So what's the basis of the lawsuit? "I don't understand the difference between messaging and data, so pay me money!"?
I can understand if it's something like Sprint charged Messaging plan customers data usage for sending MMS, since those are sent through the data network but negated on the backend since it's an MMS. Otherwise, it sounds stupid.

Clearly states unlimited pictures and videos but only on sprint network. But who knows if that was that way in 08. I don't even know if the everything messaging plan was around then.

Got this text today, too. Used about a gig of free wireless 4G tethering last night. Schmucks!
AT&T started sending out similar messages to iPhone users who were tethering.
So I see this clock in my text messages. What does it mean?

I thought the clock means scheduled message.

Really, wow I didn't mean to schedule any messages. How do you schedule a message?
So I went through that thread and deleted a few messages. I don't know if it's just a coincidence, but the clock changed to a green dot now.
I think I figured it out. I think that is their Google Talk status. I've never used Google Talk and didn't even know I had it, lol.

I'm pretty sure that is in fact what it means. I remember with my G1 that would happen sometimes. I think the orange means they are away and the green means they are online. It is kinda cool if you have limited texting because then you can just gtalk them if you know they are on.

every since I've had this plan my hot spot shows usage but I've never even turned it on... it increases everyday too. when I reached out to tech support on 3 different occasions they were stumped, not one of them had answer why this is happening. and on my roommates account, who's on my plan direct show any usage... so it can't be a simple error on how my account is set up.

If you mean what I'm showing in my picture, then don't worry. Your data isn't being used along with your WiFi and this is a known phenomenon (I mean, it's obviously happening to me too). No one has really been able to figure out exactly why it happens (to my knowledge).

I get it, too. Happens a couple times a week around the same time in the evenings. Doesn't seem to affect my data usage.
The AT&T visual voice mail app does this when you use it. It seems to always get its data from the cell network even when wifi is available. It's possible that other AT&T apps do likewise.

This isn't the cause because I've had Visual Voicemail disabled since updating to 5.1.1.
