A series of unfortunate events blah - Sprint Samsung Galaxy S III

so thought i would just share this little story with you guys. my weekend started like always work till 8pm Friday and coffee home to my gf and new born ugh... lol... try to play some mw3 if the baby isn't awake... Saturday get off at 3pm, but wait the girl that is supposed to come in and work the rest of the shift can't make it, n boss wants me to stay until close ( i work at cricket wireless btw ugh) i ***** and complain until they let me leave at 5pm oktoberfest was going on at Aberdeen proving ground (army base near where i live) I'm like babe, before i get home find a baby sitter and we are going out for the night and get trashed lol... so baby sitter was found, my brother wanted to go so we picked him up... and come to realize there's a shot crap load of kids running around everywhere at oktoberfest :-\ oh well, I'll still get my drink on we are drinking, having fun, dancing on the dance floor to a live band (which was playing some pretty good 90s music btw ) fireworks go off like a huge show and it was pretty cool, i end up falling to the ground trying to take a picture with my gf lol, feeling pretty good... finally we are ready to call it a night... we walk to the car, me and my brother are pretty messed up at this point, my girl had only 2 maybe 3 beers in a 5 hour span, so of course she was driving... we get to the car, everyone hops in, we turn the key on just to start the radio up, do we could clean my car up a little lol, then it off no where, cops pretty much surround us :-\ my girl passes her sobriety test, but blew a 1.78 ugh... we hadn't even started the car and the arrested her for dui, f$_#?+/ police! she gets out 2 hours later, bawling her eyes out she calls her mom (on my brand new Samsung galaxy s III ) i don't think nothing of it, I'm like she's just upset she can talk to her mom and then we will figure crap out... she runs over to the baby sitters house to get the kids, I'm chillin on the couch, drunk as hell lol... brother is already out cold, she comes in work the kids and baby sitter and says please don't hate me? I'm like why what happened... she pulls my phone from her pocket.......... the battery is out, the back is off, and the first thing i notice milliseconds after she pulls it out ( i work in the cell phone industry) the battery sticker shows water damage, was red as the devil :-[ I'm was like NO YOU GOT TO BE KIDDING ME!!!!!!!! she shakes her head and i ask WHAT DID YOU DO, HOW DID YOU GET IT WET!!! she dropped it in the mother [email protected]&#*%° toilet!! i am so mad right now!!! i say it in rice all night, works fine, except camera is screwed, has water in the lens and it fc's constantly ugh.... worst weekend ever!!!!!!! then i was hung over all day Sunday ugh... should have an insurance replacement in a few days but that's $150 :-\ plus her dui... which I'm fighting of course, cuz the dumb cos never read her, her rights lmao... got any worse stories? love to see if they stack up against this one

As long as she was behind the wheel then they can get u for dui. Also it's her word against their word on whether her rights were read to her. Who do u think they are gonna believe? The cops or someone being arrested for dui?

On topic, the cops can't charge you with a DUI unless you're behind the wheel AND the key is in the ignition (regardless if the car is started or not).

Ive did alot of contract work up on aberdeen proving ground. Ive got to say bro you were askig for it by lettin her get behind that wheel. Those MPs up there do not mess around at all. Only thing worst then a state trooper is a MP. They use to pull me over twice a week for random searches. Me and my girl go downtown baltimore to power plant alot and i always take light rail down then pay a cab ahead of time to get us around 1230.....1. id rather have both my phones all my tablets dropped in a toilet vs my gf getin a dwi. After lawyers, insurance and the MVA get done with you your probally looking at over 10 grand

Not to ruin your weekend but they only have to read you the rights if they plan on questioning you. If they don't, or if they don't use your statements against you then they don't need to read your rights. Hey an attorney though, .0178 is over double the limit in most states and carries jail time.

First thing, getting drunk, in general is lame. Getting totally tore up and then deciding to get in a car is stupid. ESPECIALLY at a military base.

not to add insult to injury but these are words of wisdom... getting plastered usually leads to some sort of event or series of events that like wat u described make ur life hell... avoid it in the future by limiting ur consumption... u don't remember much past the drunk stage so why make memories u can't remember?

well the police said its a federal court matter, not a state court matter which is better because federal court is less harsh. we had a ride, basically we turned on the battery to listen to the radio until our ride got there.

