So here is my story
I purchased an HTC touch pro 2 last year, i bought it before it hit the US markets so i paid a load of money for it. No problem, i love the phones, and i Paid like $700 for the Touch HD when it dropped in England but the lack of the keyboard ended with me selling it.
So i get this phone from a guy that says its direct from HTC its in an exclusive white box blah blah blah right.
Get the phone and all is well, new roms are dropping and i have WM 6.1 on my phone (weak!) so being that i have a MAC computer i cannot do anything to update the phone with out buying a load of software and putting XP on my computer (nope!).
So i go to the HTC website and the update is there and it asks for the serial number, well i put it in and it wont recognize it, hmmm. So long story intro short, i mail it to HTC for an upgrade and maybe check out the loose hinge on the tilting screen.
They receive my phone, and my phone sits on the shelf at the warehouse for 5 DAYS!!!
I call and every time i get the same story, "well mr miller we will escalate this so that it gets taken care of right away sir." I called 3 times and it was never touched. Finally on the 3rd time they tell me, well this is a sample phone, one we gave to employees before it hit the market, so there is no warranty, and we cannot upgrade it, and where did YOU get this phone. Ummm i paid for it, out in the open on Ebay, not out of the trunk of some guys car outside the pool hall.
Anyway they wont fix it, i have no warranty and thats that, ok fine whatever give my phone back, this was on Monday (April 5th) of this week. So the phone is to be sent back to me per HTC on Monday.
Call on Tuesday to get the tracking number so i can see when it will arrive because i am out a lot, and they say it is still in the warehouse.
I call back on Wednesday to get the tracking number so that i can see when it will arrive because i am out a lot, and they say it is STILL in the warehouse.
I call back on Thursday to get the tracking number so i can see when it will arrive...... etc etc.
The rep then tells me there are no notes in the system and it has not even been started for ship out.
But she is going to escalate it so that it gets sent out ASAP Mr. Miller.
Lord not this escalate crap again.

I call today Friday to get the tracking number, and its the supervisor i spoke with days ago that knows AAAAALL about my case.
Well Mr. Miller the phone is still sitting on the shelf in our warehouse/
WTF for a week+?!?!
It had been determined last WEEK that they were not going to repair it and were going to send it back.
So my phone has been held hostage by HTC and they wont send it back, no one will do anything to get me over to someone in the warehouse, they act as if its Area 57 or something and they dont have phones there.
So needless to say am very VERY disappointed in the treatment I have received and it is very likely that I will not purchase another HTC phone again after this nightmare.
Shame because i enjoy the phones, but i refuse to give my money to support a company that treats its clients in such a manner.

Perhaps you should purchase phones after they have hit common carriers instead of trying to blame your mistake on the company.
Sure, they could have sent your phone back to you a bit faster, but if you're unwise enough to purchase a phone off of eBay, you've got larger issues than your phone coming back to you. Besides, it was only there for a week? I've not had any such luck with HTC and having my personal cell held hostage. I guess it all goes back to buying a phone after it has hit the market...

So I started my first contract yesterday with phones4u and the plan is rubbish £37.00 a month with 600 minutes and unlimited texts and 750mb. I filled in a sheet known as are you happy and now they are using that against me to say I was happy with the purchase and their are no exchanges or returns. So I was thinking do any of you know a possible excuse that would give me a exchange or return. The only think I have came up with is to tell the head office of phones 4 u that the o2 signal is no good in my area and I want to return the phone or change carriers the phone is a htc one x white. I did ask phones 4 u for help on this problem but they said they have no power over the contract and only the head office so I will ring them up and ask them can they knock the price down but I would rather return the phone. I need a good reason to return it or exchange it any ideas would be greatful I have used the phone and sim but this doesn't make any difference because when I was returning it today it was sealed and they were not bothered. When I went to phones 4 u yesterday I told the women when she asked me about my budget that I do not want a contract higher than £36 but the sales women failed to acknowledge that and still offred me a crap plan. I was going for a better deal but orange declined my credit check but o2 didn't. The sales women told me that yesterday she told me that after I sign there are no returns but I can't remember.

Think ur stuck in that contract, it's down to yourself to read what your signing before you sign it.
As for saying you have no signal, they will probably check how frequently the phone has been used to make receive calls and texts to see if you really do have signal.
If you have been missold the contract though you may be able to get somewhere, but at the end of the day you would have been giving a chance to read the contract before signing away.

As far as I understand it (somebody will correct me if i'm wrong!), in this country you have a 14 day cooling off period after signing up for a phone contract were you can cancel it without having to give a reason.
I got exactly the same deal as you on t-mobile through buymobilephones.net for £26 p/month so that deal is very poor.
I suggest you ring phones4U and tell them you would like to cancel the contract and quote this '14 day cooling off period.'
14 day cooling off is only for online or phone sales not shop. When you approach the store and sign there isn't much you can do.

