Samsung allowed to sell Gallaxy Nexus in the US court hearing on Friday rules.
WASHINGTON (Reuters) - Samsung Electronics scored a partial victory against arch-foe Apple Inc on Friday after a U.S. appeals court lifted a freeze on sales of its Galaxy Nexus smartphones but upheld a lower court's decision to temporarily halt sales of its Galaxy 10.1 tablet computer.

I wonder how their shareholders feel about them pissing away money for an injunction that lasted a week. 96 million may not be much to them but the cost of this "thermonuclear war" that Steve Jobs vowed is starting to stack up.

Good point. Obviously they had it set in their minds already that their side was the strongest and they would get what they want. Obviously not, and it was kind of a dumb move for Apple.

The injunction isn't over. It was just temporarily lifted until Apple responds. And Apple gets the 96 million back assuming they win the case (and the judge seems to agree they will).

Yes. But the software patch Google has updated via OTA allows it to be sold again... right? They said the GNex should be back in the Play Store sometime next week.

Google doesn't get to make the decision that the software fix is enough. They still have to abide by the injunction. Everyone seems to gloss over this like Google makes the rules.

This comes down to who can waste the most money in this battle. The judge could likely uphold the ruling even if google updates the software.
This whole thing comes down to one factor. Apples iPhone 5 doesn't stack up, and they need to kill competition before it hits the market.

Now if they just weren't so damn slow in updating this phone with ICS. Or at least releasing some drivers and such so devs could get it done.
I swore I would never own another Samsung after the vibrant due to how slow Samsung was on dropping source and such...I got sucked in one again and sit in the same position again as the vibrant lol.
Frustrating for such an amazing phone to once again be limited by Samsung.

Several people I know have the iPhone 4S, I am not impressed. At all.

Europe doesn't have that many hardcore apple fan boys yet like we do here in the US. Plus I think the same iphone 4 design didn't help them too much but they still selling tons and tons of phones.

If I all my stuff was tied to the apple ecosystem it would be hard for me to change. plus the iphone 4s is not really outdated just boring UI and unable to open up a little bit more other than that their not missing anything but 1 or 2 things.

We can't just sell the phone off, because it's defective and that would be considering scamming. I would love to get a refund or exchange but we are unable to do so even within warranty, as this problem "does not exist."
I said in another topic that my complaints are directed the both Samsung for making this ****ty phone and ignoring the obvious problem, and to the phone companies for ignoring the problem not allowing refunds or exchanges.

Change.org Petition against Apple

Hello everyone,
If you don't know today is a bad day for Samsung Galaxy Nexus owners. If you haven't heard yet Apple Inc. won a preliminary ban against all Galaxy Nexus sales in the United States. This is bad for all things android and I have created a petition so hopefully all of you will sign it.

What really burns Apples ass is that Motorola used to make the Apple CPU (power-pc/G5 chip) and now Google owns Motorola
No petition will even raise an eyebrow, let alone get anything done.
This is how Apple does business...if you can't make a better product, keep them in court.
Apple definately spends way more in lawyer fees than it does on R&D.

It's also creating a belief, among the ignorant masses, that Google just copies what Apple created.
Works out for them both. The real losers here are Microsoft and RIM.
BTW, AFAIK the patch won't give google any of the 96M. Only proof that Apple wrongfully accused them can do that.

Dang. Looks like I held too long- was thinking of buying a gnex..
Seems like there is a consensus there are two reasons they stopped selling the gnex:
1. Update
2. because of the lawsuit thing.
As far as I understood the lawsuit (but im no lawyer) its a ban against samsung directly selling the gnexus while other vendors (VZ, google, etc) still can. truth? (if so why google play not selling it)
And is the update for JB then? Or did I miss some big news? Why not continue to sell it and upgrade prev models to JB OTA unless to build suspense/demand for it
EDIT: Found a good news article describing the situation. " Apple, as you might imagine, posted the bond quickly, and the Galaxy Nexus was pulled from the Google Play store and other online retailers" apparently the ban applies to all stores but there is hope!
"According to a report from AllThingsD, Google and Samsung have prepared a software patch for the Galaxy Nexus that should resolve the patent infringement on which the injunction is based, allowing the Galaxy Nexus to go back on sale."

What the article fails to mention is that most of those patents could never be used to critically damage Google because Google could argue that it would destroy competition/ put them out of business/ create a monopoly. In other words, not happening.

I agree with this completely. All that would be required to stall a potential suit, is an anti-competition counter suit. Federal laws are in place to prevent power moves, like the ones Apple has been pulling lately.

I think you fail to understand what really happens. Apple attacks all android vendors with patents. What generally happens in this case is that both parties raise a mutual agreement and the "infringer" pays licensing fees to the other. But with Apple, it's different, they don't want royalties or money of any kind, they want to destroy the others. So the others have no choice but fighting back with the same weapons.
Patents have been weapons like in the cold war days for quite some time now, nobody dared attacking, fearing mutual destruction, now one vendor has been stupid enough to start the war without willing to discuss, so the other partied have no other choice than either dying or fighting back. Google doesn't do evil here, they just do what is needed to stay alive.
We all knew this was coming. Google has stated repeatedly that the reason they bought Motorola was for their patents.

Man, theres a limit to how much abuse one can take
Letting apple step over them wont make them "not evil", it would make them stupid