But anyways the worst part was probably her DUI, which I am looking up on the net to see what exactly constitutes as a DUI (Driving under the influence) the key word is driving, her door (the driver door) was still open and eveything, and we were smoking a cigarette, listening to the radio. I did read up on some controversy over the field sobriety test be admissible in court, plus you have to fail or do poorly on the fst for them to have probable cause to give you a breathilizer, which they made her take one, they didn't give her the option to refuse it, Or I woulda told her to refuse the breathalizer. So I def think I will get a lawyer cuz the few cases I read where the dui suspect got off and the charges were dropped, were very similar to what happened that night :/

One, they don't GIVE you an option to refuse the breathalyzer. You have to verbally refuse to submit on your own volition (same goes for allowing the cops to search your car. You have the right to refuse the search, but they don't TELL you such).
Two, I've already told you... It doesn't matter that the car door was open or that she wasn't "driving" the car. As long as the key is in the ignition (even if the car isn't started), you can and will be charged with a DUI.
Back in college, a fellow fraternity brother of mine was charged with a DUI. He'd gotten drunk at a bar and had gone to his car to sleep off the alcohol. It was very cold outside (early December), he turned on his car for heat and got in the backseat to sleep. The cops found him and charged him with DUI because of this.
It doesn't matter that he wasn't "driving" at the time. Operating or potentially operating (having the key in the ignition) of the vehicle are both under the umbrella of driving. Arguing semantics or technicalities won't help in your girlfriend's case, unfortunately.
There should be a mandatory spelling/grammar test to pass in order to have an XDA account.

I thought that only occurred in the circumstance that the subject failed the field sobriety test beforehand.

Something seems off about that. Who's to say that cops won't pull over random people and issue DUI's to people who refuse the breathalyzer? Even if they hadn't been drinking at all?

For the people that our lives have been taken over by the addiction of flashing roms, kernels, and fine tweaking our phones on a daily basis. Have you payed less attention to loved ones in your life? Gotten in trouble? "Put that damn phone down for one freakin second!!"
As much as I get yelled at, I still can't put it down! I always get into a lot of trouble, girlfriend being suspicious of texting activities, etc... All i'm doing is playing some robo defense and fruit ninja!
How's everyone else holding up? lol. Do you consider the evo as the best or worst thing that's happened?

I had a G1 before EVO and that was my first wild phone. I wouldn't say it is the best thing but it is a vital thing in my life. It is sadly also a horrible object that promotes ADD and addiction.
I wouldn't go without it!
I think I would consider it a great enhancement to my personal life.... I have been sorta in the dog house cause of it, but this is the best dog house I ever been in....

My fiance comes first, at least to me, but she will beg to differ. Her most famous quote is, "your always on that GOD DAMN PHONE!" I dont think I am. Only when I'm checking Facebook, the forum, engadget, flashing, backups, theming, looking for cool apps, playing angry birds, and what ever else I do on the phone. So I don't see how she don't think I put her first. At least I sleep with her at night and not the phone, even though the phone does have its own spot on the bed next to me.

This is awesome, sounds like me and my house. It is definitely an addiction. After HTC 8525, HTC Tilt, all 3 iPhones, HTC Hero, HD2, HTC Desire a couple of others in between and now the EVO. All I hear now is "You and your phones"
There's been many of nights setting at my desk clicking refresh and reading every updated post waiting on the next best thing while she is her thing and still trying to talk to me and I aint hearing a dam thing.
I have thought many times about just getting rid of a smart phone and going back to just having a phone. But I just can't do it. I am ate up with this ****!

I've been a flash-a-holic since my touch pro. windows mobile sucked many hours of my life away. i spent hours modding kitchens, creating provxmls, and creating my own roms.
now... i just wait for a fresh rom update, flash, and done. ahhhh... love android. definately don't tweak it as often as i used to in WM days.... no need to... everything is rock solid with my setup in my sig...
Ill just say my phone lays closer to me in the bed than she does.

The phone always turns on for me.
The phone never complains I touch it to much.
The phone will always do what I say.
If I don't like something on the phone, I can change it.
If the phone gets broken or scratched up, I got insurance.
When a newer model comes out it wont get mad if i touch it a bit.
and last but certainly not least:

Reason im asking is i met a guy today to check out a white s3 and he was straight up in his craigslist ad and said it had a bad esn. He bought it off CL and got burned. He was asking $300. The reason im considering it is bc my daughter has a galaxy player 4.0 and wants a 5.0. There $220 new. A girl in her summer camp mother offered her $160 for it plus she has $100 left from her bday. Do you think its worth it if i sell her galaxy player and giver $40 more bucks for the s3? I have a blue my gf has a white one and shes always playin on my gfs phone wants one bad lol

Just when i was tryin to post it in this general the xda app kept closing so i closed the app and reopened it then posted in the sprint general not knowing the original threas posted. I make 80K a year I DONT NEED TO STEAL ****! Others were tellin me to do illegal stuff and i made it clear i just wanted it for wifi only. And if dude wouldnt of sold it id a bought it but since my daughter got her hopes up i got her one anyway!!!

