I know the 4G is unlimited but I thought the extra $10 was not for 4G, according to Sprint. They said that it was for the data that will be used. So then I ask, is the 3G unlimited if you have the EVO phone?

He was correct - the $10 does get you unlimited data. You posted the wrong link.
From your link (which are Sprint's standard T&C's)
Data Usage Limitation (Mobile Broadband Cards, USB Modems, Embedded Modems and Phone-As-Modem):The amount of data transmitted over our network is measured in kilobytes (KB), megabytes (MB) or gigabytes (GB). Sprint reserves the right to limit throughput speeds or amount of data transferred; and to deny, terminate, modify, disconnect or suspend service if usage either exceeds (a.) 5GB/month in total, unless specified otherwise or (b.) 300MB/month while off-network roaming. 1024KB equal 1MB. 1024MB equal 1GB.
See how it calls out specific devices, and services? If you go to any of the plan information for those devices and services, they take special care to call out that you'll be limited to 5GB - even on the 3G/4G data cards, they specifically note that the only 3G service is capped, and the 4G service is unlimited.

And they explain at that url that the data services are really unlimited for the Evo (as long as you're on Sprint's network, that is). They specifically define unlimited for both the 4G and 3G networks as;

Also, using the Evo as a hotspot is not the same as the "Phone-As-Modem" mentioned in the regular T&C's that you linked to. "Phone-As_Modem" refers to specific Sprint product called "Phone-As-Modem" (which is why it's capitalized). It's a service which is now limited to only a few business plans that have it grandfathered in, where you could pay an extra $15 on your 3G smartphone (something like the intrepid, touch pro2, or one of the older instincts - it may have also been available for dumbphones, but I'm not sure) and you would be able to legally tether your it to a computer to up to 5GB.
finally, if you check out Sprint's printed marketing material for the Evo, I'm pretty sure it specifies that the data is unlimited in the fine print there too.

there is a lot of grey with this, so im not saying yes or no, but by reading what i linked, there is a limit.

That "or" is a pretty big deal. I'm hearing that Sprint has either started, or will soon start, cracking down on those that use 300MB+ off network, even if a majority of the usage is on network. Some people have already received a note in their latest bill to that effect.
/I'm not a Sprint employee, but I work very closely with their marketing and branding teams.

dude, chill - I've not only read them, I quoted them in my post. It's the "or" that's important - it means they can cut you off if you hit 300MB off usage OR they can cut you off its just majority.
Believe me or not, that's up to you, but I work with this everyday, and you're going to see Sprint coming down more on that 300MB crowd going forward.

Yes - the prohibited uses clause is what it refers to, and that is still in effect on the evo, but has nothing to do with data caps. This clause states
Our data services may not be used: (i) to generate excessive amounts of Internet traffic through the continuous, unattended streaming, downloading or uploading of videos or other files or to operate hosting services including, but not limited to, web or gaming hosting; (ii) to maintain continuous active network connections to the Internet such as through a web camera or machine-to-machine connections that do not involve active participation by a person; (iii) to disrupt email use by others using automated or manual routines, including, but not limited to "auto-responders" or cancel bots or other similar routines; (iv) to transmit or facilitate any unsolicited or unauthorized advertising, telemarketing, promotional materials, "junk mail", unsolicited commercial or bulk email, or fax; (v) for activities adversely affecting the ability of other people or systems to use either Sprint's wireless services or other parties' Internet-based resources, including, but not limited to, "denial of service" (DoS) attacks against another network host or individual user; (vi) for an activity that connects any device to Personal Computers (including without limitation, laptops), or other equipment for the purpose of transmitting wireless data over the network (unless customer is using a plan designated for such usage); or (vi) for any other reason that, in our sole discretion violates our policy of providing service for individual use.

It is unlimited for both 3G and 4G as long as you are not roaming. There was a typo on Sprint's website that said it was limited at 5Gig but they have corrected it already.

