Cant they track it?
You could sell it, but that's kinda morally objectionable.
Plus it will be flagged as having a bad ESN, so it won't be able to be activated on Sprint.

Yea But cant you still use it??
the point is you can do what you want but sprint is not going to let it be put on a line. The ESN has been blacklisted so if you want to use it as a music player or whatever you want that does not use phone service or data then yes but as a phone No.
I will buy it for forty dollars!

Once you lose a phone, Sprint places it on a lost/stolen list. If you sell it, the purchaser will not be able to activate it.
Sell on ebay and state has bad esn
I think if you only went through asurion the phone might still work. I had a phone that was lost and I did it through the website and i gave the phone to someone else when i found it and they told me that it activated. So maybe have a friend try and see if it works.

Ill Buy it for $50 dollars, no questions ask!! I want to start into development roms, and ill be good for me!!!
Why even ask a question like that? Once you accepted the condition to file the claim then the phone belongs to the insurance company. The only sense to this question is that you want to know if you will be in any kind trouble.

i thought the same thing too when i lost my phone in the movie theatre after it fell out of my pocket. I filed a claim and got the replacment then i was able to find my lost phone shortly after. i checked the ESN and it was still clean. i was surprised but now i have two evos. You can always call them and check if its still a valid esn.
Because I don't want to cause anyone any undo trouble. I would like to get my deductible back so I will say bad esn on eBay for $100 as another forum member sugested. Thank you for all input into this discussion.

You certainly can activate it still.
I lost my TP2 and got a new one thru insurance and then Sprint called me and told me someone turned in my lost tp2.
I reactivated my original the second I got home. I sold the new TP2. I called Sprint and they told me I was supposed to send the lost one to the insurance but it was up to me. They didn't really care.
Moral wrong..yes... doable .. yes.
if you call ausrion and get a replacement phone they send you another one out but by law or sprint policy (not sure which its to early for me to google it a few sprint employees have told me though) they cant contact sprint and flag it as bad ESN your suppose to do that yourself. So you can activate the old one if you like with 0 issues. Been their and have done it. (on accident found the missing phone like a week or 2 later) sold it to a friend and he is still using it.
There are methods to make a phone work on another carrier if it has a bad ESN on Sprint. Cricket and Metro PCS are the carriers that are most commonly used in the US. I actually bought an Evo on Craigslist a while back for a good price. It wasn't listed as lost/stolen, but it was still tied to a suspended Sprint account. I later sold it on eBay for $360 and listed it with a bad ESN and a bad headphone jack. I think the guy I sold it to was planning on using it in Mexico.
Even without activation, an Evo makes a pretty nice MID on Wifi. Just be warned that most Android devices won't connect to an ad-hoc Wifi network, so it's hard to tether it to another phone.
You could sell it for more than $100. Can't you hack it to work with VZW PRL? Maybe that'll sell for more.
Technically you could sell it to someone on metro pcs or cricket.. they dont care about esn's being blacklisted they'll activate it anyway.

Oh God the moral police is here. Its a very valid question. I would do the same damn thing this Guy is doing. Just think of it as a way to recover that 10 dollars extra a month we are ALL getting hosed for every month.
Sent on my cursed EVO
The "moral" thing to do is call the insurance company, explain that you found your old phone and you would like to return the phone and get your deductible returned as well.
I would think they would go for it as they make out in the end.
And you can sleep at night knowing they won't catch on to you some day and deactivate your phone. (highly doubt that could ever happen, but I tend to have a really guilty conscience. what's a $100 anyway.....)
since virgin uses sprints tower would it be possible to use the evo on virgin because im think about buy a used one from a friend and i dont want to sign a 2 year deal
Nope would not work. If you really want a evo and your friend will sell you his then you would not need to sign a two year contract. The two is only required for people who buy a new phone or upgrade there phone and do not wish to pay retail price