State of Md licensed and cerified fire protection installer. Look on HUDs website what were making in the dc md va area which has almost twice as much new commercial construction as any other part of the country. And oh yea me and the guys that work for me curse each other out about 30 times a day. Dont have to sit behind a desk to make good money. So like i said i dont need yo steal a god damn thing.

Fire sprinkler systems. 2nd highest paid construction trade next to elevators. We come out of apprentiship school makin $30 hr. Thats just an apprentice makin that.....and as far as fhe fire stoppers go we sub contract that out pay them per whole. I wouldnt be surprised if they make close to 80k in a busy year

Well, i am screwed!
I picked up an S3 from CL today, called sprint from there and confirmed that ESN is clean. came home and begun the activation process only to learn that although the ESN is clean, the phone is locked to the other account. suffice to say the phone has been wiped and no information on it to connect to previous owner. i did the ##786# to retrieve the phone number, called the owner and said i have your phone, only to learn that the phone was stolen. i asked DO YOU WANT IT? upon their response i said, i live about 1 hr away, would you be willing to compensate me for my travel, thats when it got nasty. the lady started to threaten me by telling me she will sue, and that she will report me to the police as if i was the one who stole the phone. long story short, i drove to sprint only to find that they have nothing to do with lost/ stolen phone, they directed me to the police.
as of right now, i wasted an entire day just figuring stuff out, spent 10$ in tolls + 10$ in gas money to get the phone + one day of no work ( As a Business Analyst for Gov contractor you can imagine is a lot of money) and tonight driving to the police station to turn myself and the 'stolen' phone in!
Like i said, I AM SCREWED!!!
Point the police to the person you got it from. That's about all you can do. Get a report number from the police if you can. That way when the owner won't stop harassing you since they probably have your number, give her the report number.

as of right now, i wasted an entire day just figuring stuff out, spent 10$ in tolls + 10$ in gas money to get the phone + one day of no work ( As a Business Analyst for Gov contractor you can imagine is a lot of money) and tonight driving to the police station to turn myself and the 'stolen' phone in!

That's lame that she was so hostile, you should have reminded her that you weren't informed it was stolen and you could easily just smash it on the ground if she preferred. Dunno why people have to be so nasty when it looks you did all the right things. Hope it all works out man.
Thats the idea! im heading there right now ( well in a few minutes) and return the stolen goods, so i no longer am found in possession of them, then will call/txt her say, you want your phone? u drive there and u get your phone!

She threaten to turn this into a major investigation, and although she did not have anything on me, i did not want to associate myself with such uneducated woman. on top of all i want to apply for clearance, and i dont know how this may come to bite me in the a$$, considering i have spotless record thus far.

Has anyone tried the Bluetooth watches that read ur emails and texts messages.?

Were not allowed to have our phones on us...but a Bluetooth watch is good as long as is stay 33 feet from my phone.

I dunno... 33 feet is kinda limiting... I'm not allowed my phone during work either and 33 feet isn't even enough to get outta my office and into the hallway lol, I could never see myself spending the money on something so trite, however; for others I can see how the application dictates it would be a worthwhile investment, sounds kewl to me nonetheless!

This is just my opinion and not my suggestion. I'm a little anti authority kind of person. That being said, regardless if I had the watch or not, I would keep my phone in my pocket but with all sounds turned off and probably vibrate turned off too. If it vibrated when you were near someone, and they heard it, they might tell on you. I would not keep my phone in a locker because it could be stolen. I will not leave it at home obviously. I will not leave it in the car because of the extreme heat and possibility of theft. I would only check my phone if I was in a locked bathroom or stall or in my car. I wouldn't risk it anywhere else that there were people around. If I did get caught and given the choice of the phone or the job, I'd not back down. I would say that I would need it on me in case of a local or personal or family emergency. A job is probably saying that because a few people would blatently screw around or talk on their phones and not work. That doesn't mean you run to the bathroom every five minutes to check your phone or hold a text conversation with someone either.