It will never stop. Funny thing is, after jumping from T-Mobile and AT&T...Sprint is way cheaper. People can easily find discounts online to help offset the $10 fee
Just wondering if anyone has gotten throttled, and if you've been able to get around it by changing apn... (Im deathly afraid of getting throttled, but if I just get bumped down to HSPA+ its not a big deal)
My understanding is that AT&T doesn't throttle, they just keep adding 1gb to your usage for $10 everytime you go over.
So if you're on their 2gb plan and use 10gb in a month, that's 8gb over your plan at $10 per gig = $80 extra for that month.
...Personally, I'd rather be throttled.
For those that are still on the Unlimited Data plan (myself) you get throttled. I believe their rule is after 5GB of usage in a month you are reduced to EDGE speeds.

I'm on an unlimited plan and I got throttled after using only 2GBs. It was a weird situation though, and changing the APN got me back to HSPA+ speeds but no LTE. I couldn't get Visual Voicemail to work either and had to check it the old-fashioned way but others on the forum have switched APNs and reported no issues with Visual Voicemail.
I'm going to have to show my buddy with the Skyrocket how to add the HSPA+ APN then. That's one trick I've learned so far. He got throttled last month cause he's constantly using LTE.

Were you using LTE data prior to getting throttled?
In my experience ATT throttle starts 15th to the end of each month, at least in the peak hours.

I thought it was based on your billing cycle and your usage. Or are you saying it's across the board for all users?
AT&T says if you are in the top 5% of data users then you are subject to throttling once you hit the threshold of that top 5% percent. I think it's crap, some say it's justified in order to keep the network up to par.

As of it's "justified" crap: how about the fact that they give you unlimited usage plan but limiting it?
It's bull**** to me. If you can't handle this many users, then perhaps you should not have so many users...

You need to put "Unlimited" in italics for AT&T too. They're all throttled now like T-Mobile.

That's interesting because I thought this would be the case with Verizon's network optimization crap...but from what I found out it only effects 3G devices only and it is on a tower by tower basis.
I guess they are really trying to get people off those 3G devices so they can upgrade their entire network to 4G

The throttling is a per account basis (throttling per tower is silly), and only the top 5%. Takes a lot to get there on 3G.

I've read otherwise. That Verizon's throttling is a lot more dynamic and considers a lot more factors like congestion, data plan, data usage, location blah blah blah. Whether it is true or not I don't know. But it does seem like fewer Verizon users get throttled than atnt sneaky misleading tactics. Who knows?

Actually its on a tower by tower basis, so if I am a top 5% user on a crowded tower I will be throttled, however if the tower is not crowded I will not. That is how the system works. And by top 5% they mean anyone who uses over 2GB of data per month.

I was curious about differences between data plans. I'm grandfathered in to unlimited data and I've heard that they will throttle your data speed if your in the top nth% of bandwidth usage. Is there any way to get an idea of how many gb of data that actually is?
And are there any cases where at&t has taken unlimited data away for abusing it?
I was downloading 700mb ROM on LTE and it took like 60 second which is faster than wifi, but I sure as hell wouldn't do that if I was on a 3gb plan.

Every month that I hit 3GBs of data use, I get throttled. I have been told that people grandfathered into the Unlimited Data Plan and using an LTE phone get throttled at 5 GBs of data usage. This will be my first month on LTE, so I guess we will see! Until now I have been on a 3G plan, so I am hoping that it does change it to 5 GB or higher.
I got throttled @ 5GB on LTE about 5 days ago with 12 more days left on my billing cycle
It's actually not that bad being throttled...it's capped to only about 600Mbps. The thing is at network access starts fasts but quickly slows down to 600Mbps. Due to this web browsing, emailing, and messaging doesn't seem any slower as they usually require short/brief network access. What is noticeable is Youtube performance and updating/downloading apps via GooglePlay.

Same I get throttled at 5gbs. I usually hit that around 2 week mark. But u start to see slow speeds when on YouTube downloading etc.

I've read that if you get throttled on the LTE plan @ 5GBs you can switch your APN over to the "4G" (e.g. ATT APN used on the SGH-I777) and you can get highers speeds (not LTE) until you hit 3GBs cap.
Haven't tried it out myself.

You are correct, that's what I do everytime I hit my 5GB limit., just switch to 'phone' APN and change you connection type to not look for LTE. works like a champ.

My phone still says ~8Gb, but AT&T now says 5.1Gb. My speed is now around 600Kbps down and 2Mbps up, where it used to be 16Mbps down and 6Mbps up. I haven't tried the APN switch, but I might try it if I get throttled earlier in the month.

