There is a recent legal precedent that could put the FBI in some hot water with this: the supreme court ruled that GPS tracking without a warrant (including the FBI) is a violation of privacy because even though tailing a car is legal it requires the active involvement of law enforcement whereas a GPS tracker does not.
Similarly, the fact that this software is installed without the consent or knowledge of the user (like the GPS tracking units) means that this tracking data is collected without warrant, or the knowledge and consent of the user. That in and of itself is a violation of consumer privacy but the fact that it's then used by the government against citizens is akin to someone illegally putting a wire tap on your phone and then the government using that in a case against you. That's not legal.
For those who say "oh privacy it's dead three government can do whatever they want nowadays" do some research: the government isn't doing anything now it hasn't done in the past and the truth is you have a lot more privacy and protections than pretty much any time in the past.

My only gripe with all this is that Carrier IQ takes up memory and uses additional battery life. Just one more reason to root and use a custom ROM I suppose.

Well my main point is not whether it is present now but more that it not be active and unable to log/track/send what i am doing. You can have scar traces but not an open wound.

lookout is a popular choice.
I think the people that use it use Lookout, but it's up in the air as to whether or not you actually need it.
Lookout caught a virus from a flashable zip I was downloading from a site I was unfamiliar with and the virus was legit.

They're a scam, they will only catch known viruses which you won't get unless you pirate apps...antivirus is a scam on the phone because google gets rid of things before anyone...it goes google then everyone else, no need for it if you odnt pirate or download apps like super sexy naked screaming Chinese and japanese school girls...
Lookout also backs up your contacts and has the features to locate/lock your phone remotely if its lost or stolen

Yeah, pirating apps is the best way to get a virus. I don't really bother with antivirus software on my phone. I just use Lookout for its location feature and I use Prey to lock down my phone if it's ever lost.

Google lets any app onto the market, its been addressed many times. They dont screen for anything... hence a thousand fart apps and of course, malicious software.

I can manually remove it myself or with free software. YOUR PHONE DOESN'T NEED VIRUS PROTECTION LOL. Those apps offer free STUPID services to you so they can trick you into paying their yearly subscription fees. Lookout really isn't free, or at least their only legit feature(remote locking) which cost 29.99 a year. If you think you need virus protection on your phone you need to switch to apple with the cool kids.

This is just one of many instances where software designed for a bad purpose has been a problem, especially with the Android os. Maybe there are no reasons to worry about an actual VIRUS, but the fact still remains that 3rd party apps can contain keyloggers and other means of stealing information from your phone.
Its not too far-fetched to believe in apps that, once installed, can lock you out of your phone or possibly even wipe all the data from it.
so does the TEP app from Sprint itself. It also helps you find your lost or stolen phone by pointing you in the general direction if your GPS is on. it can wipe your phone if you think it was stolen too

I thought their response was fair. HTC does have a built in error reporting function on its phones that you can decline to participate in. In addition, Carrier IQ is on many of their phones at the request of the carrier. So Sprint goes to HTC and says, we want you to install this on the EVO 3D, and they do it. It's up to Sprint to allow for an opt in or opt out feature. Right now, the only way to opt out is to not buy the phone, or void your warranty and root to remove it.

This is true, but the biggest question that is the most important, is why carrier IQ built an app that can track keystrokes, read txt, websites, email, passwords, record audio, and the end point is that you never know it. That is breaking 4 federal laws and just because a company asks to use it, it is still illegal for them to put it on the phones. The info that the carriers need to "fix" there crappy networks is easily collected from tower data not the phone. And the other BIG one is smart phones are still only 50% of the market so all those dumb phones out there never send this data since Carrier IQ is not on those, so why "monitor" just smartphones?????
So not only are the carriers at fault, Carrier IQ is at a bigger fault because they are actually installing it into the roms then giving it back to the carrier, and ALL the info collected goes straight to Carrier IQ first, then to the carriers.
The simple fact is, it is Carrier IQ's app, they install it, and they collect the data.
I wonder how secure CIQ servers are from hackers breaking in and accessing the information that comes from phones, or target certain phones to transmit its logs.

