Question about legality of upgrading to a rom - Upgrading, Modifying and Unlocking

Hi All.
I have a qtek 9090 for a while bought in belgium from a mobile shop 6 months ago. it's running w2003se
I'm wondering if it's legal to flash it to a newer official rom from this site. Since that rom probably has a license from it's creator which might mean "if you didn't buy the device from us, you can't install our rom".
If the above is legal, the other question, is it legal to upgrade to a wm 5.0 based rom?

all the officialy released roms are free for users for the devices it support
the wm5 beta leaked roms from htc are technily not all that legal i guess but i doubt you'll be seing agents banging on your chamber door and crying nevermore!
but HTC create all the roms for the devices they make and nobody i know off have moved a rom to another device then the one it was made for

I think the programmers learn more from sites like this than from any development test platform so they are happy to let it happen.

Hi,
I am sorry if this has been covered in old posts but i am getting no where with o2 and the other UK operators.
I am due an upgrade with o2 now but i want to wait until XDAs have WM6 on them, Does anyone know what the first XDA will be released with WM6? When it will be released? Or will it ever be released? as O2 do not have a clue.
If any of the other network operators are bringing out there versions with WM6 the same questions apply as i will just move phone operators.
Any help would be greatly appreciated
i thought windows mobile 6 wasnt coming out till november? i might be wrong as i havent been on top of wm lately (im a symbian guy myself)

I know Orange are releasing the SPV E650 in April. However it runs WM6 Standard and not professional (i.e. its a smartphone not a Pocket PC).
Would guess Pocket PC's should follow soon after but there are still quite a few WM5 based devices scheduled for a release.
Would say the best bet would be to hold on but if your iching to upgrade (i know i would be) then I would suggest getting a Hermes based device. I would say that it's one of the best HTC devices currently available and people are cooking WM6 ROMs on it already!!! Its also rumoured to be one of the few devices that will eventually have an official WM6 update.

The official HTC forum in Norway has confirmed that HTC will release an WM6 update for TyTn.

Cingular announced this a few weeks ago. Actually they confirmed WM6 for the 8525, blackjack AND treo 750. No release dates though, but engadget reported that the Blackjack update is probably going to be released the earliest.

Its true that TyTn gone have an official WM6. But I’m not sure that they can delivery it in June or July because TyTn Europe couldn’t jet delivery a new Swedish MW5 Rom witch been known since months on xda-developers forum it was suppose to delivery in January 07. so I satisfying so long with current WM6 such as Black, LVSW etc.

I believe that the heroes here (we all are) investigated so much in this stuff that I will make this statement: HTC learn from XDA or you lose!!! Probably they've read all our treads and learnd from it.
Question: What do you think concerning this matter?
I think Cingular/HTC waits for the developers here to solve all the problems then they just copy and release what was done here Saves them time and money developing their own stuff. lol

Its true though... even if an offical release becomes available for my Vario II, I'm not totally sure that I would upgrade giving tha I'm so happy with my LVSW WM6 install
i have the same sentiments... the roms here are almost "made to order" with features that majority of us agree on. I really can't imagine upgrading to an official "operator" or "manufacturer" rom unless there's a big boo boo in the one's i've installed from here (which there have been none I might add).

I presonally prefer official ROMs over these user-made. WM6 roms I've tried do have more or less annoying bugs and unusefull software (xcept maybe for vanillas).
Original roms are (or at least should be) guaranteed to work on phones they have been made for.

Yes, advanced users here provide very much, but not that many actually developes the OS itself. They just add tweaks
and some freeware programs in it.
Oh and believe me, there are more gurus out there as well. This is just a forum with few experts and I doubt they
do this for a living, more like a hobby.

When you buy a new computer that comes with an OS, you can't assume that you are entitled for a free upgrade
to OS when ever one is released.
I find the best thing this forum has to offer is free problem solving when it comes to bricking your device when
you either don't have a clue what you are doing or then something goes wrong while flashing your phone.
Hats off for the expert for that.

It is quite different thing for several reasons:
1. You can't go and buy an OS for a PocketPC or smartphone. Moreover, there is no and can't be a market for OSes for such devices: any build is device dependent. Show me that shop, and I'll buy Symbian or Linux for my TyTN!
2. When you buy a motherboard, you expect free BIOS update, especially if the original is buggy. For embedded devices (STB, modem, router, MP3 player etc) you do expect free firmware update, especially if the original one is buggy. No matter that the firmware is based on a Linux or even no OS. Windows Mobile is just a part of the firmware for our devices.
And, because Windows Mobile is always buggy, we do expect free updates!
Yes, you get free updates for BIOS as you do get for your phone. They are called ROM updates, which include fixes for radio, bootloader, OS fixes and stuff, but NOT a new OS.
As I see it, when a new OS has been released, it will be sold as a part of a new phone (OEM). As you can't purchase OEM versions you are stuck with the one you currently own, but you still do get free updates.
I would find it quite strange if you would be supported with brand new OS for no additional cost, since I believe the operators/manufacturers sure has to pay license fees for
new OS's.

