The law has NOTHING TO DO WITH ROOT. It is about (mainly) carrier unlocking GSM devices to except any SIM and cloning or adding device ESNs to other carriers databases for CDMA, although cloning has technically always been illegal due to poor wording in the original law. It was only intended to be illegal to clone a device to hijack service not to clone your own donor to use on another carrier. However the new law cleared that up as now its illegal to move any locked device from one carrier to another without carrier permission, even if you buy the phone at full retail and aren't on contract.

By gaining, I meant as in net worth and which company is richer and more popular XD for Apple having I phones and their versions of tablets, they make a lot of sales.. But android all together is winning imo

Everyone roots their phone. I haven't met anyone with an android phone that doesn't have their phone rooted.

I'm all for making it legal to jail break... But wouldn't this drive up the price of smart phones quite a bit? The reason phones like the galaxy s3 are so cheap is because sprint has us locked into contracts that LEGALLY we can only use our device for... Key word, legally.
Sprint would likely charge full price regardless of contract renewal?

Jailbreaking and rooting should not be confused with unlocking. The first two (jailbreak and root) are both legal, while unlocking was made illegal only recently
Unlocking is using your phone on a carrier that it was not activated for
Jailbreaking and rooting essentially give you access to everything on your phone - the equivalent of being an administrator on your computer

Yup, I think that rooting was made illegal for tablets only in the last round of DCMA exceptions...all because the Library of Congress felt that the lawyers' definition for tablet did not encompass everything that tablets were and so was not appropriate

I think that this Judge has no idea what she is doing, I wonder what product she uses.
Almost all her rulings have been over turned by appeals courts and she has always sided in the case of Apple.

Basically Apple is using pictures of Steve Jobs in evidence photos (him holding the iPad when it was unveiled in 2010, etc.), presumably to win sympathy from the jury since he's dead and all that jazz. Samsung said, "those pictures have nothing to do with the evidence!" Judge Hoe...I mean Koh said, "Yes they do, feel free to use them Apple." So Samsung said, "Fine you can use them, but if you're going to let them use those pictures of Jobs, you have to let us quote what Jobs said about going thermonuclear on Android [from his autobiography]." The Judge said no. So basically, she keeps siding with Apple on everything, and it's effing ridiculous. She's either a fangirl herself, or she's getting paid off by Apple behind the scenes.
So wait, because Steve Jobs said that he would spend his dying breath to destroy Android because it infringes his patents, that means that it's evidence against Apple? If anything it shows that Apple truly believes that they did infringe on their patents...
And their using photos of Steve Jobs to display the product, not just random photos of Steve for sympathy.

What Apple is doing is ridiculous. Its the same as saying no one else can manufacturer a 52" 16:9 device with a screen that displays moving pictures a (TV) I hope some judge rules that they not only lose these ridiculous cases but have to pay damages, court costs and the legal fees of everyone they attempted to sue.

Unlocking of GSM phones illegal???

If you did not know it, US Congress has enacted a law that would make unlocking a cell phone to use on another carrier illegal by the end of this month. If you disagree with this please sign this petition. This mostly affects customers that travel abroad and unlock to save money and not pay huge fees for using the phone in other countries. Question on my end...wouldn't this pertain to mostly GSM users? I do not think a Verizon phone can be used elsewhere.

If you bought an unlocked phone (e.g. Play Store), then it doesn't matter. What matters is if you bought a phone from a carrier - this is where the unlocking issue comes into play. Unlocking the device to use in another carrier network is now illegal unless you get permission of the carrier from which you purchased the phone.

I couldn't care less about his colour, he just rants on about what he can change but does nothing, anyway i can freely unlock any locked phone through my carriers website using its imei number an its 100% legal an free of charge as I did when I first unlocked my gnex which was locked to Vodafone on contract the day I got it.

Pff, the amount of resources needed to first find out IF someone has unlocked their phone is exorbitantly high and not something that can be done "on the fly".
Also, as far as I know there is no way to tell if a mobile phone is currently using a different network than it was supposed to.
But then again, i'm not living in the US and don't know about the specifics of network locks there, I just know that unless it's a feature phone from a carrier (at least concerning germany) then they are not locked to a specific network anymore.
Unlocked bootloaders however are a different question (like the Motorola Razr which was supposed to be unlockable in Europe, but wasn't).
I doubt anything comes of it but if it did, they'd go after those enabling others to unlock phones.
Similarly, the EPA just went after several aftermarket diesel engine tuning companies that were selling products that bypassed emission requirements. The EPA went after several companies and small time product distributors, made them pay fines, and buy back devices sold to consumers.
Legislators should much rather go after Apple, since they dropped out of a recycling alliance.
That should be a mandatory requirement if you want to manufacture electronic devices.
Also, Apple shot themselves in their knees with that move, since now no government institution is allowed to buy Apple hardware anymore, since whatever they use has to be recycleable by the manufacturer (at least that's the way in germany).

please go read what the actual law states. this only applies to phones that are still under contract/subsidy. if your 2 year contract has expired you can unlock any phone.