CIQ is Carrier IQ, which means that the Carrier you are on gets sent data from pretty much everything you do in order to 'better the device'. In recent months, some carriers such as Sprint and AT&T are taking measures to remove CIQ, but it isn't set in stone yet.
CIQ isn't a necessity to a phone, therefore it can be removed by developers of ROMs.
But no, to answer your question, it is not used to find a missing person.
Then Tmobile is wasting their money trying to do random location checks and all that. I heard that the iPhone had a system that tracked the places it would travel to for the police or any other law enforcement to confirm ask you whereabouts. I wonder if that will save anyone in court for a hearing.

Any phone with gps does this. when you dial emergency numbers they can find you in seconds. It has nothing to do with CIQ. If the authorities need to find you, they will.

I use Avast. I have it just in case the phone is lost or stolen but it does give me piece of mind when trying non market apps.

Avast for lost/stolen device tracking, allows device disable if the SIM is changed. Also allows you to lock, unlock, wipe, sound alarm by SMS. Hopefully I never need to use it.
From what i understand any perceived need for antivirus/malware scanning will disappear with 4.2 and the new Play Store.

For lost/stolen I've been loving SeekDroid for a while now. Very nice app and works with out fail any time I test it.

Btw antivirus = gimmick nothing else !
That's a good app I used to use it but it gets owned by cerberus. Try that it has way more features for a one time 3.99 fee. U can test free for a week.

+1 for seekdroid. Got it for free from Amazon a while ago but have found that its pretty good. Haven't had to 'test' it for real just yet but gives me a bit of piece of mind.
Reality is that if your phone is stolen, likelihood of getting it back is pretty slim. For me, real important part would be able to wipe my data to protect myself from anything more than losing a couple hundred bucks on a device.
None, I don't believe in them. If my phone gets lost or stolen then that's that, little can be done afterwards. Police often times wont help and knocking on the persons door and demanding the phone will get you nowhere except property trespassing. Even then, I doubt my offender would want to use any of my information stored on my phone. Any smart thief would know to wipe the phone clean to avoid any of these apps which don't do much. As far a viruses go, really? The only reason anti-virus apps where made was to satisfy the needs of the paranoid, lets leave it at that.
I was mainly speaking of anti theft app, and not to get the phone back, but yes to wipe everything!

cerebus. it's great. went to the washroom and left my phone in my meeting room. i come back and check my email and there's a photo of my co-worker trying to punch in the wrong PIN code. lol.
I dont have one installed right now, but when I do it's Lookout. I have had lookout stop installation for an app before, I was sideloading it. I dont keep one installed for normal use of the phone and Play Store, but if I was going to be sideloading apps again I would use it for that.

The law has NOTHING TO DO WITH ROOT. It is about (mainly) carrier unlocking GSM devices to except any SIM and cloning or adding device ESNs to other carriers databases for CDMA, although cloning has technically always been illegal due to poor wording in the original law. It was only intended to be illegal to clone a device to hijack service not to clone your own donor to use on another carrier. However the new law cleared that up as now its illegal to move any locked device from one carrier to another without carrier permission, even if you buy the phone at full retail and aren't on contract.

I'm all for making it legal to jail break... But wouldn't this drive up the price of smart phones quite a bit? The reason phones like the galaxy s3 are so cheap is because sprint has us locked into contracts that LEGALLY we can only use our device for... Key word, legally.
Sprint would likely charge full price regardless of contract renewal?

Jailbreaking and rooting should not be confused with unlocking. The first two (jailbreak and root) are both legal, while unlocking was made illegal only recently
Unlocking is using your phone on a carrier that it was not activated for
Jailbreaking and rooting essentially give you access to everything on your phone - the equivalent of being an administrator on your computer

Yup, I think that rooting was made illegal for tablets only in the last round of DCMA exceptions...all because the Library of Congress felt that the lawyers' definition for tablet did not encompass everything that tablets were and so was not appropriate