Don't be so restricted, look wider!
Manufacturers get money from selling their devices. If they won't update the OS on just released models (and TyTN is far from EOL), they loose sales. Then they can give the same ROM to us, old owners, for no cost for them.
Then, they just announced new models on almost the same hardware. They have to use the new OS on them, so they have to make the new ROM for them. But if they won't update our ROMs with the new OS, they'd have to continue supporting two different lines of ROMs, instead of one with small very specific changes. It's additional cost. Or, drop support for recent devices, means loose their face and then sales of new devices.
Believe me, it's not free, and not for no cost from us. We paid enough to let them support us until EOL, and they earn enough from such upgrades.
Just like owners of other devices paid for all the firmware updates, we paid for our updates. The early we purchased the more we paid, BTW. An update with the new OS for recent devices for HTC is cheaper than no updates or updates with old OS. Even if the update would be less stable/useful than WM5 AKU3.5!

If Microsoft provides the upgrade to the OEM for free (which it looks like they are doing for WM6) and the OEM provides the upgrade to current owners for free (which it looks like they will do when they eventually do it), then it is not piracy.
Keep in mind that Microsoft really makes its money on its core products (currently Vista, Office 2007 and Exchange 2007). They REALLY want users (especially enterprise users) to upgrade to those new products. If you have a Windows Mobile device, you need WM6 on those devices to take full advantage of the new features in the core products, so why wouldn't they give it away? It will pay for itself twice or three times over. Besides, as other users have pointed out, WM6 is really just a bug fix maintenance release for WM5.0!

Does WM6 is a real or a fancy!! get in to know

Every one of us, is full aware, that since imate & HTC products being put in the market; we used to download posted upgrades from time to time from the sites of manufacturer.
for examples, the JasJam (or what called hermes), since it was placed in market (about a year ago or more) we haven’t received any claim from imate that an available WM6 is available at their site !! right?! While if we get back in our memory three years ago (to the age of Magician – imate jam ) all magician users knew that a lot of upgrades were posted authentically on imateclub.com
So why this is happen? Why imate or any other manufactures try to hide the authenticated WM6 versions from being posted on their sites?
does that because all posted WM6 as well as TNT, Shape's…etc are all FAKE!! Or in other words COOKED!!, does that means that it is very probable to get incompatibe technical errors for using the above WM6 versions???
For me, I have been using TNT SE WM6 for three months; and no notifications or mistakes reported ….. especially that I'm one of Pocket PCs for 5 years ago!!
So the point is: does our discussion point (which is the stoppage of these manufacturer from posting UPGRADES for users) is that might be as a marketing trick from imate, HTC….whatever!! I mean, that all of us knew how users were longing to use WM6 on their PDA's but at the same time not satisfied to change the set !!! right?
In other words, to do change in SOFTWARE not HARDWARE !! right?
So is it possible that imate or HTC ….etc and other manufacturer of PDA's ((with originally built in Windows Mobile 6)) were afraid from sales fall?
Because posting an authenticated WM6 for PDA's with originally WM5 could affect the users -to an extent- from purchasing the new one (which is originally WM6) ….. does any one thought that way??

i m confident they would release any requested update if customers would massive ask for them, but if you think of it, it s not like EVERYONE who bought an htc device knows about software updates and such
I think you make a valid point, but who really cares. I would guess that most of the users on this forum who are using cooked roms have tried the official manufactures release, and were less than satisfied.
In many cases, after 1 or 2 generations of OS upgrades, hardware advances and continual price declines make a new phone more appealing to a user than an OS upgrade to a potentially underpowered device.

New Official ROM HTC Diamond

Hello to everyone you know if HTC roadmap has a new version of ROM for the Diamond. I have installed the latest available, but I saw that for the new PDA HTC has released new features. You believe that will be available in a new official ROM? Thanks Tony
I got a feeling that HTC gave up on Diamond cause they have Diamond 2 which replace Diamond.

HTC will probably never release any official updates of Manila for the Diamond (or any other existing phones). Cause if they do, people won't by their new phones

On topic: Compared to other HTC devices and other manufacturers in general our dear Diamond received quit a lot of updates. 1.37,1.93,1.97,2.00,2.03,2.07,2.09 and now 2.10. Now think about your average SonyEricsson, Samsung,<place your manufacturer here> mobile phone.
This answare sended to me when asking for WM 6.5 to my Diamond:

I only see 2.03 available officially in HTC.

Typical O2 UK - Jellybean ETA

I read that jellybean was rumoured to be released to other network providers by the end of this week so..
I decided to check with an "o2 Guru" if they could tell me when Jellybean will be rolled out to the O2 branded HoX
As expected they could not answer my query - see below for the chat