In many cases, like mine, it's nothing to do with productivity, we are not allowed phones on site, period. Or radios. Or USB sticks. Or...
I have worked without access to my mobile for the last 16 years and never missed anything important, we have proper phones at work if there is an emergency...
I would think anyone willing to risk their job for the sake of having a phone in their pocket should maybe reassess their priorities a little, especially in the current econmomic climate.

MY STORY -------
I was robbed on craigslist, NYC MIDTOWN?
To sum it up:
I was robbed by a con artist on craigslist pretending to buy my phone.
I sold many things on craigslist in the past, high end and small end. Whatever..
I posted an ad to sell my Samsung galaxt s3 tmobile phone for $540, and the buyer called with 1 number and ask if Its available and that his wife saw the ad and hes buying it for her. Then he asks me if I’m a business and I said no. Then he said he will call me back and I said ok.
He called again in a few minutes and said hes interested and asked my location and he will be coming so I said ok , I gave him location, on park avenue and 58th street at TD BANK. When he got there he was driving was in his car so I got him to show him the phone.
He asked nicely if I can just go with him to tmobile store around the area to make sure the phone is not stolen so I said okay sure. Its 2-3 blocks away. We was driving and he was telling me this whole store how he and his daughter went to check out a phone and after he bought it the phone turns out to be stolen and it took him a week to return it back to the seller and such and he thanked me for going with him to the store.
Finally, we parked RIGHT in front of the tmobile store by a fire hydrant. He asked if I can watch his car while he goes in to make sure its legit and to activate his simcard for the phone so I said ok pls make it quick. He went in for a few minutes and I was wondering what if this car is stolen ? or he ran away ? anyways so I took a peak and saw him on the line and speaking to the representative so I thought okay its cool. He came out and said something is not working and if I could go and talk to her, so I can ok.
I was in the passenger seat , now the keys are in the car. He ask if I can turn off the car so I turn it off and I took the keys with me when he said he needs to get something real quick and go in first, I went in for less than a minute. LESS THAN A MINUTE OR 1 MINUTE!!! Then I turned around and POOF!
HE IS GONE…. HE IS GONE!! I got scammed and wow, I was shocked and laughing.. I tried running up the block but his car is nowhere to be found!
I called the cops and gave a report, waiting for a call back from the detectives hopefully.
I have received a call back from 1 of his numbers he called me with , and it was lady claiming she don’t know what happen. I have a feeling she is linked to him, I don’t know.
What should I do now ? What can I do ? I want to catch this sucker!
His appearance:

Skin: Dark / Tone
Nationality: Hispanic Hair: Curly hair Attire:
He was dressed in a white button up with dress dark khankis or dress pants and shoes
. ( his attire indeed let my guard down )

Ok here's how this went. I was selling a samsung galaxy s III (for about $500) on craigslist. I live in queens, NYC, so I arranged for the exchange in midtown manhattan. I drove there with my bro and parked my car in a parking lot. The guy who i was selling to, arrived in a family van with his 2 year old daughter. He wanted me to drive down the street to the "Fossil" store where his "wife" worked at as she was "the one he was buying the phone for". Seeing his daughter, his demeanor, as well as the fact that we were in a heavily populated area, I thought nothing of it. He seemed like a reasonable person.
We get to the fossil store, he asks me if I can go to the driver's seat as he goes into the store to speak to his "wife" in case cops request for the car to be moved. At this point, his 2 yr old daughter and I are in the car alone. He asks me if I can give him the phone so that his wife can test it out. I say fine as I have his car and his kid is in the car. He comes back later and says he's having a problem testing out the phone. He asks me If I can check it out. I say no problem, I step out of the car, turn off the car and hold the keys with me (the keys also included 4 other keys). All of a sudden, he disappears literally into thin air. I take a few steps to look around. This is 7th ave manhattan, so there's alot of people walking up and down. I then turn around, and boom...car is gone. All happened within 1 minute. Literally, 1 Minute. I literally started laughing in amazement.
I am not one to get scammed..very rarely have i been in a fraud situation. I've seen everything...but This.
How could a guy use an innocent little kid to scam people? Is this a new Craigslist scam? I am being reimbursed for the phone by my credit card company as they cover theft. What do you take of this?