Yup you are stuck in the contract. I have only managed to get out of 1 contract but that was only because 3 killed the mast in my area and left me with no mobile signal for over 2 months. It took me another 4 months to get out of the contact ( and this was not easy ) but eventually after getting in touch with the comms regulation board they admitted that there was a loss of signal in my area (after they tested) and release me with a refund and no extra charges.
So if you do try to go down the route of no signal be warned they will test and check.

In what way did the contract trick you, as your thread title claims? You must have known what you were signing up to (and if you didn't, well...), and you apparently even told them you were happy with it.
Maybe you've changed your mind or seen a better deal and you're not happy now with paying £37/month, but that's a different matter.
Sorry if that sounds harsh, but there are far too many people who rush into long term commitments (of all sorts) and then scream "it's not fair" or "I didn't know".
Even tho phones for you say they have a no returns policy you can 14 day it! I 14 dayed a note this year as the vodfone signal in my area was shocking. Phones for you cancled it there and then. If they feed you with some **** and bull explain to them that if the signal is not serficiant in your area they cannot provide you with a full serive. This info came from someone that i no at carphone warehouse who used to work for p4u

1st mistake: you went to phones4u
2nd mistake: you signed a crap contract
sorry if it sounds a bit harsh, but if you knew it was a crap contract why did you sign it? But I do want to help as I know how you feel as I've had a bad experience with them before and knowing what they're like they more than likely pushed and pressured you into signing that contract.
phones4u sales people in their store are dicks, all they do it want to make a sell and then never see you again. they don't want to hear about any issues you're having or help you out at all once they've made the sale.
they used to say contract phones could be returned within the 14 cooling off period provided by the network provider but they seemed to have changed their tune now. see link:

the best bet you have now is calling phones4u customer service line, they are a heck of a lot more helpful than the sale driven idiots in their stores:

also a piece of advice, if you have spoken to customer service and they authorise the return make sure you get a reference number and then get to the store while the customer service lines are still open, otherwise they will make excuses like, no we don't take returns, can't find you case number on the system, well can't speak to customer service now as they are closed, you'll have to keep the phone (this happened to me)
o2 has a 14 day cooling off period which you can cancel and return the phone, but I am unsure of what the agreement is when you don't buy directly from them. But you can also call them for free from you o2 phone, on 202.
hope this helps you get this sorted, also if you feel that the people in store did not help you and pressured you into the contract, being unprofessional etc you should also make a complaint to the head office after this is all resolved and they may offer you some compensation.
btw, you will always likely to find a better deal online. and next time avoid phones4u like the plague, and always check if there is any cancellation policy. if not do not sign anything unless you are 100% sure its what you want and its the best deal.

i dont think its barred, it network locked, <--- maybe not
you need to find that person and ask him to ask his network to get it unlocked,
he will need the phone imei no.

If it is barred then you can't use a UK so you'll need to change the IMEI which in itself is illegal in the UK.
Each time you enter a sim it checks for the unique code which is registered when your phone is blocked. Hence why you'll get no signal.
An international sim will work if you are using it abroad.
However as posted by thunder it could be that the phone is network locked so only the original network sim will work you need to find out if it's network locked or actually blocked.

Use checkmend. Google it. Think it's £1.99 and it will tell you it's status. Wether it's network barred, reported lost or stolen.

Ask the seller for a refund. It could be a stolen phone or insurance scammed. I would first ask the seller and or contact the forum mods which in turn may tell you to go to the police if it's a stolen handset.
There is nothing you can do legally to change imei as this is illegal.

If an intermediary like PayPal was used, file a complaint immediately and dispute the transaction
Get in touch with your bank and file for a chargeback; with credit cards you have pretty much guaranteed cover here, for debit cards you should still be covered so long as it's VISA [1][2]
Also, don't forget that Distance Selling Regulations entitle you to an unconditional 7-day window for returning any good you're not happy with so long as it's in original condition (it is not necessary for the packaging to be in good condition or even present at all).
You can of course consider notifying the police too, but that may result in the phone being confiscated and you not getting your money back. If the seller won't respond to your contact now, the chargeback should get his attention and you can go ahead and return the phone if you like — then tell the police anyway once you have your money.
As I see it, you're most likely going to get your money back so long as the purchase wasn't below £100 and thus not eligible for cover (If you seriously thought you were getting a legit One X for this much WTF were you thinking?), done through pure cash, or past the claim time limit — if any of those are the case I guess you can treat this as a hard lesson in how to shop more carefully online.

