.

You payed in honest your hard earned money for a phone you had no idea was stolen so from a moral standpoint I think thats fine.
So now what? Phone gets returned and now that $600 was basically stolen from YOU. Fair right?
You could have just said you bought it but then sold it. Done.
And just because you got ripped off doesn't mean everyone on Kijiji or ebay is bad. I buy and sell all the time through kijiji. Just be smarter about it in the future. Find out where it came from, see the proof of purchase, things like this.

Sucks, one of the reasons I didn't buy from Kijiji. Sudbury eh? I went to high school, college and uni there.
The forums really should be split I'm tired of Verizon users thinking everybody is in the US, not everybody on xda is get over it

Damn that sucks. It is things like that, that make me hesitant on buying things from craigslist/Kijiji and why I always keep my receipt/OEM box in case I do ever decide to sell an expensive device so I can prove to the buyer that they are legit.
There's no way to get your money back? You'd think you'd have a legit claim there, considering there was all sorts of fraud/misrepresentation.
Normally, you would be the bona fide purchaser. If you paid a reasonable price for the item and the item is considered a common good, which it is, you will win in the court of law. HOWEVER, sites like the one you got it from is considered "caveat emptor", meaning buyer beware. Because it is common knowledge that illegal goods may be sold on such websites as that and Craigslist, you are in fact agreeing to that knowledge when purchasing something.
Unless Bell decides to be nice, HA!, they have rightful ownership of the device. The only recourse you have is to sue the seller for fraudulent activities. Good luck with that one.
P.S.
For anyone who would like to know, not ALL items have to be returned in this case. For example, cash cannot be returned if it was used to purchase a consumable. Also, something like lumber or bricks that were used to build your house cannot be returned.

It's a simple contracts case w/ fraud, misrepresentation, etc., but since he's from Canada I'd be hesitant to really weigh in with what I think.

I am tired of the high and mighty attitude that some GSM users have. So I agree, lets split them. Not everyone is GSM, so get over it.
You could probably file a small claims case for around $75 as an infrequent claimant.

The police obviously traced the IMEI of the phone since it was in use. How else did they know who to call? They called because they knew you had the phone and were using it
That really sucks man and I can honestly say I know how you feel.
I bought 6 Verizon BlackBerry 8830 phones a few years ago to resell them and before I bought them I called Verizon to make sure the ESNs were clear and I was told that they were.
I buy the phones, sell them on eBay, and after a month the seller says the ESNs are bad. I get the phones back after refunding the buyer $1200 (I bought them for $800 I believe) and then I get a call from Verizon saying the phones I had were stolen and then they had the cops call me asking if I had the phones and that I had to turn them in. I told them I bought them from someone else and tried to give a description of the guy and the car he drove but I met him 70 miles from my house.
It really, really sucked. Sorry that you had to go through that, it's a big downer when it happens.

Thank you for being an honest person. If you ever have some kind of donation option to fund your new phone, I'll be the first to pitch in.
Good people shouldn't get screwed over by scammers (I almost was on a completely defective "mint condition" HTC Sensation), but lying will only set you up for some other problem down the road.

Sorry to hear that OP, you seem like a good person that got screwed over by some dirtbag . Any chance you paid by PayPal? They tend to side with buyers. Something tells me you paid cash though

No, but he said in his original post that he was on Bell and his phone was a stolen Rogers phone - aka 'not Verizon'. That's zeke's mistake for not reading the post. Still, everyone else in the world uses GSM, so yes, Verizon's got a smaller market and the CDMA Nexus isn't going to be that common in comparison.
Still, lesson learned. Pity the OP can't turn in the seller and maybe get some money back.
I know this is probably a long shot, but from what I've read Asurion doesn't follow the phone, it follows the SIM. I spoke with a lady from Asurion, but she was no help at all, so I spoke with someone at T-Mobile and he wasn't any help either. They both basically stated that they weren't sure and would need to get back to me about it. That was almost a week ago and I still haven't heard back from either company, great customer service, isn't it?
If the insurance won't cover the phone I don't want to be paying the $7.99/mo for it and not be able to use it if the time comes.
PS: I do assume the answer is no, but it's worth asking I suppose.
Try starting a claim online and see how far it goes. Or call and ask someone at asurion.

the answer is no..i have checked, double checked, tripled checked...
i originally asked a tmo chat rep..he said yes, i didnt believe him so i wanted to double check...i asked another rep and he said no...then i called asurion directly and they said no
asurion is the company that handles most of the major US carriers...being that the galaxy nexus (GSM) is not supported by any of our carriers its easy to see that the answer would be no

i just sold my SG2 today..gonna call tmobile to cancel my phone insurance now that im using the galaxy nexus
according to their pamphlets they only cover phones sold by tmobile. I have found securranty to be a cheaper but reliable provider of smart phone insurance.