Yes.
I know it might look confusing and have typos and such but I am so heated and still cant believe I was conned like that. Its just shocking!
I went to the precinct on my lunch break to give the cops more details and that other post I found a day earlier of my incident indicating the same pattern of crime.
Its the same guy!!

this is a reason why I never sell phones on Craiglist, I always sell them on Ebay is more secured and no way for you to get scammed, I have seen a couple of friends that actually sold their phones and got fake $100.00 dollar bills, with Ebay you get backed up by paypal.
Sounds like some next level ninja sh!t, I hope by some strain of luck you get your S3 back.

What caught me was maybe the office attire, the area and the fact i had his keys...
It was pretty good scam.....
I have up to date, sold over 500 phones just on craigs...
Sucks... Lesson Learned, gotta be alert... Luckily he didnt have a gun to my head..

if a customer on ebay, insists to their credit card that they did not purchase the item. I think they can get away with it just as easy like how this happened to me, however this guy took a lot of time to develop his scheme..

That's why PayPal has certified mailing addresses tied to the account. It's a way to track someone down...

lol... wow... I've sold tons of phones on cl. Never this happened to me. But then again I live in Virginia, where its legal to open carry a gun. And anytime I have a item for sale and someone wants to buy it, when we meet up they always notice that I'm not one to scam or rob.

There is a lot of companies that will give you a free ride if you have been drinking. And some will tow your car for free. So there is no reason to get a DUI or possibly lose your life or take someone else's. Its bound to happen to a lot of people over the next week just make sure it isn't you or a loved one. My dad just finished his year of dealing with the consequences of his second DUI and it was a year from hell for him and my mother.
So beyond being worried about accidents, remember that even if you think you are or even if you are good to drive, a DUI is no joke.

My family's pretty smart not to.. At least I think.. Might be stubborn.. Uncle drank himself into a coma or got himself put into one, guess a blood alcohol level off the charts will do that to you. another uncle was emotional depressed drinking and another off the charts amount in his system, decided to be a dumb ass and ride his crotch rocket on the freeway at night when he couldn't even stand correctly, a few week coma there and lived after massive brain swelling and just so much blah. Think my family gets the picture not to be stupid with alcohol XD but everyone don't be irresponsible and put your family in such a situation...
A grown man or woman shouldn't have to be watched over like a child from the fear they will do something dumb.

Just a single year from hell? ****, I wish... my 2nd one was 3 years of hell, and I'm still not done. (this coming month I'm finally off Probation/Supervision and everything, and I can get a speeding ticket without having to worry about the consequences of this **** coming back to haunt me.)
I couldn't drive for nearly 2.5 years, overall the 2 DUI's have cost me at the very least $35,000, that includes lawyer costs, court visits, missing work, classes, treatment, blah blah blah... Trust me this **** isn't worth it. The loss of your license alone is just awful. Try living by yourself, out in the middle of a corn field and somehow getting to work every day without being able to drive for 2 years. My friends hated me for that. Haha.
One thing that I'll offer as a helpful tip to those who undoubtedly end up in a situation where you need to get home, and your car is the only way... Sign up for AAA if it's available in your State/area. It's only $90 a year or something, and they give a certain amount of tows a year within I think like 100 miles of your location to wherever you want... Just tell them it broke down and to tow it to your house. The guy towing it won't care, he gets paid the same.
Trust me, it's cheaper than a normal Tow and fractions of a penny compared to what it could cost you if things go bad, and priceless compared to the lives you save, including your own.

Yes its definitely not worth it.. I have 2 from when I was in the Army.. over 2000 dollars in fees.. 5 years probation.. 30 days in jail. Must have a breathalyzer to start my car for the next 5 years to keep my license. Thats 80 dollars a month.. expensive sr-22 insurance. 2 years of alcohol treatment classes and AA meetings. Random piss test where they test for alcohol.. the list goes on.. and trust me I had it pretty easy.. I didnt have to pay for the classes because I took it at the VA hospital.. but the class is about 4 to 5 grand..
I definitely learned my lesson.. I dont even drive anymore. . My girl drives me everywhere. . I might drive once or twice a month when she cant take me for some reason..
Dont drink and drive its not worth it at all..

I stay home for New Years because its just safer that way
If you gotta drink and drive, move to Sun City Center, FL and buy a damn golf cart. You can't do too much damage with one of those and in Sun City Center golf carts are the norm for driving. Hell theres no way a drunk could be anymore dangerous than the 90year old demented folks in a golf cart. Where I live a little south of Sun City Center we have cabs that if you blow over a .08 on their breathalyzer will take you home and in the morning pick you up and take you back to your car for free.