DSR won't apply with this situation as it was a private sale according to the OP.
You have to be very careful when doing private sales on forums, same thing happened to me, bought my sister a SGS2 it came with a receipt and everything from a private seller, a year later she went to CPW to trade in and they found out that it was an insurance scammed phone! The odd thing was it wasn't barred as UK sims were still working in them but could have been barred at anytime.
Contact the seller, say if they don't give the only back you will contact the police as effectively this was a fraudulent sale, they probably won't do much at all but hey it'll make the seller aware you won't give up.
But contact the moderators of the forum you purchased this from and let them get involved as well.

Ah, didn't realise DSR didn't apply to such sales. As a general rule I avoid private selling like the plague because I've heard too many horror stories, unless it's via eBay which offers you somewhat reasonable protection and is why you should insist on going through such a medium unless you literally know the person.
OP: I think you can still go down the chargeback route though, have a look through the links I posted before and figure out if you can make a claim. You never know simply appealing to the seller's goodwill by saying it doesn't work may get you a refund, but I'm guessing not.
Hi i had this happen to me, i swapped my SGS 2 for another phone and the phone i swapped for become barred.. I didnt know what to do but a friend of mine said contact the police, so i did i gave them the persons name and contact number who i got it off and the police managed to get my phone back and it was in London too on its way to India (im from Sheffield). So i would suggest contacting the police worth a shot:good:

Good to hear a positive story for once with the feds doing something positive! Quie common for phones to end up back in Asia, big demand for them there as well as all the scams that go on with them!

I am always cautious, so before buying I requested ESN number from seller and called sprint to check phone, some women answered me and said Phone had no problem and I could go ahead and buy with sellers ask price. So I went to that buy and paid 400$. Later that day I called sprint again to double check, cuz phone was without box, after second attempt guy from Sprint that it was reported.
What should I do. Probably I don't have chance to prove that I bought it honestly. But as every carrier service records customer call, I can prove them that they gave me false information. I thought that owner could report it during that two owner difference between first call and second call but chance of that is very low

It was probably not reported yet. By the time you called again it was updated in the system. So no false info was given. That's why you should always meet at a Sprint store and do the change and activation on the spot. Nothing you can do now.

Maybe, I don't know... I can't afford 400$ lose..If I bring it to dealer and they flash it on Metro or other carrier, will 3G or 4G work and which carrier is best..
I don't know what to do, If I call owner he/she may not request to unlock phone, so I'd rather flash
What you SHOULD do is return the phone to Sprint and get it back to it's rightful owner. You can call the police on the person who sold you the stolen property and go after them for your money. It's wrong of you to keep something that you know isn't yours.
Sorry to hear this happen to you. You should have activated it on the spot to make sure it was good to go. And second. Why did you pay $400. The phones worth $300 max

Go to the police, make the report, your likely to get your money back and the evo to its original owner. Do it ASAP or the report isn't credible.

First of all unless this was a factory sealed phone you payed too much. I got my S3 in November 2012 and it was from a 3rd party Sprint seller on eBay, which is highly rated by a lot of people. It was an open box item and flawless, I got it for $350 with a 30 day return policy and some accessories. Second if you ever buy a phone off someone on craigslist make them meet you at a Sprint store and activate it while they are there then pay them, all done in the store in front of the workers. If they disagree say bye. Last but not least that could have been their phone for all you know. They could have sold you the phone that they got on their contract then the next day called Sprint and said my phone was lost/stolen here is my insurance cost of something like $150. They get new phone and make $250. Or they just stole it and sold it to you. So lesson learned I guess for you huh. Also Sprint "may record your call for quality assurance" not they record and keep every single phone made to them for quality assurance.

Only problem there is the seller can always play stupid and say he bought the phone from someone and was not aware it was stolen.

When it boils down to it, OP is now is possession of stolen property, which is a crime.
Go to the police or sprint and give the phone up. You can try to go to the police and take the seller to court. But is that time and effort really worth $400?

Most likely, real owner is covered by insurance, but still it does not matter. I would be glad if someone would return my stolen phone, so I will do the same.. I hope I will get my money back.