You say "600 Mbps" but I really think you mean 600 Kbps. There's a big difference and 600 Kbps is actually painfully slow when you're coming from 8-25 Mbps depending on if you have HSPA, HSPA+ or LTE. My home internet connection is 889 Kbps and it's really slow for downloading large ROMs. So unfortunately I have been quite reluctant to download ROMs from my phone because I don't want to get throttle on my unlimited plan. It looks like I will continue to not go over my 5 Gb soft cap so I won't be throttled. I might as well not have unlimited
Think about this. Yes we get throttled at 5gb. But, we pay the same as a tiered 3gb plan. And even if we hit 5GB, we don't get charged an extra $10 for more data.
I do agree and I'm just nit picking. I consider myself lucky that still have an unlimited plan. My situation may be a bit different than others because my phone is by far the fastest data connection I have. Period. Way faster than my home or my job, so I have a tendency to use it for everything. I feel as though they could give people more data though. I realize that a 'small percentage' use over 5 gb, but I don't see a problem with doubling all the tiered plans including those with grandfathered unlimited plans soft cap. AT&T has a LOT of money.

They throttled me at the 2gb mark. Called them and *****es them out something fierce. They told me it was because it was I had gone over 2gb in one cycle. I asked them about the past where the website said I had used 17gb. Didn't get throttled then, why now?
Dude couldn't give me an answer. I think the system picked up on my because I sent the *3282# to see what my data usage was.
After I got off the phone with them, researched and forunf the other apn settings to use, no problems thus far. No throttling, no slowdowns. That was with my galaxy note i717.
Not I have a razr xt910, don't bother to check my data and, no throttling.

There is a delay between usage and throttle. I think it's 1 but may be 2 days actually.

I got throttled last month. Little after 5 gigs. Too many Rom and large files download testing lte. My speeds were crawling. I had to connect to wifi to download 5+ mb apps. Needless to say, i.use wifi now. Nooo matter how slow it is.

I haven't seen anybody comment on this thread regarding ATT's speed reduction after 5GB, sorry if I missed it.
I have an "unlimited" plan and recently hit 5GB of data. (Lots of in car videos.) I had no idea AT&T would throttle down my bandwidth so much! Are there any workarounds for this. After I hit 5GB, they have limited me to about 500kbps for the rest of the billing cycle, it's horrible.
It's this throttle down done at the network level, or is there something I can do in the phone to trick it?

Its known fact. if you are on 4G plan, ATT throttle @ 3GB, for LTE plan throttle @ 5GB
Grandfathered unlimited plans should throttle at 5gb. check your bill but if you are grandfathered you most likely have the 5gb lte.
Wish that there was something that could be done, but that is the fine print. Honestly I think it is false advertising to say you have an Unlimited plan. You have a 5GB plan + additional severely crippled data. Wait until voice over LTE (VoLTE). It will only get worse. Trust me.
I'm not sure if something is different with my data plan since I have a business account, but my speed is not throttled late at night. I haven't figured out the exact time range but I've used about 8 gbs so far and late at night my speeds are 16-20 megabits in my area. During the day however it is around 60 Kilobytes/s. I have been ballsy and tether from it on my computer since my home Internet out here in the boonies is 889 kilobits/s.

For AT&T, it is based off of your area and the current load on the network. If it's busy hour, and your in a busy area, you will be throttled much harder. My sister in law, who is on my family plan, CONSTANTLY gets 12+ gig a month on LTE in the next town over. She moved from my house, in a much more congested area, where she would get throttled hard at 5 gig on the nose.
So based on your area, throtteling may not have slow you down much at all.
I just hit 4GB and I have 9 days left in my billing cycle. I never have used more than 5GB. I should go over to see if I am throttled here in Dallas.
Yeah this happened to me a couple of months ago, I am on AT&T with unlimited plan and once I reach 5GB limit my connection on my phone goes down to Dial-up speeds, the reason they do this is to minimize slowdown on the network which makes sense
This happened to me last month. I was flashing and reflashing like a mad man thinking it was on my end. I was getting less than a mb down. Turned out that's what it was

You could join the law suit against them for false advertising. I know when I signed up for unlimited about 10 yrs ago there was no fine print stateing I would be throttled. I'm sorry.. Unlimited should mean unlimited. And people are winning in court from time to time.