Actually, yes it will.
Carriers are not gonna go after the users (such as myself) but will definitely go after commercial unlockers, like the store I have bought 5 phones from and flashed 6 phones with. I buy the phones unsubsidized, so im ok, but with a possible $500,000 fine and prison time...I dont think my store will continue doing this.
Going to call them tomorrow and see what they say...
Edit: read the docket...im glad I got my note 2 flashed before it went into effect.

I get the ruling, but don't fully agree with the logic used. It centered around the cellphone service providers recouping the subsidy costs the give consumers. I just don't get why they needed it overall, especially for the general consumer, since the contracts state if you leave the carrier, you pay a fee; assuming you don't find a loophole to exploit. If that that fee isn't enough, raise it. As far as I know, there is nothing to say it can't be higher based on the phone purchase. Just has to go down over time. My thinking, make it cost the same as buying the phone unlocked.
At the same time, I wouldn't say Sprint makes phone friendly to switch carriers, compared to others who do not have build in SIM cards.
Personally, it's not going to stop me or that many people. I don't believe most people who unlock do it to change carriers. They're more interested in rooting for the ability to use custom firmware on the same carrier or use other applications.
That said, I can understand where people might be one these phones and try to go with something like Metro. I never looked into the long term costs, so I'm not sure how much money is really saved. The wore part is the ability to see the phone to offset the cost of upgrading to newer model because it limits the buyers to only those who want that same carrier. This may drive the prices even lower.
Without more numbers, I just think this more carriers being scared rather than working with each other so consumers are happy and they can make more money by increase the number of users.

Replacement phone T-Mobile? Refurbished?

My friend is on contract on T-Mobile he got the note 2 a month ago and he told ordered two replacement refurbished note 2's then he's done with T-Mobile he ain't sending it back or nothing just done paying it and keeping the phones. I told him he can get into trouble for that he can right?? Or does it just mess up his credit? He did it three years ago and nothing happened besides probably bad credit now.
I know a lot of people on Craigslist be getting new phones without battery and back piece and I once bought one and it wouldn't read my Sim card because he never paid it I'm guessing.
The phone will black listed, side note I exchange phones a bunch due to defects or little things Tmobile is becoming much more strict about what they will exchange abs are now charging $5-$20 to process exchanges I wouldn't be surprised if a bill is coming his way soon

They may bill for a full cost of a replacement phone. I used to work for a t-mobile dealer LONG time ago (9 years ago) and they did the same thing. If we had a customer walk in, we process an exchange on their behalf. But we tell them if they don't send original phone back, they will be getting a large bill. And few people did. T-Mobile does work with them, and will take the charges out if you return the phone.
The phones will be blacklisted. If he sells them the new owner is screwed. Maybe he is Ok with that. If he is, find another friend as this guy proved himself to be a slime ball.

You ever see "bad esn" in an ebay auction description for a cell phone...that is what your buddy's phones will have. They can pretty much can be used as a wifi mini tablet, unless he is able to flash the phone to another gsm carrier. Regardless goes against his credit also.
Not true T-Mobile uses sim cards you can do what ever except. For warranty. I know a bit about this subject but the problem with things like this is once people start talking in a public forum than can screw everybody.

Again, not true. The phone WILL be blacklisted and won't work in the country unless you take it overseas maybe. How do I know? I deal with craigslist people and ebay listings for a meager living.
Phones will be blacklisted with Tmobile, Simple mobile and AT&T he will also be billed $600 for not returning the defective phone. The phones they send him will be factory refurbished which means it's just the phone there will be no battery, battery cover, Spen or charger.

My opinion: Galaxy S2 > iPhone 5.
The iPhone was made for the simplistic user. 85% of users on this forum are the opposite.
Apple is giving Samsung free publicity. By the time this goes to trial, the S5 will be out and the suit will be pointless. Samsung will have already made all the money there is to be had on the S4.
Apple should just buy Microsoft. Maybe between 2 dead companies, they can re-invent themselves and re-enter the race.

Apple is giving Samsung free publicity. By the time this goes to trial, the S5 will be out and the suit will be pointless. Samsung will have already made all the money there is to be had on the S4.
Apple should just buy Microsoft. Maybe between 2 dead companies, they can re-invent themselves and re-enter the race.

Seems more intelligent than the stupid suits they have been blowing their money on. At least if they buy Microsoft, two negatives might make a positive.
Before you know it... Apple will be suing every cell phone comapny claiming it was the 1st to make a cell phone, then sue every company making music players because they did that first too. LOL. And this is why I have never, and will never support Apple. In the past month I've converted 3 iPhone users to getting the GS4!! #TeamAndroid #AppleSucks

If Apple bought Microsoft I think Android would be gone. Microsoft own a lot the essential patents Android need to operate. In the hands of Apple, Android is doomed.

There are anti trust laws to prevent that. Apple and Microsoft could never fully merge the anti trust boards wouldn't allow it, so no need to go all "the sky is falling". The worst that could possibly happen would be licensing patents to each other or partnering on a project, but with their competitive history the only way that would happen is if Apple offered BIG money which they would never do cuz they are too greedy.
