I just ordered my phone from HTC's site. I was quite surprised to see I got charged tax on my order.
According to US law, they can only charge tax in states where they physically have a presence. In looking at their e-commerce partner, DR Globaltech, they only have physical locations in CA, WA, MN, and PA.
Given that I live in Maryland, how can they charge me tax? It's not like I bought it thru the carrier our anything like that.
Anyone else experience this?

I'm not sure how it works.. Because as far as im aware, they shouldn't be charging any taxes. But I had the same thing when i ordered my moto last year.

This doesn't answer the original question, but technically, the issue is whether they can force the company to collect sales tax, not whether they can impose it. Paying sales tax is the obligation of the purchaser of the product not the seller. If a company has a physical presence in the state, the state has jurisdiction over the company and can require them to collect the tax and pay it on behalf of the purchaser. If there is no presence, the state can't force them to collect the tax, but the company can do so voluntarily. Even if they don't, the purchaser still is obligated to pay the tax and the state can charge you with tax evasion if you don't and collect the tax plus interest and penalties. This is why, from time to time, states have sued out of state companies to get their records of sales into the state. In many states, you are expressly required to include on your income tax return the value of any internet purchases made in the year on which you didn't pay sales tax and pay it then. If you don't, they can go after you for failing to report as well as failure to pay the tax.

I did an online chat raising the same issue with them and they simply said they are required to charge tax. I agree that something is fishy though. I live in Pa. and I don't think HTC has any presence in Pa. that would obligate them to collect tax.

Mine was only 34, but I agree, of course I'd rather not pay for it.
It is because HTC isn't shipping the phone, they use a 3rd party company for their supplier. Can't recall the name of it off the top of my head. But if "they" have a storefront in your state, then you get taxed.

I mentioned the supplier and where their locations were in the country. Since they have an office in Pittsburgh, it makes sense tax is charged in PA.
It's one thing if they have to collect it legally. Otherwise, they just may be pocketing it.

This has been mentioned already but It's because they're internet orders and just like Amazon they're required to collect the tax for 45 states.
It has nothing to do with storefronts or brick and mortar retail operations (traditional Nexus).

In Florida, I have never paid taxes for internet orders on Amazon -- There have been a few special scenarios however. So I'm not surprised.
Looks like this is a gray area. Only 4 states require taxes on sales bound for other states where they have no physical presence. DR and HTC don't appear to be in any of them.
While not required, more sites are collecting taxes than before. Amazon was noted as an exception for not doing it.
Of course I'm screwed since Amazon set shop in Baltimore up.

amazon does not collect tax on all purchases and the only reason they tax me sometimes now is because they put a distribution center here a few years ago.
ive also ordered from ebay and other online retailers that have not collected taxes on my purchases.

Yeah I get that about Amazon, I was super tired and not communicating well and tried to edit my post but wasn't very clear.
As for other vendors, just because they don't charge doesn't mean they shouldn't charge.
What I'm trying to say is HTC is carrying the burden of tax compliance for customers.
If a person want's to see if they're charging tax inappropriately; someone from Oregon, Montana or the other 3 states that don't have sales tax would need to check if they were charged tax on their orders. Because of the burden of compliance HTC is carrying, they're doing everyone a favor by removing the burden of tax compliance from the consumer for the 45 states that do have sales tax.
As previously stated by others if you live in a state with sales or use tax, as a consumer you're required to account for any appropriate tax if not charged by the vendor ie: consumer carry the burden of tax compliance.

If they are pocketing it then it is illegal. If any company collects a tax they must hand it over to the state.

Who knows if you'll have to pay customs fees... I paid the extra $50 ($764) to go with a US reseller but they're being sketchy at the moment... See my post (Negri Electronics is being sketchy).
I'd say go US but maybe not Negri.. I'm sure everything is fine but still... You could pay more than you think with credit card international fees and customs fees depending on the shipping company they use.

International pricing is pretty firm. The UK prices aren't going to be effected by whatever happens in the rest of the world. A lot of folks in the UK and EU buy their phones outright so demand is what drives pricing. The SGS2 stayed pretty firm for about four months and then started to drop a bit. It's still over $500 having been out since May. If you're importing, don't look for bargains and sales because they don't exist (through legitimate resellers). I've bought from both Clove and Handtec and was pleased with both.