the thing is that sprint doesn't a have plan where some one can buy a phone at full price and use it on a month to month deal or do they and i just cant find in on there webpage like with Verizon i bought a droid when they first came out but paid full price but used it mouth to mouth does sprint have somethink like that
Try going to a Sprint Corporate store and asking.
PROTIP: Bestbuy is not Sprint Corporate.
The Evo on metropcs works great for me for the $40 a month price, though you'll have to get the esn added through houdini in a non-official manner so to speak. Search craigslist and there'll be a ton of adds of people who can add the evo to the metropcs network.
so in other words, yes it's possible as the cdma radio hardware is the same,
however some people who are not lawyers think it's illegal to change the ESN
even though you're not stealing any service.
Protip: Sprint bought Virgin last week. They already had 51% share and decided to purchase.
Virgin does not allow flashed phones on their network (sprint). Now you can flash evo to verizon, cricket and metropc and other verizon based providers. Cricket is nice because for 55 you get android plan with everything unlimited and it runs on network that evo was designed for.
Nothing is impossible in our world.
Anyone out there dedicated and financially capable of trying? lol

You'd be wrong if you sincerely believed this.
Works with $25/month plan perfectly...

You had the Virgin Mobile Intercept though, not the Sprint one, right? It doesn't matter that they're technically the same network. They use different databases to check ESN numbers. You'd have to buy an Android phone from them (get the Optimus V, it's cheaper and better than the Intercept) and spoof the ESN of the Evo to match the other phone's. Make sure only one is turned on at a time though or the ESN will be banned, and since they'll have the same ESN neither will work!
Is it illegal? No. You're not scamming anyone. You'd still be paying the same amount of money. Plus, you own the original phone with the ESN you'd be copying, so it's not illegal.
I'm using HTC Evo on Cricket now, and next couple weeks I'll try to make it work on Virgin base on what I did to transfer from Sprint to cricket. Just change the prl ,ip .........I'll see
Google it and I found the prl from the thread called : How to flash a phone to virgin
Good luck everybody .
I think I know what thread you are talking about, does data work on the phone as well as voice?
I've heard of people getting talk and text working but not data, so far with the evo.
Hello, So I have an intercept already and just bought an EVO, how do you spoof the esn of the evo? I really need your help guys! Thanks.
I got the email, but I've never done it.

You can find out what the data settings are on howareforums, in a thread called How To: Flash a phone to virgin mobile, but they won't tell you how to change an esn.
Some people thinks it's illegal to change esn # so we aren't allowed to tell how it's done on most forums.
If you look around online and youtube you can find out.
If you end up getting it working let us know.
I have a evo right now can i call sprint and tell them my evo broke and get a new one for 100 bucks (I HAVE INSURENCE) i just want one for my bro mine dident break!!
Well they will ask u to return the one u have
And if you say it was lost or stolen, they will deactive the ESN and it won't work. Your bro needs to pony up the money and buy an Evo if he wants one.
What if i say somebody stole it and than after i get it say i found it

They still won't reactivate it. Also, I'm pretty sure it is illegal.
___

not only will they not reactivate it but they will probably charge you for the one they shipped out. tell your brother to get a job or say find something else. sprint insurance is not through sprint its a 3rd party provider and they do well. they will not send one out with out receiving the broken one or disabling your current one. and no you can not change the esn mainly because sprint still has to have it in there system first
http://en.wikipedia.org/wiki/Insurance_fraud
Don't do it.

Here is what happens when you report it broken
Sprint will require the "broken" unit back
If you manage to convince them to send out a new one on the premise that you'll send the broken one back, you will get billed full retail on your next bill if you don't return it
Here is what happens if you report it lost/stolen
The ESN (Electronic Serial Number) will be permanently disabled on Sprint's network.
Your "lost" EVO can never be activated again, I know this is redundant to above comment but I can't stress this enough. You will have bought an EVO brick for $100
This is to protect legitimate cases of stolen/lost phones from fraudulent use/charges on their bill.
Most importantly
THIS IS INSURANCE FRAUD. SUBJECT TO CRIMINAL AND CIVIL LITIGATION IF FOUND
Sprint has all of their basis covered when it comes to people trying to scam their system. Simply put, you will NOT be able to accomplish what you are looking for.
I will probably pull some trolls or hate from this post, but I swear every word is genuine.
I purchased an EVO from a nice fellow that just got it from Best Buy last Saturday. Everything went well, Sprint said the ESN was clear to activate on my line after I purchased. After we parted ways, and I had my new EVO I decided to turn the beast on and have some fun. Bad idea, it immediately activated on his mother's line.
Now, 5 days later, I have a phone that has some poor old lady's number on it. A seller that returns "I'm working on it" to every text, and I am out 300 dollars.
My question, possibly illegal or not welcome here, is there a way to fake an esn in order to use this phone I paid for? I really don't know where to turn, I don't know if this guy will take the 5 minutes to call sprint to sort it all out.