It wouldn't be like that. He just needs to go to the police. Sprint won't refund any money. If he goes to the police, they will figure everything out, and he will get his money back and likely not even have to go to court. Police have access to digital proof via messages or texts or various other things and can easily get it done.
Legally what happened would fall under fraud and robbery. As the item was stated as genuine and non stolen and in working order, and it happens to be stolen and not in activate able condition, that is fraud due to lying about the product, then he took your money knowingly for a broken product and getting away with money as if it was a clean esn. Ignore sprint, go straight to the police. Your money will be recovered and the phone returned to the right person. If it was him saying it was stolen, after the product was sold, then likely he will get the boot from sprint

Guys. I had that same thing happen to me. Got it off CL, turned out to be stolen.
Typed ##786# to get the number of the previous owner, because when tried calling the guy who sold i to me, number was unresponsive.
So, when i called the real owner she said phone was stolen, i was not smart to call from a blocked numer, but from my cell, so she had all my information and googled me threatening to turn me in for stealing.
I decided to beat her to it, and handed it over to the cops. She then called me mltiple times threatening, to which i replied i no longer had the phone.
Interesting fact, when the cop took the phone, he ran some check and did not find to be tolen, only sprint knew it was stolen, so unless i would have give him her cell, the phone would have probably sat around. They are not as sufisticated as we thing, this is not FBI or CIA, just some cop.
If u return to the police, do the ##786# and call the previous owner to tell them the stoy, otherwise dont waste your time, it took me 3 hrs waiting for cops at the police station to only hear phone is not stolen.

Legally what happened would fall under fraud and robbery. As the item was stated as genuine and non stolen and in working order, and it happens to be stolen and not in activate able condition, that is fraud due to lying about the product, then he took your money knowingly for a broken product and getting away with money as if it was a clean esn. Ignore sprint, go straight to the police. Your money will be recovered and the phone returned to the right person. If it was him saying it was stolen, after the product was sold, then likely he will get the boot from sprint

Police don't have any type of access to any digital records and "various other things" you speak of.
Once in court, the judge would have to issue a subpoena. Once issued, Sprint has a legal department that can release certain digital items.
When you print emails, they can be falsified. I honestly don't think cops care for you buying stolen goods as CL is at your own liability. No one is responsible for it but yourself.
I like how if you don't know an answer, people make stuff or voice how they think the world should work.

My whole family is police.. They deal with Craigs list stuff constantly. Most of the time they report results in the person getting their money back and the person who sold the stolen item gets dealt with whichever way they choose to,
Your not getting your money back unless you sell that phone to someone else. If you do that I highly doubt you get the full 400 but at least you get something back. It ain't right but hell I rather take that chance then waiting to take the person that sold you the phone to court . You won't win that case unless you signed a contract or have a receipt. These phones seriously need sim cards like T-Mobile and at&t and the rest of the world and you wouldn't have this problem. Whoever does this to somebody should seriously get a ass kicking, reading this pissed me off. The original owner of that phone sounds like the same person that sold it to you. He got the money then reported it stolen . Good luck on getting your money back but next time just add another line to your service and avoid the hassle.

Yeah I got my S3 from Craigslist in December for $300. I never bought a phone like this before but meeting at Sprint seemed like a no brainer ( and a deal breaker if they won't meet there) Seller had no problem meeting meand as soon as the Sprint rep activated the phone and I made a call on it, I handed her the money. Awesome deal considering the phone was only 2 days old, like brand new, in the box with accessories.
I got lucky that this girl didn't like the S3, and wanted her iphone back
But for the op. Hopefully you communicated with the seller by text. That's a record of the communications you can show the cops when you tell them what happened.

Okay, so the HTC One V is out of stock on VM's website and they are also out stock of the replacement class One V's... I called in to ask for a replacement since the speaker of one of my One V's began to sound garbled and the representative told me that the phone was getting phased out and that they would open a case for me and that they would call me back in 2-3 days but they never did.
What you got to do to get the upper-hand and get something out of your worthless warranty is simple.
1) Call in, get to a representative, and then ask to be transferred to a financial department representative.
2) Tell the financial department rep that you wanted a replacement for your "troubled" phone still under warranty, but that they no longer have new ones or replacements in stock, and that you were told to ask them for a phone of equal or greater value as a result.
3) If it is not possible to get a phone of equal or greater value (the rep tried to give me a Galaxy Reverb but I refused) tell him/her if you could then receive credit to get a different phone since the warranty you have is now worthless.
*) I didn't try to negotiate just how much credit I would receive, but the rep offered me $60 and I took it...lol
In the end I was able to fix the garbled speaker by removing the rubber cover around the camera and then pressing the speaker back onto the adhesive from which it got loose, so I got a working One V and $60 from the experience.
I'm not encouraging dishonesty by telling you to call them even though you have a perfectly good One V, but these guys gave me the run-a-round for two weeks before I got anywhere, and had to call the like 10+ plus times before a smart rep helped me out, so I say call them and get something for your useless warranty...

Oh relax... stealing is them offering me 60$ instead of them fulfilling their 1-year warranty. Stealing is customer support taking away my time by lying to me and saying that they've placed my replacement order when in fact they never did, even go as far as giving me a bogus order number that no other rep could pull up. They've got a few knowledgeable reps, but most of them are simply incompetent for the job they are doing... Anyway, I only got brave and fixed the phone myself after they told me there was nothing else they can do for me...