Though I must say, it shipped with DHL and the packaging was kinda sketchy for a $700 dollar electronic device. It was in a plastic DHL bag and the box the phone came in was just wrapped in fine-bubble bubble wrap. No damage and it works fine, but still kinda irked me when I saw it.

I ordered two GNs from clove which arrived today. No import duties. I have a thread in this forum showing the current policy regarding importing cellphones to the US (with documentation from the corresponding government agencies).
As for the packaging, I too am a little disappointed that they only used bubble wrap and a dhl bag. The corners of the boxes where slightly damaged; however, the phone itself was fine.
I preordered mine from Handtec and the experience was awesome. I ended up paying around $700 total and somehow the phone got to me within one day!!! It was awesome to see that tracking from Fedex on the day it was shipped telling me it would be at my doorstep by the very next day before 10:30am... now that's fast, especially coming from Europe!

I decided to email Popular electronics about the Galaxy Nexus and it seems like they're willing to bargain about the tax. Chicago has ridiculous tax at 9.75% so the phone would have been $767.15. With a simple email, they were willing to do $710 flat. I'm sure when a little more persuasion, I could get them to $700 or throw in a free case. Just a heads up to all the Chicagoans. Probably pick this up this weekend.

That does seem odd that they have a cash only policy. Really weird for an electronics store. Maybe they have a no receipt policy too.
But back on topic, I just bought my nexus from clove last night. Order is processing and now it's just a waiting game!

When paying with cash, it's always considered under the table. They probably don't file their taxes legally so it helps them when people pay in cash. Good for both parties. They're a small electronics store, nothing huge but they do carry the latest phones.
Not sure about the receipt policy, probably isn't one but as long as it's brand new, I'll be happy.

You forget about the third party. The government and all society that utilizes tax money. (Including yourself)
Taxes are there for a reason and should not be avoided by dodgy business practices.
I would check the phone out in-store to reduce your risk of having to return the device since you may not be able to.

Tell that to Apple, Google, Facebook, Microsoft, IBM, Oracle and so on. They all dodge taxes. What they're doing it is legal but it's effects you also. It always seems like when a little business does it, they should be shunned by their practice. The way they're doing it is probably illegal but it's still dodging taxes.

Don't assume that paying with cash is always considered under the table.
Another reason for the cash policy is that is removes the credit card processing fees for the transaction. Depending on their processor, it should be around $0.25 + 2% of the transaction amount. So on a $700 transaction, that is roughly $14.25.
(American Express' fees are around 3.5%, so the cost on that transaction is around $25).
If you are a retailer, that extra credit card fee hurts quite a bit. Think about that the next time you buy a pack of gum with your credit card.

That being said, in this instance their's a good chance that this is under the table. I would much rather buy the phone on my Amex and get the additional warranty they provide. Also, why not just import it from clove for $670 rather than paying $700 cash? Makes no sense to me.

Just a quick one - I'm going to Germany on the 6th, think it's worth holding out on pre-ordering and seeing if they're in stock anywhere at Gatwick... think I'll save that much?

its not even necessarily the case that Dixons will have it in stock on the 6th in an airport shop. i'd definitely phone ahead before getting your hopes up
anywhere in the EU there's no more duty free
unless you go to Turkey or Middle East or something...sometimes prices @ airports are more expensive than retail stores downtown

Even in places where duty free still exists, the prices are normally higher than the with-duty price elsewhere. They prey on the gullible. About the only thing you save on is cigs and sometimes booze.

Because of this event, I am very very afraid of the same event happening again. If anyone from Canada or specifically Vancouver have ordered anything from overseas like in Hong Kong, please share your experiences with your purchase. Thank you.