There is a way to do it, but it'd have to be one from another Sprint smartphone. Look, if you paid for a seemingly legitimate phone from a sleazy guy, I would talk to Sprint about the situation. If they budge (they'll probably say it's not their problem), I would threaten the guy with the cops. He is essentially holding your phone hostage and you paid for it, therefore you own it. Don't be afraid to actually file a complaint with the police if he doesn't do anything. Don't try and hack your way to a working phone. It'll only make your case weaker and probably won't result in a happy ending.
PS: Try getting your story published on Consumerist.com. Companies read that blog a lot and offer to help to protect their image.
EDIT: Probably stolen. Get the cops on him, but don't warn him.
Unless your related to this nice fellow, than that phone was probably stolen from that nice old lady and your out $300.

if sprint told you it was a clear esn, then why didny you have them associated the imei and esn to your account before you got off the phone with them? that way when you turned it on it would activate to you account and not the old lady's
If that nice old guys story is true, why not use the phone w/ this old ladies number and force them to foot the bill? If it activated on their line, you aren't liable to pay right? That would get him to fix the problem really quick. OR, at least that old lady can call sprint and ask why there is another $100 or so on her bill and complain...then at least sprint will now try to fix the issue.
So what if it's activated on another line? Call sprint (or even easier, use the site) to activate it on your own.
Your title says "can't activate on my number" but you haven't explained why, so I'm assuming you haven't tried.
You can't activate it if it's already activated on someone else's line. It's probably a stolen phone that hasn't been reported stolen.
Thanks guys. I called the number and it went straight to VM. I believe if its not taken care of in the next few days I'll contact the police. I mean I have his number, and a few other details. I'll first see if sprint can help.

In that case Sprint shouldn't have said it's a clean ESN, because clean means it's not activated on another line. Sucks...

Well it was clean until i turned it on, then the phone activated on another line. ;(
The phone may be stolen, but slightly more possible is that the phone was purchased using an upgrade on the old ladies line. When you turned it on, it went through hands free activation like it should.
What you should have done was setup activation on ur line before turning it on. Then it would have done its hands free activation on your line.
What you'll need to do now is call Sprint and get on the line with real tech support, not just the person who answers, make sure you ask for next level tech support. Have them do a full factory reset, it will also reset ur profile, and you should be good to go. It may take an hour on the phone with Sprint, but it should work fine. I have had to do this several times whenever activating a phone on a line that it was not originally intended for. Hope it works for you.
Hey... I think this thing makes phone calls too!
My friend got a new evo 3d and just flat out let me have his old evo 4g
the ONLY thing wrong with it he said was it had a bad esn
First can someone tell me what this means because I can't find accurate information about this and also could I sell a phone with a bad esn?
Sent from my SPH-D710 using XDA App
It means the account the phone was on is not in good standing with Sprint. You can sell it y o somebody who is going to flash to Cricket or some company like that. Make sure you disclose the Bad ESN to the buyer.
Sent from my PC36100 using xda premium
Yep, Sprint has flagged it either because of lack of payment on the account, or leaving without paying an etf. The ONLY was to remove the esn block is to have the original owner settle the debt with Sprint. Otherwise you can use it as a media player/web browser on wifi only.
After a few months, you can actually get the ESN put back in good standing if it is bad due to payment reasons. You may have to pay someone a few bucks to get it done, but it is legal and cheaper than paying off the bill.
Otherwise, you have a toy, or you can sell it to someone else who wants to swap carriers, fix it, or do other things with it.
If the ESN is flagged as stolen though, there are fewer options, but you can still get some money out of it if nothing else.