They always use the postal service and they always claim a lower amount to avoid duty or tax. In some instances you will need to pay ~$5 for brokerage fee and whatever the duty when customs deem you need to pay
If they use other carrier like UPS, FEDEX etc., they will charge ~$50 just for brokerage fee even when you buy a $10 item

The website says they'll use "First class Airmail," what's the charge on this then? So there's the brokerage fee AND then the duties on top? Thx again.
that has actually never happened to me before. you shouldn't be charged extra if you buy from Mugen and since its airmail there won't be any hidden fees.
From my experience, postal service charges $5 on brokerage fee. However, they don't charge that fee on all shipments. It is like depends on your luck. And that applies to customs duty too. But for item declared/insured under $40, there is definitely NO fee and duty.

I was charged about $90 duty for the Note but I seldom have to pay any duties for any smaller items. Don't quote the $90 it is my guesstimate from what I remember but it was close to that.

Although I haven't bought from them personally, I know that Negri is a reputable seller that has been around for some time.
Isn't it cheaper to get the phone form T-Mo directly though?
Yes they are a reputable dealer, and yes direct from T-mobile is cheaper by $20-30.
I bought the original Note from them back in the days when it was first released.

That is actually incorrect. The fee is based on many different variables, all of which are covered in the store policies.
You may be referencing a return of a new release. In that case if you order a product at $800, and return it unused after 7 days, your restock fee is based on the current site price, time out of our possession and condition of exterior packaging and accessories within the box. If the price of the device happens to be $600, your restock fee would be close to 25%.
Restocking Fees are not used to generate profit for our business. We use restocking fees to recover costs incurred during shipping and receiving of returned items, as well as price changes that may have occured while the device was out of our possession and unable to be sold.
We are very transparent in everything we do. If there is an issue please contact us so that we can explain in greater detail. Please do not mislead XDA readers. When posting your issue, please provide further detail so that others may make a educated decision as to where to purchase their next device.

I guess its again US/UK only, because HTC never introduced any type of deal for the rest of the world.
I saw that they opened it up to orders from their site as well, starting yesterday 8/2. I bought mine last week, so I submitted my info anyway, we'll see if I get anything. It'd be nice to pick up a couple extra quick chargers!

well, I guess this doens't apply to us who bought straight from htc huh? unlocked on whichever carrier we went with...and apparently within that time frame of july 12-31

HTC's site is very vague on this. Right on their homepage, it says $100 off the phone AND $100 off accessories. The "and" isn't ambiguous, in my opinion. But on another page on their site, it says "or $100 off accessories if you bought elsewhere".
Has anybody contacted HTC to get clarification on this?

Perhaps you need some refresher courses in English. The wording is clear about the offer in question. It states that if you buy the device on htc.com, you get $100 off the price of the device as well as $100 towards accessories. It also states that if you bought the device elsewhere, like from a carrier, you only qualify for the $100 accessories promo.

Perhaps htc needs help with English because many people are saying they couldn't get both.
To me it said, in the fine print, I can get both but must activate on t-mobile, sprint or Verizon. Since I'm going at&t I guess not me, huh?
Maybe I should activate on my current Verizon plan first then before switching?

So, you need to:
Buy the device from the 3 US providers outlined above OR any authorized reseller (HTC.com purchases in US seems to be sold by Digital River)
Activate it on the 3 US providers (I assume by installing the SIM card on T-Mo or activating for Spring and VZW)
Submit the form before Sep 18
So I wonder.. How long do I need to be on Verizon to qualify? Certainly interesting if it's an easy $100 but I'd much prefer to be switched over to AT&T sooner than later so maybe I shouldn't mess around..

Early adopters always get shafted. That's what happens. When has a product not decreased in price six months after release?
You can buy a new Nexus 6P for $400 now. Did the people who spent $500+ get shafted?
And I doubt anybody is going to pay $199 for those headphones. Unless the reviews end up being amazing.
Early Adopters are not "shafted".
You got to use a beautiful and fast phone for 3+ months before any of the later adopters got to. You can be a "late adopter" as well and watch while everyone else gets the latest and greatest. Its a small price to pay to be "ahead" of the game.

I agree. I held out till the end of July just to get it cheaper. Sucked waiting but in the end I got it for 50$ US with a two year contract upgrade. I will be never purchasing an LG flagship ever again. HTC has never disappointed me.
